SAN DIEGO (KGTV) -- A 74-year-old man reportedly hit a bicyclist with his truck in La Mesa Tuesday before leaving the scene thinking he simply hit a curb, police say. According to police, the crash happened on the 7000 block of University Avenue at 4:19 p.m. Tuesday. Police say the 74-year-old was driving his 1994 GMC pick-up truck when he turned right onto Harbinson Avenue and struck the 21-year-old bicyclist. Police say the cyclist was in a designated bicycle lane. The man kept driving, thinking he hit a curb, according to authorities. “When contacted by the police the driver of the pick-up truck was shocked to learn that he had hit a bicyclist and cooperated fully with the investigation,” La Mesa Police said in a news release. According to police, the bicyclist appeared to have a broken ankle as a result of the crash. Anyone with information is asked to call police at 619-667-1400. 906

SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) -- A 17-year-old boy accused of killing a Carlsbad woman on a popular hiking trail denied the allegations against him during a virtual arraignment Thursday morning.Through his attorney, the teen denied all allegations. He faces charges in connection with the Nov. 23 death of 68-year-old Lisa Thorborg.Thorborg was on a morning walk at Hosp Grove Trail when Carlsbad police investigators said she was attacked and stabbed to death.On Dec. 14, Carlsbad police announced the arrest of a 17-year-old boy in the case. Little information on the teen was released, but police noted the suspect is a Carlsbad resident.Thorborg's death struck a chord with many in the community. In the days following her death, a large group came to honor her by finishing the walk she started.The woman’s death also left many neighbors upset and concerned about their safety while on that trail.During Thursday’s arraignment, the judge also granted the teen's request to two phone calls -- one to his Mom, the other to his grandmother.ABC 10News learned Thorborg’s family was also listening to the hearing through the phone.Another hearing in the case is set for Dec. 22. 1173

SAN DIEGO (KGTV) --  It was a normal Thursday night for Rob Perelman. His Uber app was on and he was picking up passengers in San Diego. Then suddenly, things changed and his passengers got violent. You may have seen the video by now - a car crashing in Banker's Hill after the passengers began violently beating the driver.RELATED: Uber driver attacked by drunk passengersFriday, Perelman spoke for the first time about his early-morning attack. He told 10News what happened Friday morning isn't an Uber problem - they were just bad apples. "I've done 4,999 rides with good people," Perelman said. "And one with a bad person."Perelman gave that bad ride sometime after 1:00 a.m. Friday. He picked up the passengers in Banker's Hill and almost immediately realized they were drunk. "My gut feeling said to drive away," he said. "But I'm here to give people rides home, and I said you know what, 'we've all been the drunk guy just trying to get home from the bar, let me give these guys a ride home.'"MAP: Track crime happening in your neighborhoodHe only made it two blocks. "The guy in the back seat starts puking out the window...and if he can't make it two blocks, he's definitely not going to make it 10 minutes," Perelman said. So he pulled over and asked the two to get out of his car. He told 10News that he even tried opening the door for one of them."Still nothing happening, so I say a third time, 'get out of the vehicle or I'm calling 911,'" Perelman said. That's when things got dangerous, and the passenger next to him attacked with a fury of punches."And he's not stopping, he's just beyond the point now," Perelman said. "Probably doesn't know what he's doing, just starts throwing punches at my head, I can't get him to stop. I've got my glasses on, he knocks my glasses off."Perelman says he was left with two options. Take the beating or jump out of the car. He took option two, jumping out of the car while it was still in drive and running to a nearby house to call the police.After the car crashed, the passengers seemed to have a moment of clarity and took off. Perelman says he left behind a shoe, a cell phone and ,000 dollars in damages to his car.Even though he had a bad experience, Perelman says he just wants to get back on the road. "I'm just happy that I was able to get out safely and I've got a few bruises on my head, but I was able to walk away, so I'm lucky that it didn't escalate," Perelman said. SAN DIEGO (KGTV) - A college student is suing the San Diego County Sheriff's Deputies from the Las Colinas Detention Facility after she disfigured her face while detained.The lawsuit stems from May 6, 2019. San Diego State student Tanya Suarez, 23, tried methamphetamine with a new group of friends.The document states she had psychotic delusions in a gas station parking lot, causing nearby San Diego police officers to arrest her for being under the influence of drugs.According to the lawsuit, at Las Colinas Detention Facility, while being fingerprinted, she heard another woman screaming about her eyes. That's when Suarez started to claw out her own right eye.Deputies restrained her on a gurney and cut her acrylic nails leaving them jagged.The suit claims deputies then placed her in a safety cell unrestrained. Suarez started clawing again at her right eye.She says the entire time she was screaming and saw a guard standing outside her cell filming her with an iPhone.Within five minutes she scratched both eyes out.Documents state it took another 5-10 minutes before deputies entered the cell.Suarez is now blind and, according to the lawsuit, she was known "to sleep with the lights on because she is afraid of the dark. Now she lives in complete darkness."The lawsuit states she told nurses she is bipolar and was previously hospitalized for wanting to commit suicide.Suarez's lawsuit states she is going back to finish her psychology degree at SDSU and is taking classes with the Center for the Blind; adding she wants to help others who suffer from mental illness and drug abuse.The San Diego County Sheriff's Department sent 10News the following statement: 1681
