SAN DIEGO (KGTV) — A Superior Court judge gave San Diego County restaurants the green light to serve on-site again, but not all will make use of the opportunity.For Roddy Browning, the pressure to reopen his restaurant is intense.“We lay in bed at 2:30 in the morning, going, 'Okay, what am I going to do? What am I going to do tomorrow? What am I going to do the next day?'” said Browning, who owns Oceanside's Flying Pig Pub and Kitchen.Browning said sales are down 60% and employees have been reduced from 30 to 12. Reopening for outdoor dining under the new court ruling could boost those numbers.“The state's going to appeal it, and what is the point in opening back up again, and then bringing all these people back to work and saying okay guys the ruling changed, now we're going to have to kick you out of the restaurant again,” Browning said. “I don’t want to do that to my employees anymore.”Don't get him wrong. Browning does plan to reopen under the new court order - but he wants to respect the full three weeks intended in this latest shutdown order, set to complete on Dec. 28."This is not about us against them," Browning said. "We said we would give the governor his three weeks, and I'm going to give him his three weeks."But other San Diego restaurants are planning to remain takeout only until health officials advise otherwise.At Spring Valley's Cali-Comfort Barbecue, a gathering place for sports fans, owner Shawn Walchef says he's not offering indoor or outdoor dining.“We believe that the coronavirus is the antithesis of hospitality. Everything we do in our blood is to take care of people,” Walchef said. “Social distancing doesn’t work in our business. We welcome people into our homes.”Walchef cut about half of his staff - a day he calls his toughest as a restaurant owner.But he says Cali Comfort has fully embraced multiple digital ordering systems, helping it to remain profitable amid the pandemic.Still, the recent order impacts many. SAN DIEGO (KGTV) — An Ocean Beach man was injured after two men stormed his home, beat him, and robbed him.Police say the 34-year-old victim was at his home on Cape May Ave. with a woman, possibly an ex-girlfriend, when there was a knock at the door at about 10 p.m.The woman answered the door and two men forced their way inside, one wielding an expandable baton and the other with a knife, police said.A struggle began between the victim and two suspects and the two men beat the victim several times, before ordering him to open a safe.After the suspect was unable to open the safe, the suspects rummaged through the home and stole several items, including credit cards. The two men then fled.The woman fled shortly after as well.The victim was treated at a nearby hospital for non-life threatening injuries.Police described the suspect with a baton as a 20- to 25-year-old white male, 5-foot 10-inches, with thin build. He was wearing dark clothing and may have had his face painted black, police added. The man with the knife was described as a 25- to 30-year-old Hispanic man, 6-feet tall, weighing about 220 pounds, and wearing a black sweatshirt and jeans. SAN DIEGO (KGTV) - A woman who was hit by a car in Normal Heights says she’s been left stranded for six months after her wheelchair was damaged in the crash. Now, replacing it is a challenge. Pet photographer Tamandra Michaels’ love for the camera came to a pause after she was hit from behind while crossing the street.“It sent me flying," Michaels said. The wreck damaged her custom wheelchair, which cost more than ,000.“It slightly bent the frame to where one of the front wheels don’t quite hit the ground.” Michaels says Geico, the insurance company of the woman who hit her, won’t replace the wheelchair after giving them proof the chair must be replaced.“Months went by, they said they did some research and that the chair should only cost between ,500 to ,100," said Michaels. Michaels says without being able to work, she can’t afford to pay the difference.“It's incredibly frustrating. They’re treating it like its a car or maybe even a bike. This is like my legs; this is my life. SAN DIEGO (KGTV) -- An exclusive ABC 10News/San Diego Union-Tribune poll shows many City of San Diego voters are still undecided on some important races this November.The poll was conducted by SurveyUSA from Aug. 28-31, five weeks before mail-in voting begins.According to the poll, one of the closest races is for San Diego mayor, as both Democratic candidates -- City Councilwoman Barbara Bry and Assemblyman Todd Gloria -- are within a few percentage points of each other.The poll shows Bry ahead of Gloria 37 percent to 34 percent, with 29 percent undecided.Political analyst Kyra Greene told ABC 10News, “At this point in an election cycle, you would fully expect there would be more differentiation between the two candidates, but I think it’s a tough year because campaigns aren’t able to get out, talk to voters, so there are just a lot more people who are undecided.”Gloria’s campaign representatives said of the poll: “Our campaign has completed two polls recently and both show Todd with a double-digit lead. We are confident in their accuracy and will continue to run a campaign that focuses on finding solutions to the big issues facing San Diego."Bry’s campaign responded: “These results illustrate the dramatic shift in momentum since the March primary, when Assemblyman Gloria received 41 percent of the vote compared to Councilmember Bry's 23 percent.”In the race for San Diego City Attorney, the latest poll shows at least half of San Diego voters are undecided, but incumbent Mara Elliott leads challenger Cory Briggs by 10 percent.Several key ballot measures are set to be decided on Nov. 3, including Measure E and Measure B.Measure E would change the existing height limit on buildings in San Diego’s Midway District.The latest poll numbers are close -- 31 percent in favor of the measure -- but Greene said past voter trends could be an indicator.“The most common thing if people are not sure is they vote against the measure, which makes sense. They assume why change something if I’m not entirely sure what it’s about?” Greene said.Measure B would create an independent citizen’s review board to review actions taken by police.According to the poll, voters are showing clear support for the ballot measure, with 55 percent in favor.Greene said, “In part, it’s because it appeals to people across the spectrum of opinions about police accountability.”Ultimately, Greene said she believes results might not be completely clear on Election Day.“Given that people will be mailing in their ballot, we will have even more uncertainty on election night about which races and more questions about how soon they will be decided,” Greene said. 2666

SAN DIEGO (KGTV) -- An eventual return to outdoor dining for some North Park restaurants may not be an option due to a City of San Diego project.Right now, some businesses on 30th Street have left their outdoor dining structures just as they were before the latest stay-at-home order. However, concerns have been raised as the city’s pipeline replacement project, which includes a bike lane expansion, moves into its final stages.In a virtual meeting, city officials presented a plan to the North Park Main Street Business board of directors, informing business owners of what will be required of them as part of this construction. This will include restriping the bike lanes in their section and putting signage up.Several area business owners, like David Gamboa, were not happy to hear the plans. Business owners believe the project will cost them their parklets and outdoor dining spaces.“Not only are businesses scratching for every penny they can right now. Now we’re going to ask them to take their staff, time, and take whatever little money they have and stripe the street themselves. It seems crazy to me. It’s a big ask,” Gamboa said.The business owners are asking the city to delay the striping of the bike lanes until businesses can fully reopen.Typically, the city would require businesses to hire an engineer who would design a traffic plan. 1363
