A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. A Catholic priest in Pennsylvania has been charged with indecent assault and corruption of a minor involving a 17-year-old girl, Lehigh County District Attorney Jim Martin said Tuesday.Father Kevin Lonergan, who served at the Cathedral of St. Catharine of Siena in Allentown, started sending sexual messages to the victim via Snapchat after meeting her at St. Francis of Assisi in Allentown, Martin said in a press conference.Martin said Lonergan also hugged the girl while he was aroused and grabbed her buttocks, pulling her closer when she tried to pull away.The victim told an adult at Central High School who contacted the diocese, Martin said. A dire warning from the National Weather Service has forced an evacuation around the College Lake Dam in Lynchburg, Virginia.A flash flood warning issued Thursday night by the NWS reports "if a complete failure of the dam occurs, the water depth at Lynchburg could exceed 17 feet in 7 minutes." The area impacted would be the city of Lynchburg, which is one mile downstream from the dam.An updated report issued just after midnight by the NWS said the dam has not failed, and is being closely monitored by emergency personnel for any signs of structural failure."Lynchburg Water Resources Department reported that 4 to 6 inches of heavy rain earlier in the evening caused College Lake to fill beyond its capacity.Piper Van dePerre, with the Lynchburg Department of Emergency Services, told CNN affiliate WDBJ that crews are working with a list of 124 residences that need to be evacuated because of the imminent threat of a dam break. A federal judge ordered the Trump administration to fully restore the Deferred Action for Childhood Arrivals program Friday and accept new applicants for the first time since 2017, according to media reports.A judge with the U.S. District Court in Brooklyn told the Department of Homeland Security to post a public notice by Monday that states they will accept DACA petitions from immigrants who qualify and are not currently enrolled.The judge also instructed DHS officials to grant approved applicants work permits that last two years, and not the one year limit the Trump administration had proposed, according to CBS News."DHS is DIRECTED to post a public notice, within 3 calendar days of this Order, to be displayed prominently on its website and on the websites of all other relevant agencies, that it is accepting first-time requests for consideration of deferred action under DACA, renewal requests, and advance parole requests, based on the terms of the DACA program prior to September 5, 2017, and in accordance with this court's Memorandum & Order of November 14, 2020," the judge wrote.The Trump administration tried to end DACA in 2017, but the U.S. Supreme Court ruled against him in June 2020. Wolf issued a memo in July saying that new applications for DACA would not be accepted and renewals would be limited to one year. The memo essentially suspended the program.Friday’s order follows a ruling in November from the same judge that found acting DHS secretary Chad Wolf did not have the legal authority to close DACA to new applicants, shorten the period for work permits or change protections from deportations.The judge ruled at the time Wolf’s appointment to his position violated the Homeland Security Act of 2002. A man and a woman were arrested in Arkansas on Tuesday after the woman's 1-year-old child was found dead in their bedroom closet. Fayetteville Police say that 21-year-old Tyler Hobbs called dispatchers stating that the child fell down the stairs and started seizing. He said that he performed CPR on the child but could not revive the child. Hobbs told police, “It happened a few days ago.” He explained that he got scared and did not know what to do.When officers arrived on the scene, they spoke with Hobbs and the child’s mother, 21-year-old Maria Giron-Molina.Inside the closet of the bedroom where the couple slept, officers found the child's body decomposing inside a plastic container that was covered with blankets.Hobbs later admitted to investigators that the child was crying uncontrollably and that it was giving him a headache. The child then knocked a picture frame and lamp off of a bedside table. Angered at the child’s refusal to calm down, police say that Hobbs picked the child up and covered its mouth with his hand to “muffle” the crying.Hobbs told investigators that the child hit and scratched him, so he shook the child back-and-forth. Hobbs said he blacked out, and when he “came to”, he saw the child was not breathing.He then performed CPR to attempt to revive the child. His initial effort was successful, but ultimately the child died without ever receiving medical attention, according to police.Hobbs said he was under the influence of marijuana at the time of the child’s death. He expressed remorse for his actions, and he said he did not intend to harm the child, police say.Hobbs was arrested for first-degree murder and abuse of a corpse. Giron-Molina was arrested for abuse of a corpse. 1761
