OTAY MESA (CNS) - Border Patrol agents stopped a car in Otay Mesa and arrested five people, including a man who claimed to be a national guardsman from California, for alleged human smuggling, a Customs and Border Protection officer said Saturday.Around 3:45 p.m., Border Patrol agents stopped a car near the intersection of Alta Road and Otay Mesa Boulevard, according to Customs and Border Protection Officer Ralph Desio. The area is about a mile north of the U.S.-Mexico border.Agents interviewed the five people inside the car, all men, and determined two were U.S. citizens and the other three were undocumented Mexican nationals, Desio said. The driver of the car claimed to be a California National Guardsman in the process of separating from the service, according to Desio. California National Guard spokesman Lt. Col Jonathan Shirmo, however, told City News Service that the man was not a national guardsman, and was believed to be a U.S. Army reservist. The Army could not be immediately reached for comment. The five were all arrested, and the two citizens could face charges of human smuggling, Desio said. The three undocumented people were being held as witnesses in the case and will later face deportation proceedings, according to Desio. 1264

Nurses at an assisted living facility in Glendale, Arizona are facing backlash for filming and making fun of elderly patients. The video ended up posted to the social media site 'Snapchat'. The incident occurred at the Glencroft Senior Living facility.  An administrator from Glencroft told Phoenix-based KNXV that the facility cannot discuss personnel issues, but did learn about the video Monday morning and is taking the situation seriously. The video shows an elderly woman using a walker as she advances toward the camera. She is obviously agitated, telling the workers she "almost fell" and is seen asking for her pills. Instead of helping the woman, the nurses continue filming as they watch the woman and mock her.The video came to light after a whistleblower saw it on social media and alerted KNXV, as well as Glencroft, and the Arizona state agency that licenses nurses. She is also a nurse and said she knows the woman who made the video from nursing school. "It just disgusted me that you would treat someone like this," said the whistleblower, who asked to remain anonymous. "This lady obviously has some dementia or something going on."The whistleblower also said she is worried about violations of the patient's rights under the Health Insurance Portability and Accountability Act.  KNXV has reached out to the Arizona State Board of Nursing but has yet to receive an answer on this topic.  1468

On Aug. 26, 2017, 15-year-old Damon Grimes was involved in a police pursuit while driving an ATV. That pursuit ended in a crash on Detroit’s east side that claimed Grimes’ life.Using the Freedom of Information Act, 25-hours worth of video from police body cameras and dash cameras, surveillance video and cellphone video shot by witnesses were released that tell the story of the senseless death. They would not provide footage from the dash cam of the pursuit by MSP Troopers, Mark Bessner and Ethan Berger. At 5:31 p.m., the video shows Damon Grimes riding his ATV down Rossini Avenue and Gratiot in Detroit.Bessner requests priority to chase an ATV. “He flipped. Flipped!” said Detroit Police Officer Williams on the radio.“Yup, tell them there’s an accident,” said DPD Officer Boersman, who was first on the scene.Grimes hit a parked Ford F-150 with his ATV and he flew off the four-wheeler.“He’s got a pulse and he’s breathing,” said Bessner.“0-9, he’s slowed down, we tased him and he crashed out. Have EMS step it up,” said Bessner.“He’s got a pulse,” Bessner said.As Detroit Police Officer Kimberly Buckner heads to the scene in his squad car, you can hear radio chatter from MSP: “If you could just maybe have a unit or two make it there for moral support, sounds like it could be a pretty bad one.”“They never said what they were chasing him for just came over there and said MSP’s in a chase," said Officer Addison.“Don’t run from the State Police, you get f---ed up,” said one officer. Also on video, troopers can be seen attempting CPR on Grimes.“His pulse is weakening, what’s our ETA?” is heard on dispatch.“They tased his ass while he was cruising,” said an officer who walked up to Buckner as he covers her body cam.Buckner then shuts off her camera. As the ambulance arrived around 5:37 p.m., the stretcher is wheeled up to Grimes' body while another officer shuts off his body camera. At this point, Stephenson turns on her body cam.“Should we give them like an escort or something?” she asks DPD Officer Aubrey Wade. “Should we give them an escort to St. Johns?”“For him? Hell no!” said Wade.“They got lights and sirens. We only do that for police,” he said. “If an officer gets shot we’ll do that.”“I didn’t know they were chasing a four-wheeler,” said Stephenson.Grimes was pronounced dead on arrival at St. John’s Hospital.Due to his insensitive comments, Wade was reassigned.Bessner, the passenger in the MSP vehicle in pursuit, is accused of breaking protocol and taser use. He is awaiting an August murder trial. He resigned from Michigan State Police. The Grimes family has filed a million civil suit against Bessner. They have also filed a ,000 suit against Trooper Ethan Berger, the driver of the MSP pursuit vehicle. 2796

OCEANSIDE, Calif. (KGTV)- The freeway is back open in Oceanside after a big rig crash caused a major mess. It happened just after 10:30 a.m. on the southbound I-5 just north of Harbor Drive near Camp Pendleton. According to the CHP, the driver of a flatbed pulled off to the shoulder to check the equipment he was carrying. The driver of a big-rig hauling an excavator passed by and clipped the rear tire of the truck that was parked. The driver of the semi lost control, went down the embankment, hit a tree and flipped over. Remarkably, the driver is expected to be OK. "Very fortunate, judging the distance and the weight that we're looking at in these vehicles and the condition that the big rig is in that he sustained only minor injuries, " said CHP Officer Mark Latulippe. The big rig also caught on fire, but drivers stopped to help. "After the big rig had come to a stop on its side, a small fire had broken out. Some witnesses and passer-bys that had seen the crash actually stopped and put out the fire with some fire extinguishers," said Officer Latulippe. Clearing the wreckage was a long and complicated process."It's kind of a mess. There's a lot of pieces. It's entangled within a tree. The excavator is off the trailer, mostly off the trailer, the big rig truck tractor's portion of that is coming apart in pieces as we are trying to get it up," described Officer Latulippe. The number three and four lanes on the five south north of Harbor were shut down until around 530 pm. Traffic was backed up for miles. 1540

OCEANSIDE, Calif. (KGTV) - Two North County bars have voluntarily closed down because of positive COVID tests.Last Friday, Kate Dionisio went to dinner with her husband at Masters Kitchen and Cocktail."We had dinner and one drink, and stayed about an hour," said Dionisio.A week later, Dinoisio, who has an underlying health condition, says the night of celebration has sparked anxiety."Panic. Scary. We've been so careful with masks and taking precautions, but this felt out of my control," said Dionisio. On Thursday, on the bar's Facebook page, a message announced a recent positive coronavirus test and a voluntary closure for two weeks to best ensure everyone's "health and safety." The bar's owner says an employee was tested on Monday, with the positive result coming on Wednesday. The next day, the same day of the Masters post on Facebook, there was a similar message put up by Mission Avenue Bar and Grill, just a few blocks away. In this case, two employees tested positive. Their post stressed that safety is "our highest priority." It also promised a sanitization by a professional cleaning company. Their reopening date is to be determined, only after every returning staff member has tested negative. The owner of Masters Kitchen and Cocktail says there is no overlap in staff between the bars, but in their industry in Oceanside, "everyone knows everyone."The two bars are just a handful of local bars and restaurants to disclose positive COVID-19 tests. On their Facebook pages, customers weighed in and many lauded the transparency."It shows they respect their customers and care about the community," said Dionisio. In the end, Dionisio contacted the bar and found out the employee wasn't working the night she was there. 1746
