A federal court in Texas sentenced ice cream manufacturer Blue Bell Creameries to pay .25 million in criminal penalties for shipments of contaminated products linked to a 2015 listeriosis outbreak, the Justice Department announced Thursday.Blue Bell pleaded guilty in May 2020 to two misdemeanor counts of distributing adulterated ice cream products.The sentence, imposed by U.S. District Judge Robert Pitman in Austin, Texas, was consistent with the terms of a plea agreement previously filed in the case.“The results of this investigation reflect the determination of the Defense Criminal Investigative Service to hold companies that sell food products to the military accountable and ensure they comply with food safety laws,” said Michael Mentavlos, Special Agent-in-Charge of the DCIS Southwest Field Office. “The health and safety of our service members and their dependents are of paramount importance.”The .25 million fine and forfeiture amount is the largest-ever criminal penalty following a conviction in a food safety case.“American consumers must be able to trust that the foods they purchase are safe to eat,” said Acting Assistant Attorney General Jeffrey Bossert Clark of the Justice Department’s Civil Division. “The sentence imposed today sends a clear message to food manufacturers that the Department of Justice will take appropriate actions when contaminated food products endanger consumers.”According to the plea agreement, Texas state officials notified Blue Bell in February 2015 that samples of two ice cream products from the company’s Brenham, Texas factory tested positive for Listeria monocytogenes, a dangerous pathogen that can lead to serious illness or death in vulnerable populations such as pregnant women, newborns, the elderly, and those with compromised immune systems.Blue Bell directed its delivery route drivers to remove the remaining stock of the two products from store shelves, but the company did not recall the products or issue any formal communication to inform customers about the potential Listeria contamination.Two weeks after receiving notification of the first positive Listeria tests, Texas state officials informed Blue Bell that additional state-led testing confirmed Listeria in a third product.Blue Bell again chose not to issue any formal notification to customers regarding the positive tests. Blue Bell’s customers included military installations.In March 2015, tests conducted by the Food and Drug Administration (FDA) and Centers for Disease Control and Prevention (CDC) linked the strain of Listeria in one of the Blue Bell ice cream products to a strain that sickened five patients at a Kansas hospital with listeriosis, the severe illness caused by ingestion of Listeria-contaminated food.At least three people in Kansas died as a result of the contamination, according to the CDC.The FDA, CDC, and Blue Bell all issued public recall notifications on March 13, 2015. Subsequent tests confirmed Listeria contamination in a product made at another Blue Bell facility in Broken Arrow, Oklahoma, which led to a second recall announcement on March 23, 2015.According to the plea agreement with the company, FDA inspections in March and April 2015 revealed sanitation issues at the Brenham and Broken Arrow facilities, including problems with the hot water supply needed to properly clean equipment and deteriorating factory conditions that could lead to insanitary water dripping into product mix during the manufacturing process.Blue Bell temporarily closed all of its plants in late April 2015 to clean and update the facilities. A child in Galion, Ohio tested positive for meth on Sunday, just hours after trick or treating in the small town located between Columbus and Cleveland, WBNS-TV reported. According to the Galion Police, the boy is expected to make a full recovery after suffering a seizure. The boy reportedly was sickened after playing with fake teeth that were given to him while trick or treating. The boy's father reportedly said that the boy only had a few pieces of candy before getting sick. The Galion Police has not confirmed how the boy became sick from meth, and an investigation is underway. In the meantime, the police department has issued a warning to its residents. "We encourage parents to thoroughly check any candy your children may have received before they eat it," the Galion Police Department said. An expert on Halloween sadism, Joel Best, has previously said that intentional tainting of trick or treat candy is generally rare.“There is this fear out there, and it is terribly overblown,” Best said. “They are worried that some maniac will hand them a contaminated treat, and I can’t find any evidence that has ever resulted to a death or serious injury.” 1201

A Florida man was allegedly attacked while trying to do the right thing during Hurricane Irma.The alleged victim was letting Tarvice Lamar Payne stay at his home in Port St. Lucie during the storm when his guest attacked him, according to Port St. Lucie police.Payne, 33, of Royal Palm Beach, accused the alleged victim of stealing his drugs, so he punched him and then threatened him with an ax, a police report states. The alleged victim managed to escape and call the police, but not before Payne took the ax and struck a car in the driveway, police said.Arriving officers managed to track Payne down as he was leaving the area.They charged him with aggravated assault, battery, and criminal mischief. 742

A Lyft driver accused of sexually assaulting a customer on April 24 has been arrested, police say.The woman told police that she had been sexually assaulted in the city of Pontiac, Michigan. At 5 p.m. on April 24, the victim contacted a Lyft driver she had previously used. The driver claimed he was the owner of a health spa and would give her 0 if she let him give her a massage and filled out a survey evaluating the massage afterward.The victim said Hanif also encouraged her to drink from an already opened container of Four Loko, an alcoholic beverage. She arrived at the alleged spa and said she felt as if she was 'buzzed.' At the end of the massage, the victim said Hanif offered her ,000 in exchange for sexual intercourse. The victim refused, at which time she was sexually assaulted by the suspect, police say. After, Hanif reportedly drove the victim back to her residence.Hanif was arrested on April 25 and lodged at the Oakland County Jail after being interviewed by detectives. During the investigation, detectives discovered he was listed as a possible suspect in a different sexual assault incident that occurred in December 2017.“The Detectives assigned to this case worked quickly and methodically in order to give this victim the justice she deserves,” Sheriff Michael J. Bouchard. “We will never tolerate behavior from those who commit sexual violence. I commend this victim for coming forward as she may have brought closure for other victims as well.
