LARGO, Florida — In the span of about 10 minutes, jurors in the sentencing trial of convicted cop killer Marco Parilla handed down two sentences. Only one was correct. And, it isn't what family members of fallen Tarpon Springs, Florida Police Officer Charles Kondek were hoping for.The jury had supposedly unanimously decided death was the appropriate penalty, but then the judge noticed some numbers scribbled out on the forms and asked the jury to go back and confirm all 12 jurors agreed on death.  Upon their return to the courtroom, the jury came back with a verdict of life in prison, as only 10 jurors voted for the death penalty and two for life in prison.The judge, explaining to Kondek's family and friends that under a new Florida law, the decision to sentence someone to death must be unanimous. The jurors made a paperwork error filling out their verdict that led to the confusion.Kondek's widow Theresa couldn't believe an error was made."Relief, we felt like justice was served for Charlie. We waited three years for this and then to have it taken away that was a little tough," Kondek said. "It’s closure for us. Obviously, we wanted the death penalty."Kondek said this chapter of her life is over and all she wants to do is move forward and live a life that will honor her fallen husband. "No one wins. Either way, my husband will never come home," Kondek said.  Parilla was convicted of murdering Officer Charles Kondek of the Tarpon Springs Police Department back in 2014.On Thursday, Parilla told the family he was ashamed of what he did and tried to apologize to the fallen officer's family.After learning Parilla would not face the death penalty, family members told him in their victim impact statements that they hoped he died in prison sooner rather than later."You are an animal and I hope you die the worst death possible, a shiv across the neck or something," Charles Kondek, the fallen officer's father told Parilla. 2038

LAGUNA BEACH – A Tesla sedan that was traveling in autopilot mode crashed into a parked police vehicle in Laguna Beach Tuesday, according to KABC.Both vehicles were damaged after the crash, which sent the police vehicle sliding onto a sidewalk.The police SUV was unoccupied at the time of the crash and he driver of the Tesla sedan received minor injuries.Tesla previously said that its autopilot systems shouldn’t be used in spots with intersections, stop signs, red lights or suddenly changing traffic patterns.Drivers are also supposed to keep their hands on the wheel to maintain control of the vehicle, Tesla says.The circumstances surrounding the crash are unknown at this time. 692

LAKE JACKSON, Texas — A Houston-area official says it will take 60 days to ensure a city drinking water system is purged of a deadly, microscopic parasite that led to the death of a 6-year-old boy earlier this month.The Texas Commission on Environmental Quality said earlier this week that it was developing a plan to flush and disinfect the water system.Mundo says Lake Jackson residents are urged to boil their tap water before using it.Texas Gov. Greg Abbott declared a state of disaster in Brazoria County over the weekend due to the presence of the microbe in the drinking water.Lake Jackson City Manager Modesto Mundo said Monday that three of 11 samples of the city's water indicated preliminary positive results for the naegleria fowleri microbe.One sample came from the home of Josiah McIntyre, a 6-year-old boy whom doctors said died earlier this month after being infected with the parasite.According to the Houston Chronicle, Josiah was tested for strep and COVID-19 when he came down with a fever. It wasn't until the disease had significantly progressed that doctors realized that N. fowleri was the culprit."He was an active little boy," Josiah's mother, Maria Castillo, told KTRK-TV in Houston. LAKELAND, Fla. -- A Florida bus attendant has been arrested for child abuse, according to the Polk County Sheriff's Office. Deputies say Brenda Nelson, 65, of Polk City has been charged with one count of child abuse for reportedly striking a special needs child on a school bus. On Wednesday, November 8 at about 4:23 p.m. the Transportation Safety Specialist told deputies a citizen complaint was received from a witness who reported she saw a bus attendant strike a female student on the head. The witness was not riding the bus. The witness advised officials that the incident took place on Wednesday, November 8 at approximately 3:58 p.m. The bus transports special needs children from the Doris Sanders Learning Center in Lakeland to their homes throughout Polk County, according to the Sheriff's Office. Deputies reviewed video footage that shows Nelson attempting to help a special needs child off of the bus. In the video, deputies say the victim was strapped to her seat by a "Houdini Harness" which is designed to significantly restrict her movement and mobility. At about 3:58 p.m., Brenda Nelson is seen on video walking by the victim and hitting her on the top of her head with an open left hand and saying "I'm gonna slap that tongue out of your mouth when I get up there."Two minutes later, the video shows Nelson walk behind the victim's seat, grab the victim by her hair and violently shake the victim's head back and forth and to the side, approximately four times. Deputies say after shaking the victim's head, Nelson was seen pulling something behind the victim's seat in an effort to tighten her harness. The victim attempted to reach behind her seat in the direction of Nelson and Nelson slapped the victim on the hand twice, according to the affidavit. According to the arrest affidavit, Nelson told the bus driver, Bradley Mckean, to take the victim home first, changing the regular bus route. Nelson was seen sitting next to the victim for the remainder of the bus ride and it appeared as if she was attempting to push the victim down into the seat to further limit her mobility. Deputies interviewed Nelson the following day. Nelson told deputies she did not remember hitting the victim on the head. She told deputies she was trying to get another child off the school bus and the victim kept on beating on the window and trying to get up out of her seat. Deputies did not observe the victim beating on the window of the school bus or acting in a disruptive manner as described by Nelson. Brenda stated, "I guess I done it. I didn't remember hitting her." Brenda also stated, "I must have just lost it. I don't remember doing that. I would never hit one of those kids."Brenda Nelson was arrested and transported to Polk County Jail.Due to the Veterans Day holiday, the Sheriff's Office does not have access to the video mentioned in the affidavit. The Polk County School Board released the following statement:  3005
