SAN DIEGO (KGTV) – Just days into California's new stay-at-home order, many businesses say this time around they won’t comply with restrictions.Some restaurant owners tell ABC 10News they’re not doing it out of defiance, but as a way to survive.“We have to stand up for ourselves. We have to open or else we lose the risk of losing our business entirely,” said Annie Rammel, the owner of Oak + Elixir restaurant in Carlsbad.Rammel said she spent ,000 to have a deck built outside of Oak + Elixir on State Street to provide a safe dining option for patrons.It was going well until she had to shut things down once again this week as COVID-19 cases surged and the state put restrictions on in-person dining were put back in place.“Closed, open, closed, open,” she said. “A lot of us are not doing well; we’re not doing well, the take out and to-go we’re losing money on that.”Rammel and a group of small business owners in Carlsbad and Oceanside decided to reopen for in-person dining Friday and take their chances, including several restaurants in the Carlsbad Village.She said if she stayed closed, her 15 employees would be laid off during an already rough year.“It’s for our employees to put food on their tables; some of them have children that they have to provide for, the holidays are coming, and I’m just not going to do that,” she said.Her patio and additional outdoor sidewalk tables were ready for customers on Friday at 4 p.m. Rammel said she expected to seat approximately 100 customers.Just next door at Caldo Pomodoro, customers were seated outside for lunch Friday.“We’re basically fighting for our lives, and we’ve been here for 29 years, it’s a family-owned and operated restaurant, it’s not that we’re doing anything wrong, we just want to survive,” said Justin Davis, who works as a server at the restaurant. “If we shut down, we’re pretty much not going to open again. We did the plexiglass, redid our tables, and invested so much money into it, and we don’t see any reason why we should shut down again.”A Carlsbad Police spokesperson said officers respond to reports of businesses operating outside of the health orders, but the goal is to gain compliance through education.However, they said willful violations witnessed by officers will be reported to the county for documentation.“We’re scared to lose our ABC license, which is our liquor license,” said Rammel. “If that happens, the group of us is saying we’re going to push through, we have some attorneys on our side, and they say we have a really good fight because there is no evidence that these spikes are coming from us.” 2614

SAN DIEGO (KGTV) — Merritte Powell hired six new people once his downtown restaurant got the green light to serve indoors again.But now, those workers could be in for some bad news. The three or four shifts they thought they’d get each week at La Puerta could instead be reduced to one, if that.“The hardest part is just the emotions and the mental health of the people working in the industry,” Powell said.It’s because San Diego County is in danger of falling into the state’s most restrictive purple tier of coronavirus restrictions, which would ban restaurants from serving indoors. That would be the latest setback in the region's push to return to normal amid the outbreak.“It feels like they're just playing games with us at this point, and it's getting frustrating,” Powell said.The twists and turns are taking a big toll, not just on day-to-day operations, but also when it comes to hiring in the future.“You're not going to hire people back, you're being extremely cautious,” said Ray Major, SANDAG’s chief economist.Major said restaurant owners have it especially hard. Not only do they have to be concerned with whether they can break even, but also if a future move into a less restrictive tier would only be temporary."We're really going to have to get into the orange or the yellow tier, and we're going to have to be able to stay there, and businesses are going to have to have the confidence that we're not going to shut them down again before they start rehiring people," Major said.SANDAG says the region's jobless rate was 13.3%, with 226,000 unemployed workers as of Sept. 5. SAN DIEGO (KGTV) - Just ahead of this holiday week, San Diego's Cross Border Xpress (CBX) unveiled new biometric facial comparison technology. The CEO of the sky bridge that connects travelers directly to the Tijuana International Airport told ABC 10News that it will further secure and streamline travel into the United States.The U.S.-Mexico border is still closed to non-essential travel because of COVID-19. CBX CEO Jorge Goytortua said CBX is still not encouraging people to travel right now but if they do, they can take advantage of this technology.“Within seconds, the technology will recognize the passenger in a [Customs and Border Protection (CBP)] database,” said Goytortua. He told ABC 10News that the comparison process happens only at a time and place where travelers are already required by law to verify their identity by presenting travel documents. Goytortua says that when a traveler arrives at the CBP processing area, he or she will have a photo taken at the primary inspection point. A CBP officer will do a review by retrieving the traveler's passport or visa photo from government holdings. The new photo will be compared to the previously collected photo.“It's going to be a hands-free process. It's going to be a much faster process,” he told ABC 10News.He added that CBX does not have access to the photos. Only CBP officers can see them. If travelers are still concerned about privacy, he said it's not mandatory to use the technology. “You can ask the officer if you don’t want to be processed like that then you will be processed the traditional way with your document read it on the scan. A CBP officer [will] research on their system and make sure that the person that is presenting the document is the one there in front of the officer,” he stated. 1790
