SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business. (KGTV) - A new website from the City of San Diego's Planning Department is asking residents to help re-imagine the Clairemont neighborhood.Clairemontplan.org is like an online public meeting, where people can look at different ideas for adding housing and retail to the neighborhood and weigh in on which ones they like the most."We understand not everyone can make an in-person meeting at the time we schedule it for or attend a city council hearing in the middle of the day," says City Planning Director Mike Hansen.As MTS builds a new trolley line through Clairemont along the I-5, the area is coming up with a new community plan. The city wants to add housing and retail to the area to help meet new goals for housing, transportation and climate change.To do that, they're looking to add density to the neighborhood.The website identifies eight areas of Clairemont that could be redeveloped. It asks users to make changes to at least three areas while adding 5,000 new homes. At least 40% of the houses need to be near the trolley.To help, it offers basic renderings of what different development could look like in each neighborhood."We wanted to try to find something that allowed people to get into the weeds if they wanted to," says Tait Galloway, the Program Manager who helped design the website. "But, this still allows them to do it within 15-20 minutes."The website will be available until March 14th. After that, the answers will be collected and used as the city devises the new Clairemont Community Plan. They hope to present it by the end of 2020.City leaders hope this will become a template for other neighborhoods and a way to get more people involved in the process. But they are girding for the arrival of a weather system Sunday that will bring high winds and thunderstorms that could spark new fires and fan existing blazes that already destroyed nearly 1,000 homes and other structures and forced tens of thousands to evacuate. SAN FRANCISCO (AP) — A California state appeals court has thrown out the sole conviction against an immigrant who fatally shot a woman on the San Francisco waterfront in 2015.The 1st District Court of Appeal on Friday overturned a gun conviction against Jose Inez Garcia-Zarate because the judge failed to instruct the jury on one of his defenses.Garcia-Zarate was acquitted of murder in the killing of Kate Steinle, who was on a pier with her father when she was shot in the back in July 2015.The case of Garcia-Zarate, who was in the country illegally and had been deported five times, touched off a fierce immigration debate.He said he unwittingly picked up the gun wrapped in a T-shirt and it fired accidentally.Garcia-Zarate is in custody and facing federal gun charges. 783
