SAN DIEGO (KGTV) -- A Bald Eagle admitted to the San Diego Humane Society on Fourth of July died Tuesday, the organization said.According to the Humane Society, the eagle passed away after being sedated and anesthetized for an examination. SAN DIEGO (KGTV) -- Families worried about paying back rent due to the pandemic are getting more time.Tuesday, the San Diego City Council voted 5-4 to extendthe rent repayment period for commercial and residential renters to December 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would haveextended the repayment period for the eviction moratorium to March 31, 2021.Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergencyeviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused "substantial loss of income," according to city staff.Renters are also required to follow the rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.During the meeting, the council heard from landlords and realtors who say renters are taking advantage of the situation."The blanket moratorium has given criminals a free pass at the full expense of landlords, this is not a one size fits all," said property manager Claudia Cooper.Other callers said it would be a disaster to evict families just as children are starting school from home."Folks will be evicted and this pandemic won't be over anytime soon as the presentation mentioned, a lot of children are going to be learning from home and to be evicted right as school starts is just going to exacerbate the effect this pandemic has had on our kids," said one caller.Many callers said evictions must be prevented to avoid adding to the homeless problem."Many people have been out of work and eviction could mean death," said another caller.The moratorium on evictions expires September 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through December 30."We are all in it together," Gomez said before discussion of themotion. "The economy is not fully restored. This is not an ideal policy, butit's a necessity for what we are dealing with."Gomez represents District 9, which encompasses Southcrest, CityHeights, Rolando and the College area. It has also been one of the mostimpacted areas during the pandemic.According to a member of Gomez' staff, which gave the presentationon the topic, the city had started 15,659 rental relief applications usingfederal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday,not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent."It's a cruel hoax," she said. Bry said that by not paying rent ontime, tenants could be destroying their credit and leaving themselves withmountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, manyurging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright.About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.Councilmembers Chris Cate and Scott Sherman were opposed to theextension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year. SAN DIEGO (KGTV) - A 98-year-old woman is being evicted from her Ocean Beach home after living there for nearly three decades. Betty Morse moved into her tiny Ocean Beach cottage back in the late 1980’s. After her husband died, she needed a place she could afford. “I was by myself, but I managed,” Morse said. “I could walk to work.” Morse said the rent was about 0 when she moved in. “It was a beautiful place to live because you could walk to the beach and watch the sunset,” she said. This little place by the beach that fits her so well was supposed to be her last stop. "See, I figured I'd lived a wonderful life in Ocean Beach, and I want to live and die here, you know, because I feel so comfortable here,” Morse said. “It's my little house, and it's all I know.” Morse said this year she was asked to sign a new rental agreement. Her family had some disagreements with a couple of changes made by the landlord: one was a no-smoking addendum. Morse told 10News after decades of being a smoker at 98-years-old, she quit so she could stay in the home. Despite her efforts, she said after the attorneys went back and forth a few times, she received a 90-day-notice in July terminating her tenancy. Morse doesn't know what to do if she’s forced to leave. “I don’t know who will rent to me because in two months I’ll be 99 and they are not going to be happy to rent an apartment,” she said. During her 30 years at the property, Morse said she never had a problem with the rental. A fixture in the neighborhood, she knows San Diego Mayor Kevin Faulconer and his mother. "She said, 'Kevin, I want a picture of Betty with you' and he said 'OK mom,'” she said. “He came over to the step and she said, 'She's very unsteady on her feet, Kevin, don't let her fall.'" Morse said her rent was always paid on time, a trait she picked up from the one man she ever loved. "Before he died, when he was in the ICU, he had a tube, but he wrote, don't forget to pay the rent.” A model tenant, Morse is using Section 8 housing assistance to help cover her rent. According to the termination notice she showed to 10News, the owner is electing to opt out of the Section 8 program and not renew the lease. It states the owner will be conducting substantial renovations to the unit and following the renovations the owner desires to rent the unit at a higher rental value, being that of the market rate value. The notice states the owner will be opting out of Section 8 entirely."They clearly state on their 90-day notice that their just cause is they don't want to comply with Section 8,” said Pamela Macias with San Diego County Evictions. Macias is working with Morse and her family to try and keep her in the home. "She's willing to pay market rent and just for no reason at all they want her out,” Macias said. Morse does have children, and instead of being out on the street she could move in with one of them. However, nearing the century mark she worries about being a burden.“I don't want to be in a nursing home either,” she said. “I still want to be independent.” The 90-day-notice has expired and Morse is still living in the property. The property owner filed an unlawful detainer, which is basically an eviction lawsuit. Team 10 contacted the owners of the property; they declined to comment due to pending litigation. Housing Assistance in San Diego The San Diego Housing Commission (SDHC) states that more than 6,000 landlords are participating in the rental assistance program. Most landlords don’t usually stop participating in the program, but it does happen, according to the commission. They say the Section 8 Housing Choice Voucher Rental Assistance program includes options to meet the needs of both landlords and tenants. Landlords can increase rents for rental-assistance tenants as they would for market-rate tenants as long as 60 days’ notice is provided to the rental assistance tenants and the new rent is determined to be reasonable.According to SDHC, to evaluate the reasonableness of the rent it compares the requested rent to the rents on other units on the premises with tenants who do not receive rental assistance. Right now, landlords are not required to accept tenants who receive Section 8 rental assistance. However, in August 2019 a new amendment to San Diego’s source of income ordinance will prevent landlords from declining a tenant based only on the household receiving rental assistance. “It opens large opportunities for our clients to receive assistance and utilize their voucher in the City of San Diego,” said Carrie Leverett, director of the SDHC rental assistance department. “It allows our clients to maintain affordable housing and find affordable housing. SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave.
