Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. Harbor Police say they're documenting each sail the company is doing and incorporating those into the original citation that it sent to the City Attorney's Office. 2046

A few years ago, came to this country, I had a goal and I came to live right. So I just want to keep continue living right. SAN DIEGO, Calif. (KGTV) -- A group of University City residents is suing the city of San Diego over its plan to pump sewage under their neighborhood to be turned into tap water. The nonprofit University City Community Foundation filed the lawsuit after raising ,000 from residents to challenge the environmental impact report for the city's Pure Water pipeline. The suit doesn't challenge the city's goal of making heavily treated reclaimed water one-third of its supply by 2035. The city says that will protect against future shortages and price increases. The lawsuit, however, says the city did not explore alternatives and did not adequately notify the public of the project's pipeline. It will pump sewage from the Morena Area, through Clairemont and University City, to a treatment plant at UTC. "There's no 100 percent guarantee that there could not be a leak, there could not be some discharge," said U.C. resident Barry Bernstein, who supports the lawsuit. "There could be some discharge. There may be some problems with the purification system."Ruth DeSantis, who heads the foundation, said the city and foundation are now in settlement talks. A city spokesman declined to comment on the lawsuit, but said there are multiple protections in place - including a system designed to immediately cut off to avoid sewage geysers. He said the city still plans to break ground on the project by early next year.  1476

  

SAN FRANCISCO (AP) -- California voters have rejected a ballot measure to require a doctor or highly trained nurse at each of California's 600 dialysis clinics.With more than 10 million votes tallied Tuesday, Proposition 23 had just 36% of votes.It drew more than 0 million in spending.Opponents, financed by dialysis clinic companies, say it would mandate that between two and three doctors at every facility, creating a financial burden that could lead some clinics to close.Proposition 23 was the second attempt by unions representing health care workers to increase regulation of dialysis clinics in California. 626
