SAN DIEGO, Calif. (KGTV) - A former assistant at a local nursing home is accused of raping a disabled patient. In a story that you'll first see on 10News, Team 10 investigative reporter Jennifer Kastner discovered the patient was a stroke victim who uses a wheelchair. What may have happened behind the walls of the Paradise Hills nursing home is difficult to process. An accusation of rape seemed to have slid under the radar for almost a year, until now. It was a few months ago when 10News was tipped off about Reo Vista Healthcare Center, which touts being named one of Newsweek's top nursing homes and having a Medicare 5-star rating.This week, San Diego Police confirmed that detectives referred the case to the District Attorney's office, which is charging 26-year-old Ariel Chavarin-Camargo with forcible rape and a "lewd act upon a dependent adult by a caretaker". He is now sitting in a South Bay jail. According to state documents, it happened last February to a 58-year-old woman who uses a wheelchair and was living in the nursing home after suffering from a stroke and panic disorder. The documents report that the morning after the alleged assault, she reportedly came "crying" to a nurse, claiming that the night before, when she was returning from the kitchen and on her way back, "one of the CNAs (Certified Nursing Assistants) stated that one of her breasts was exposed." According to the documents, he “followed her and he exposed his private parts to her". She reportedly said, "the CNA raped her" for up to three minutes. A forensic exam reportedly found male DNA in her private area. According to the documents, when he was later questioned, he suggested that she came onto him but admitted "it happened” and “there was penetration". He reportedly said, "I feel bad. It happened so fast." Prosecutors believe that man is Chavarin-Camargo. He resigned after the reported rape. The administration of Reo Vista Healthcare Center sent 10News the following statement on Tuesday."We are grateful to local law enforcement and the District Attorney’s Office for successfully prosecuting this individual for their crime. Our team took immediate steps last February to suspend the individual, to notify, and to fully cooperate with authorities. We take all matters regarding patient safety and the conduct of staff seriously. Moreover, the actions of this individual do not reflect the values we hold at our facility. SAN DiEGO (KGTV) - Police deployed tasers to arrest a man following a road rage outburst that got out of control Wednesday evening.Police identified the man as 33-year-old Jason Berard. He was driving a silver SUV that backed into a white pickup truck near Park Boulevard and Howard Avenue in the University Heights neighborhood.  According to the driver of the pickup, they pulled over into a Chevron. The driver of the pickup truck thought they were going to exchange insurance information, but instead, Berard was confrontational.  According to witnesses, Berard punched the other driver before ripping away the man’s cell phone and throwing it on the ground, smashing it.A gas station employee called the police.  After police responded and made contact, police say Berard assaulted an officer. That’s when another officer came to help and fell to the ground during the struggle.Police say Berard took off on foot and got about a block down Howard Avenue but was taken down after an officer using their taser.Berard could be facing battery charges on an officer as well as resisting arrest. 1122

SAN FRANCISCO (AP) — Federal wildlife officials were urged Wednesday to withdraw a proposal to drop 1.5 tons of rat poison on remote islands off the coast of California to kill a mice infestation until it addresses questions on the impact to wildlife.The California Coastal Commission heard public comment on the U.S. Fish and Wildlife Service plan, which has drawn criticism from local conservation groups. The commission is seeking to determine whether the plan complies with state coastal management rules.The U.S. Fish and Wildlife Service said in a report presented to the commission in March that a massive house mice population is threatening the whole ecosystem on the rugged Farallon Islands, 27 miles (44 kilometers) off the coast of San Francisco.The archipelago is home to the largest seabird breeding colony in the contiguous United States, with approximately 300,000 to 350,000 birds of 13 species, including the rare ashy storm petrels. The islands are also used by marine mammal species for resting and breeding and by migratory birds.Federal wildlife officials proposed using helicopters to dump 2,900 pounds (1,315 kilograms) of cereal grain pellets laced with brodifacoum, an anticoagulant that causes rodents to bleed to death, which is banned in California.Officials acknowledged the plan will kill some seagulls and other species but argue that the benefits of eliminating the invasive species will heal the whole ecosystem."The only way to protect these species and allow the ecosystem to recover is 100% eradication of the mice," said Pete Warzibok, a biologist who has worked on the Farallon Islands for more than 20 years. "Anything else is simply a stopgap measure that will not adequately address the problem."Critics argued the poison will not only kill the mice, first introduced by ships that stopped in the islands 200 years ago, but also wildlife on the island and scavengers that would feed on the carcasses of the poisoned animals."These poisons are deadly, they persist in the environment for hundreds of days and they do kill animals," said Alison Hermance, the spokeswoman for the conservation group WildCare."The situation on the Farallon Islands has existed for decades. It does not need to be solved overnight with a massive poison drop," she said.The commission has no power to veto the plan but before federal officials can proceed, their plan needs approval from the various state and federal agencies.After a nearly two-hour hearing, commissioners said they still have questions on the impact to seabirds and other species. "We haven't been convinced that this is the best and only way to go," Commission Chair Dayna Bochco said.The commissioners asked federal officials to withdraw the proposal and resubmit it after their questions have been answered.The project would be implemented in the November-December time period when the mouse population is declining and food stressed, and would occur no sooner than late 2020. 2975

SAN DIEGO, Calif. (KGTV) - A third gender option will be available for California drivers licenses and ID’s starting in 2019. The law, SB 179, was signed by Governor Jerry Brown in October. It will allow people to apply for a ‘non-binary’ gender marker if they do not identify as either male or female. “For me, it was surprising to see this change,” said Al Johnson, a transgender activist and member of Trans Family Support Services. Johnson is non-binary and uses pronouns they/them. But with that surprise, came excitement. “Not only does it mean we’re being recognized by society and the people around us but were also being recognized by government entities as valid and real people,” they said. Johnson says they know people who plan on changing their gender to non-binary, but so far, they have not decided to do it on their own license. “I’ve definitely considered it, but in the end I don’t think I’m going to,” they said. “I just came out to my parents and in my personal life I’m trying to navigate that.” The DMV’s website is encouraging those who want to apply for the change to schedule an appointment as early as January 2, 2019. 1154

SAN DIEGO, Calif. (KGTV) - A gang member was sentenced to more than 126 years in prison Tuesday for the murder of Navy pilot James Celani at Horton Plaza in 2017."This is not living. This is hell," said Celani's cousin, Sean, who was also shot in the incident. "Mr. Morris killed my happiness and my life."Sean, who asked not to have his last name revealed, and Celani were at the Mad House Comedy Club that night. Upon leaving the club, they walked past a group of men, including Morris. Sean said he offered an innocent greeting, "What's up, brother?" At that point, Morris pulled a gun and opened fire, killing Celani and hitting Sean in the leg. Prosecutors say Morris, who has a history of violence, was angry because of a fight that evening with his girlfriend.Celani's wife spoke during a victim impact statement, describing how she and their three children have suffered since her husband's murder. She called for Morris to get the maximum sentence. "The system couldn't or wouldn't protect Jim and Sean from Arrow Morris, but you can safeguard society from Arrow Morris by letting the punishment fit the crime and sending him to prison for the rest of his life."Morris has 60 days to appeal his sentence. 1221
