WASHINGTON (AP) — A federal judge on Monday ordered North Korea to pay more than 0 million in a wrongful death suit filed by the parents of Otto Warmbier, an American college student who died shortly after being released from that country.U.S. District Judge Beryl Howell harshly condemned North Korea for "barbaric mistreatment" of Warmbier in agreeing with his family that the isolated nation should be held liable for his death last year. He died in June 2017, shortly after he returned to the U.S. in a coma and showing apparent signs of torture while in custody.In holding the North Korean government liable, Howell accused the government of seizing Warmbier for "use as a pawn in that totalitarian state's global shenanigans and face-off with the United States.""Before Otto traveled with a tour group on a five-day trip to North Korea, he was a healthy, athletic student of economics and business in his junior year at the University of Virginia, with 'big dreams' and both the smarts and people skills to make him his high school class salutatorian, homecoming king, and prom king," the judge wrote. "He was blind, deaf, and brain dead when North Korea turned him over to U.S. government officials for his final trip home."The arrest and death of Warmbier came during a time of heightened tension between the U.S. and North Korea over the country's nuclear weapons program. President Donald Trump held a first-of-its-kind summit with North Korean leader Kim Jong Un in June 2018 and plans another next year.The judgment may be mostly a symbolic victory since North Korea has yet to respond to any of the allegations in court and there's no practical mechanism to force it do so. But the family may nonetheless be able to recoup damages through a Justice Department-administered fund for victims of state-sponsored acts of terrorism, and may look to seize other assets held by the country outside of North Korea.Fred and Cindy Warmbier, who are from a suburb of Cincinnati, said they were thankful the court found the government of Kim Jong Un "legally and morally" responsible for their son's death."We put ourselves and our family through the ordeal of a lawsuit and public trial because we promised Otto that we will never rest until we have justice for him," they said in a statement. "Today's thoughtful opinion by Chief Judge Howell is a significant step on our journey."The lawsuit, filed in April, describes in horrific detail the physical abuse Warmbier endured in North Korean custody.When his parents boarded a plane to see him upon arrival in the U.S., they were "stunned to see his condition," court documents say.The 22-year-old was blind and deaf, his arms were curled and mangled and he was jerking violently and howling, completely unresponsive to his family's attempts to comfort him. His once straight teeth were misaligned, and he had an unexplained scarred on his foot. An expert said in court papers that the injuries suggested he had been tortured with electric shock.A neurologist later concluded that the college student suffered brain damage, probably from a loss of blood flow to the brain for five to 20 minutes.North Korea has denied that Warmbier was tortured and has said he contracted botulism in custody, though medical experts said there was no evidence of that.The complaint also said Warmbier was pressed to make a televised confession, then convicted of subversion after a short trial. He was denied communication with his family. In June 2017, his parents were informed he was in a coma and had been in that condition for one year.Though foreign nations are generally immune from being sued in U.S. courts, Howell cited several exceptions that she said allowed the case to move forward and for her to hold North Korea liable. Those include the fact that North Korea has been designated by the U.S. as a sponsor of terrorism, that the Warmbiers are U.S. citizens and that North Koreans' conduct amounts to torture and hostage taking.The penalty awarded by Howell to the Warmbiers and to Otto Warmbier's estate includes punitive damages as well as damages for economic losses, pain and suffering and medical expenses.The lawsuit was brought on the Warmbiers' behalf by Richard Cullen, a prominent Virginia lawyer and former U.S. attorney. (KGTV) — Two people were arrested this week after a pursuit took authorities from Valley Center into unincorporated Escondido.San Diego Sheriff's Department says the pursuit began just after 9 p.m. near State route 76 near Pala Mission Rd. after a deputy spotted a stolen truck. When the deputy tried to pull the truck over, the deputy says the drier sped off.The chase reached speeds of 90 miles per hour and lasted about 30 minutes, with deputies from Fallbrook and San Marcos assisting in the chase.A spike strip was used and put an end to the chase near the Mountain Meadows community of unincorporated Escondido, the department said.After hitting the curb, the driver put the truck in reverse and rammed into a Sheriff's patrol car, deputies say.No deputies were hurt.The female driver and male passenger of the truck, identified as Sally Arrellanes and Roy James Duncan, were arrested and charged with felony evading, assault with a deadly weapon likely to result in great bodily injury, vehicle theft, conspiracy to commit crime and possession of a stolen vehicle. 1093

(KGTV) - The parents of a two-year-old boy say they're still reliving the terrifying experience they faced in a store parking lot over the weekend.Peter Kopcak and his fiance Jennifer Lawson were backing out of the Costco parking lot on Hacienda Drive in Vista Saturday afternoon."I just seen out of the corner of my eye this guy running down between the two cars, and I didn't know what he was doing," said Kopcak.The couple said the guy tried to rip their toddler out of his car seat."He opened the car seat back door, reached in and grabbed my kid, she jumped out of the car, left it in reverse, I put it in park. I jumped out, he was trying to grab the carseat and, she pushed him and I just had to take him down," said Kopcak.Kopcak tackled the man to the ground."I took him to the ground and did what I had to do to subdue him, a bunch of people, an off duty officer pulled me off the guy and held him down told him to put his hands behind his back," said Kopcak.Sheriff's deputies arrested 37-year-old Adam Glavinic. He's facing charges of felony attempted kidnapping and being under the influence of a controlled substance."I thought he was going to take my kid and I wasn't about to let that happen, I'd do anything I could to stop him cause that's the worst nightmare, just having someone A, touch your kid, B, try to take your kid," said Kopcak.The couple was also upset to learn Glavinic was released from jail on a 0,000 bail Sunday."I couldn't stop crying when I found out, cause he will do this to someone else and who knows if it's a single mom or the husband isn't quick enough, and the guy takes off," said Lawson."I don't understand how he got out so fast. What if he tries to grab another kid or hurt someone else? It boggles my mind," said Kopcak.There's a backlog of out of custody cases due to the pandemic. (KGTV) -- California could become the first state in the nation to use recycled plastic as part of its roads and freeways.The state Senate unanimously passed SB 1238, which directs Caltrans to study the use of plastics in asphalt for construction, or repair of a state highway or road."There's no other state in the nation that has more paved roads in California," said Sen. Ben Hueso, who wrote the bill. "So, imagine if California developed the use for a product that it's abundant in … This would be a game changer. This would be a great way to reuse plastic.”That's especially important now, as China has stopped buying recycled materials from the U.S. Prior to 2018, California sent 2/3 of its recyclable materials to China, which has since banned all plastic trash imports.Now, instead of going into the landfill, it could go into California’s roads."It would help create jobs in our state. It would help a local contractor that we have in our county, it would help improve the sturdiness of our roads and reduce the maintenance of our roads," said Hueso.Hueso said he got the idea from a group of students at Bonita Vista High School in Chula Vista. He met with their Progressive Club and Green Club, challenging them to find solutions.The students introduced Hueso to MacReber Southern California, a Vista company that takes plastic and prepares it to be used in asphalt."It makes too much sense not to do," said MacReber CEO Rebeca Sparks. "With this technology, we can truly offset our footprint, and not only offset it but be do more than that to be plastic positive."MacReber takes plastic out of the recycling and landfill chain, and then processes it. The company then sells the plastic to asphalt companies. They use the plastic mix instead of oil when making asphalt.MacReber said in addition to being more environmentally friendly, it also creates a stronger, sturdier road."It's going to look feel and move the same as a traditional asphalt," said MacReber President Chris Sparks. "But our product lends to a stronger, longer lasting asphalt road."Hueso said finding a use like this for all of the plastic waste produced in California is vital to the environment, especially now that China has stopped buying the state's plastic waste.The bill still has to get approval from the state Assembly, and then it would need the governor’s signature to become law.After that, Caltrans would be responsible for studying and implementing the idea. 2478

VISTA, CA (KGTV) — The man accused of intentionally driving a U-Haul van into a crowd of people outside of an Encinitas bar, pleaded not guilty to serious charges in a Vista courtroom Wednesday.Christian Davis, 28, stood next to an attorney with his head down as he was formally charged with two counts of attempted premeditated murder, three counts of assault with a deadly weapon, and one count of felony driving under the influence of alcohol.Deputy District Attorney, Kim Coulter, said the incident early Sunday morning started at the Saloon and Shelter bar when Davis was kicked out.RELATED: Video shows driver slamming into crowd outside Encinitas bar"He was asked to leave because he was highly intoxicated and it was time for him to go," said Coulter.Once he was kicked out, Coulter said he got into a verbal argument with two bouncers, then threatened them."It escalated and culminated with Davis telling the security guards 'you're going to regret doing this, I’m going to come back and I’m going to kill you,'" she said.Moments later, witnesses saw the U-Haul heading for a crowd of people standing outside of the bars.RELATED: Man arrested after driving into crowd outside Encinitas barThe incident was captured on a passerby's dash cam video."He reversed out of a 7-Eleven and he came barreling down a sidewalk in front of Shelter bar, right into a crowd of people," said Coulter. Sadly, two men who were outside of the bar at the wrong time were seriously hurt."A 25-year-old victim has had a severe injury to his leg, he’s had his third surgery today," said Coulter.The other victim, a 24-year-old, was also left hospitalized with severe injuries."He has two collapsed lungs, fractured ribs, a broken arm and he did spend time in the ICU," she said.Bail was set at million.
