Chad Daybell, the husband of a woman whose children have been missing since September, appeared in court on Wednesday after two sets of human remains were found on his property.During Wednesday's court appearance, prosecutor Rob Wood said the remains were those of 7-year-old Joshua "JJ" Vallow and 17-year-old Tylee Ryan, both of whom have been missing since September.Kay Woodcock, JJ's grandmother, also confirmed to East Idaho News that one set of the remains are those of her grandson's.Police have not yet publicly confirmed the identity of the remains.Daybell faces two counts of evidence destruction, alteration or concealment. His bail was set at million. Should Daybell make bail, he will be required to stay in certain parts of Idaho and will wear an ankle monitor. He also cannot have contact with the families of the victims. Daybell was arrested Tuesday shortly after police served a search warrant on his home in Idaho. Two criminal complaints allege Daybell willfully concealed or aided and abetted in the willful concealment of human remains, "knowing that said human remains were about to be produced, used and/or discovered as evidence in a felony proceeding, inquiry and/or investigation authorized by law, with the intent to prevent it from being so produced, used and/or discovered."Daybell is married to Lori Vallow, the mother of JJ and Tylee. She was arrested in Hawaii in connection with her children's disappearance on Feb. 20 and was extradited back to Idaho. She remained jailed despite several attempts to lower her bond.JJ and Tylee went missing in September, shortly after Daybell and Vallow married. Daybell's former wife, Tammy, died of what was believed to be natural causes shortly before Daybell and Vallow married. CARLSBAD (KGTV) -- A slope in Carlsbad is moving, affecting a senior community on top of it. The question of who is responsible for paying to fix it has the City of Carlsbad battling with those who live in Camino Hills.“It’s been a tremendously stressful experience for everyone,” said Mike Perry, who has lived in Camino Hills since 2001. Joe Matthews has called the Camino Hills community his home for about 19 years. “We have lunch out here, sometimes dinner,” Matthews said, as he showed Team 10 the front patio area where he relaxes with his wife. “The grandkids come visit.”“It’s a really wonderful community,” Mathews added. What he did not know was something was going on beneath the surface. “It came as a real surprise,” Matthews said. According to court documents filed by the Camino Hills Homeowners Association in 2018, the City of Carlsbad noticed damage to the pavement and sidewalk right by Camino Hills Drive back in 2007. In January 2009, a geotechnical firm placed devices in the slope to track the movement. There was more slope movement detected during the El Ni?o rainstorms from 2016 and 2017.To fix the issue, it could cost anywhere from 0,000 to about million, according to Elizabeth French. French represents the Camino Hills Homeowners Association. She said the city did not fix the problem properly in the first place. “The city actually knew that there was an ancient landslide at this location and rather than make the developer make a more expensive repair, they allowed the developer to put in a subsurface buttress made of soil, but in recognition that that wasn’t the best repair,” French said. She said when this community was being built, the City of Carlsbad entered an agreement with the developer of Camino Hills. In the indemnity agreement, French said it required the developer to fix any problems for up to 10 years after the community was built. Camino Hills was built in the mid-1980s and the developer is now out of business. French said the city is now asking the residents of Camino Hills to foot the bill.“There’s nothing in this association’s government documents alerting any of the prospective purchasers that there’s this enormous liability out there, that they could be tasked with addressing down the road and that kind of notice is required in the law,” French said.Joanne Stout’s modular home is right by Camino Hills Drive. “This is it. This is where I’m going to be until they carry me out of here,” Stout said. CARLSBAD, Calif. (KGTV) - Two teenagers were stopped in their tracks when they looked into a tree and found a creature looking back at them along a Carlsbad street.Two Fridays ago, around 10:30 a.m., a freshman college student did a double take while walking along Babilonia Street in the La Costa area. He called a friend, who drove right over. They made a quick recording."Omigod, look at him," one of the teens is heard whispering in the video.Perched in a tree, about 25 feet up, was a mountain lion, growling.The mother of one of the teens tells ABC 10News soon after they stopped recording, they looked up, and it was gone.Lauren DuBois of Project Wildlife at the San Diego Humane Society, says it's hard to tell the big cat whether the mountain lion was a juvenile or an adult. She says it's not surprising it was in a tree."Not unusual at all. They will climb trees, and rest in trees quite often," said DuBois.Dubois says it was likely relaxing after a long night."They can have up to 100 square miles of a territory. Most of time they are hunting from dusk to dawn, so a lot of the time, that’s where (tree) they will be resting," said DuBois.The concern? Less than half a mile away, is La Costa Meadows Elementary School, which began in-person learning in October.Neighbors tell us there have been sightings of a mountain lion in nearby Box Canyon for years. One of those neighbors did file a report of the most recent sighting with state Fish and Wildlife officials.DuBois say this big cat wasn't being aggressive. What about the growl?"Hey, I’m up here. Don’t want you to be there. I'm going to take off now," said Dubois.She says if you ever do spy a mountain lion in a tree, slowly back away and maintain eye contact."It's probably going to just leave. CHICAGO (KGTV) -- Police say three people were shot and one person is dead after a shooting at a Starbucks in Chicago Thursday night.According to ABC 7 in Chicago, the shooting happened in the city's Uptown neighborhood at 8:30 p.m. Police say a 12-year-old was transported to the hospital in unknown condition after being shot in the groin. An adult male was shot and took himself to the hospital.
