SAN DIEGO (CNS) - Mayor Kevin Faulconer announced today that all city-owned property along the San Diego River has been cleaned at least once. The city owns roughly one-third of riverfront property, and employees have removed nearly 99 tons of debris from 32 locations since last September, he said.Faulconer said the cleanup will continue, particularly in regard to outreach and coordination with owners of the remaining two-thirds of land along the river."The San Diego River is one of our most precious natural resources and we must continue to give it the care and attention it deserves," Faulconer said. SAN DIEGO (CNS) - A jury Monday began deliberating the fate of a man accused of fatally beating a senior citizen and going on a shopping spree with the victim's credit cards nearly two decades ago.Prosecutor Christina Arrollado asked jurors to find 39-year-old Edward Jamar Brooks guilty of first-degree murder.The 71-year-old victim, LeRay Parkins, was found in an alley off the 3700 block of 28th Street on Aug. 23, 2000. He died at a hospital three days later of injuries that included two skull fractures and brain bleeding.According to prosecutors, Parkins was out on a morning walk when he encountered Brooks and co-defendant Lester Bell.Brooks allegedly struck Parkins in the head with a bat, then rifled through the victim's pockets and took his wallet. Purchases were made with Perkins' credit card less than two hours later at a Spring Valley gas station and an Escondido clothing store, according to the District Attorney's Office.A baseball bat was later found at a Spring Valley home frequented by Bell and the getaway driver, Terrence Maurice Brown, but authorities lacked sufficient evidence at the time to arrest the trio for the murder, according to previous court testimony.The three were arrested in different states last summer: Brooks in North Carolina, Bell in Colorado and Brown in Arizona. Brown, 38, recently pleaded guilty to a robbery charge, while Bell, 39, pleaded guilty to voluntary manslaughter. Both men have yet to be sentenced.Brooks "took a baseball bat to the (victim's) skull," and his DNA was found on the victim's short pockets, Arrollado alleged in her closing argument.She said Parkins was a senior on his morning walk to stay healthy, and claims that he was "willing to get into a full-blown fight" with the defendants are false."Instead of coming home healthy and more vibrant, (Parkins) lay dying in alley, choking on this own blood," she told jurors.Arrollado also dismissed claims by Brooks' attorney, Robert Ford, that Bell and Brown were the real culprits who conspired against Brooks."If this is a frame-up job, it's the worst frame-up job in history," the deputy district attorney said. "These three set out looking for victims."Ford countered that if three people are involved in such a crime, accomplices "will say anything to save their own skin -- don't convict Mr. Brooks unless it's based on evidence." That evidence, Ford said, would include DNA on the baseball bat.Brooks admits to taking Parkins' wallet, and DNA evidence supports a robbery -- but not murder, the defense attorney said. SAN DIEGO (CNS) - A pedestrian was struck and killed by a Metropolitan Transit System trolley in San Ysidro, police said Friday.The crash happened shortly before 11:40 p.m. Thursday near the intersection of Beyer Boulevard and Smythe Avenue, San Diego police Sgt. Michael Stirk said. The intersection is just northeast of the Beyer Boulevard Trolley Station.The pedestrian was pronounced dead at the scene, Stirk said. SAN DIEGO (CNS) - A San Diego federal judge has again denied a Chula Vista church's request to challenge the state's COVID-19-related restrictions on indoor worship services.South Bay United Pentecostal Church, which lost a challenge to the restrictions earlier this year when the case went before the U.S. Supreme Court, filed an amended complaint this summer in its ongoing lawsuit arguing that California's restrictions on indoor services and singing are unconstitutional.U.S. District Judge Cynthia Bashant, who denied the church's request for a preliminary injunction in May, also denied South Bay United's latest request in a written order signed Wednesday.Bashant echoed much of her previous reasoning in denying the church's request, though South Bay United's latest complaint and her ruling took into account the shifting state of the virus locally.South Bay United argued in court papers that the state's "scientific pronouncements" are "largely baseless," as by "all reasonable scientific measurements," the COVID-19 health emergency "has ended."Bashant disagreed with the church's assessment of the current picture, and wrote that limitations to indoor worship attendance do not restrict one's ability to attend religious gatherings, as long as they are held outdoors.The judge wrote that the current COVID-19 situation in San Diego County holds that worship services may be held outdoors, with singing and chanting permitted. Indoor worship is limited to 100 people or 25% of building capacity -- whichever is fewer -- with singing and chanting prohibited.The church has argued that outdoor worship and services held over video-conferencing are "inadequate substitutes" and that the public health orders prohibit the church "from holding the services mandated by scripture."It also argued that California arbitrarily allowed certain sectors considered essential to stay open and conduct indoor operations, while discriminating against religious institutions.Bashant disagreed that public health officials have shown a pattern of discriminatory enforcement of COVID-19 health orders against religious institutions.She wrote that through Aug. 26, the county served 10 cease-and-desist orders or compliance letters to businesses or other entities, three of which were places of worship.Additionally, she wrote that through Aug. 26, 144 citations were issued for health order violations, none of which were to places of worship or people engaged in religious services. 2485
