ENCINITAS, Calif. (KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20.  She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away.  1259

Fed up with limited leg room onboard airline cabins?Italian seat manufacturer Aviointeriors has come up with a design that allows passengers to stretch their legs as much as they want when they travel without any extra cost.The catch? The seats are so far upright that they'll be pretty much standing up.Unveiled at the Aircraft Interiors Expo 2018 in Hamburg, the SkyRider 2.0 aims to help airlines squeeze in more passengers by allowing an "ultra-high density" and reducing the space between rows.It's a new and improved version of a design the manufacturer revealed in 2010 but failed to get off the ground.The original Skyrider, which was was not approved by the US Federal Aviation Administration, was designed in the style of a horse saddle.Aviointeriors compared the seating position to that of a horseback rider, pointing out that cowboys can sit on saddles for hours without feeling uncomfortable.Stand up idea?The revised seats have extra padding, as well as poles to connect each row from the ceiling to the cabin floor.According to Aviointeriors, the SkyRider 2.0 "ensures an increased upright passenger position, allowing installation of the seat at a reduced pitch, while maintaining an adequate comfort."While it remains to be seen whether Aviointeriors' definition of "adequate comfort" matches the average person's, the company stresses that the seats, designed for short haul flights, have many benefits."The design of this seat enables to increase the passenger number by 20% allowing increasing profits for airline companies," says a spokesperson for Aviointeriors."Furthermore, Sky Rider 2.0 weighs 50% less than standard economy class seats and the reduced number of components enable minimum maintenance costs."Will it take off?The concept of vertical seats has been floating around for nearly two decades.Airbus proposed the idea of standing room flights as early as 2003 and in 2010, Ryanair's CEO Michael O'Leary announced that he was considering introducing special standing-room only areas of his airplanes.But the airline seems to have abandoned the idea for the time being."We have no plans to trial or introduce standing flights," a spokesperson told CNN last year.While Aviointeriors has dubbed the Skyrider 2.0 "the new frontier of low cost tickets and passenger experience," aircraft specialists have pointed out various stumbling blocks ranging from potential evacuation delays due to limited space and the fact that there is no room under the seats for personal items.The innovative seat is yet to be snapped up by an airline.   2592

ESCONDIDO, Calif. (KGTV) -- The County is investigating complaints from neighbors that a business owner with a criminal history for fraud may have converted a former hotel into a drug treatment center without proper permitting.Residents living near the former site of the Tuscany Village Resort on Circle R Way in unincorporated Escondido say they started noticing people wandering trough their neighborhood this summer."The people that are staying there have told us they're getting treatment," said one neighbor, who asked not to be identified.The property was acquired in March by NSI Services, LLC, according to public records. The company identifies itself as a "drug rehab" in its incorporating paperwork."Our concern is the safety and well-being of our community with a gentleman who seems to have disregard for the law," the resident said.NSI Services is owned by Larry Burns, an entrepreneur with several aliases who served prison time for mail and wire fraud and has been charged with crimes in at least three states.Burns, who also goes by Lawrence Burzynski, did not respond to phone calls by 10News seeking comment Monday or Tuesday.Burns was once the president of the Escondido-based Crosby Centers and is listed as a director of the Crosby Clinic on its website. Neighbors say they've seen a Crosby Clinic van parked at the resort.The clinic advertises drug rehab services along with treatments for traumatic brain injuries and CTE, and attracted media attention for treating former NFL players. In 2015, the NFL Players Association issued a warning to players about Burns, urging players using his services to "exercise extreme caution."Burzynski "has accumulated numerous convictions for felony FRAUD related violations," the bulletin read. "He has been convicted in federal prosecutions in Wyoming, Colorado, California and elsewhere."The old Tuscany Village Resort is not zoned for drug rehabilitation or medical services. After complaints by neighbors, code compliance inspectors began investigating the property on August 7, according to a letter from County Planning and Development Services Director Mark Wardlaw.The owner "indicated they had not yet finalized their plans for the property" but "noted that he may use the property as a resort that may also provide brain injury and other medical treatments," the letter stated. The owner, who was not identified in the letter, said he did not intend to offer drug or alcohol treatments at the facility."We will continue to keep our code compliance case open until we have received all the information required to classify the use," Wardlaw wrote.Staff gave the owner a 0 citation on September 12 for improperly storing items in the parking lot. When a 10News reporter visited the property Monday, there was still furniture and other items in the parking lot.The owner has until October 9 to clean up the property, said County spokeswoman Tammy Glenn."We will continue to update residents in the area and work with the property owner to ensure compliance with County codes," she said.Late Tuesday, a man who identified himself as one of Burns' employees contacted 10News, saying the hotel was undergoing renovations and would open next year as a Bavarian-style spa. The man named Jeff said other than himself, no other Crosby Clinic employees were working at the property and the resort would not be used for drug treatment."They think because they see a Crosby van it's going to be drug and alcohol [treatment], but that's not the case," he said. "It's going to be a whole different place" with water falls and a new pool, he added. 3616

ESCONDIDO (KGTV) -- Escondido police arrested a man with prior criminal convictions Thursday after they found him passed out in his vehicle wearing a ballistic vest and loaded rifle magazines in his front passenger seat. He also had other weapons and police gear he'd allegedly stolen from a law enforcement officer in San Diego, authorities said.According to a release from Escondido Police Department, officers found the man after a caller reported him passed out around 1:10 a.m. outside the 7-Eleven on West Ninth Avenue. The caller said the man was likely under the influence of drugs and did not respond to attempts at waking him.When officers arrived on scene, they recognized the man as 30-year-old Thomas Vann, who has prior criminal convictions. He was wearing a ballistic vest with loaded rifle magazines that were "plainly visible" on the front passenger seat.Officers were able to wake Vann and detain him. They searched his vehicle and found four fully loaded rifle magazines, 126 rounds of rifle and shotgun ammunition, and stolen police gear, including a tactical vest, a duty belt, a medical kit, and handcuffs. Officers determined the police gear was stolen Wednesday from a law enforcement officer in San Diego. They also found 392 grams of methamphetamine and 78 grams of heroin.Vann was arrested and booked into the Vista Detention Facility on numerous drugs, weapons, and stolen property charges. 1426

ENCINITAS, Calif. (KGTV) -- Encinitas resident Amy Dixon was always an avid athlete growing up in Connecticut, but in her 20's, her life would change forever. She noticed while working at a restaurant, she kept bumping into things, and later became very concerned when she fell down the stairs at her home. She says her vision was fine when looking straight ahead, but was losing sight from the outside in. A doctor originally though she had a detached retina, but that wouldn't be the case."It was this rare disease and it was progressive. At the time they thought I was going to be totally blind within a year."She would lose 98% of her vision, and started to think her days as an athlete were over."The words athlete and blind were not in the same sentence for me."The treatment for her disease was to suppress the immune system, but the medication she was taking caused her to put on weight. That's when she started swimming, riding a spin bike, and jogging."Someone said your swimming, you're biking, and you're running. Have you ever thought about doing triathlons?"She thought it sounded terrifying but fun. And not only did she give it a try, she excelled."I'm currently ranked number 6 in the world and number 1 in the United States."With 98% vision loss, she has implants in her eyes to help her see. Then she was introduced to Iris Vision. A product which at first glance looks like goggles. But for Amy, it would totally change the way she trained."It increases my visual fields," she says. "My vision is super tiny, it's like looking through a straw. What's cool about Iris Vision, is it allows me to see my computer screen, and more importantly, I can now see my heart rate and what my speed is. I'm can now see what the prescribed workout is that my coach sent to me."She has become a very successful triathlete, as she made the national team back in 2015. She was an alternate for the Paralympic Games in Rio in 2016. She was training for the 2020 games Tokyo when the COVID-19 pandemic hit."I am 44 years old and my disease is very challenging. It takes a huge team of doctors, because my eye disease is an autoimmune condition. So to get to Tokyo is pretty miraculous at my age. When everything got delayed it meant another hard year of training, and fund raising trying to cover travel expenses for me and my guide." 2347
