SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. "We fully corrected the issues underlying the allegations in this lawsuit years ago and are unaware of any unresolved consumer impact."DEBT COLLECTION LAWSUITSPart of the complaint talked about debt-collection lawsuits.In July Team 10 discovered a 157% increase in the number of rule 3.740 collections lawsuits filed in San Diego County court from 2015 to 2019. SAN DIEGO (KGTV) - The family of a man killed in 2013 is pleading with the community for new leads as the case has now been left unsolved for more than half a decade.Ralph Green was killed on October 20, 2013.  He was murdered on Jewell Street in the Mountain View neighborhood, on the porch of his daughter’s home while at her 32nd birthday party.His daughter, Chanel Green, says the shooting happened suddenly, catching everyone by surprise.“My mother was on her way outside, so it was a blessing I didn't lose both my parents that day,” Chanel said. “I remember (my mother) shrieking, ‘oh my god, Ralph’s been shot.’ And I ran to the door to see my dad walk holding his neck.”Green says he was shot three times, once through this throat.“My brother catches him, and I moved my brother out of the way, and I laid (my father) down on the ground, and I start screaming, “oh my god, my dad’s been shot, call the police,’” she said. “My dad bled out on the floor, and all I could hope was that he heard me when I told him I loved him.” Channel’s aunt, Jennetta Pierce, was also shot.  Pierce is Ralph’s cousin-in-law.Pierce says she was inside the house, by the window, when the bullets started flying. One of them hit her on the lower back.“I got hit, but I didn’t let anyone know I got hit because my kids were there, and I just told them to get up under the table,” Pierce recalled.  After that, emergency crews came inside the house and took her to the hospital, where she spent two weeks.  She says she spent the next five years focused on moving forward.Police have said the shooting was random.  Chanel says there have been tips, and potentially leads given to the police but none have panned out.  But she’s convinced that there are people out there that know something, that can give her and her family the closure they need.“For anybody who knows somebody that knows something to come forward, now is the time, to tell the truth,” Chanel said. Anyone with information can contact San Diego Police or Crime Stoppers at 888-580-8477. 2087

SAN DIEGO (KGTV) — The Del Mar Fairgrounds says it faces closing for good unless it receives emergency state funding.The fairgrounds, which is owned by the state, says its operations are self-funded and relies on event revenues to operate. Without events like the San Diego County Fair, horse racing, several smaller festivals, and more, the fairgrounds' revenue has been severely depleted. The venue had already lost the KAABOO music festival heading into this year as well, which was set to move to Petco Park this year.The fairgrounds says it needs million in relief aid from California in order to survive."From creating cherished family memories and generating 0 million in economic impact, to serving as an essential evacuation site during wildfires and providing nearly 4,000 full-time-equivalent jobs, losing the Fairgrounds would leave a giant void in San Diego as we know it," a release from the venue said.Fairgrounds officials are calling on the community to urge their local leaders to support emergency aid from the state.The fairgrounds has also set up a website here to help locals show their support and connect with local and state leaders to urge them to help. 1194

SAN DIEGO (KGTV) -- Surveillance video shows a couple at a Kearny Mesa home, targeting an American flag.John Dodds bought his flag two years ago and displayed it with a light outside his home on Atlas Street."My father was a Navy veteran, my brother was very patriotic and instilled it within me," Dodds said. "I want everyone to know how much I appreciate this country and what the veterans of this country do for us."A flag typically flies in front of Dodd's home 365 days a year. On Thursday morning, Dodds walked outside and saw the empty flag holder, before reviewing his surveillance video.Around 8:30 p.m. Wednesday night, two people with backpacks - bandanas on their faces -  walked by. One of them walked up to his porch and yanked out the flag before she took off. Dodds posted the video on the Nextdoor app in hopes of tracking down those thieves - and his flag.        "Maybe it was a big joke to them, but I don't think they know how seriously most of us take the flag of the United States of America," he said. Dodds plans on getting another flag but is still holding out hope for it to be returned.
