SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation. The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya. He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

SAN DIEGO (KGTV) - Some of the nation's top Democrats in the country have gathered in San Diego for California's three-day Democratic Party Convention.About 3,400 Democratic delegates are expected to submit endorsements for California governor, U.S. senator, and other state offices during the convention.Among the leaders attending are Sen. Kamala Harris, D- California, House Minority Leader Nancy Pelosi, D- San Francisco, and Rep. Adam Schiff, D- California 28th District — who has sparred with President Donald Trump publicly in the past.RELATED: Workers protest outside Democratic Party ConventionRep. Schiff told 10News reporter Jon Horn that he believes Rick Gates's guilty plea will be a hot-button topic during the convention."[Mueller] now has another very important cooperating witness, somebody who was at the center of the Trump campaign, and someone who can shed a lot of light not only on Paul Manafort and the effort to launder money from Pro-Russian interests but also the inner workings of the campaign, so I think it’s a very important development," Schiff said.Gate, who is a former aide to the 2016 Trump presidential campaign, pleaded guilty this week to conspiracy and making false statements as part of Special Counsel Robert Mueller's investigation into Russian meddling during 2016's presidential election.Jon's report will air Saturday on 10News at 7 p.m.RELATED: San Diego hosts debate for gubernatorial candidatesAnother issue is likely to be gun controls, calls of which have increased in the last week following the Florida shooting at Marjory Douglas Stoneman High. Students from the school have led protests and social media calls for action from lawmakers."Our generation, their parent's generation have done them a horrible disservice by allowing the proliferation of military grade weapons onto our streets, but they’re taking matters into their own hands," Schiff said of those calling for new legislation.Sen. Dianne Feinstein slammed President Trump as she addressed attendees Saturday morning."I have never seen the presidency and I’m going to say it, as disgraced as it is today," Feinstein said.RELATED: California Democratic Party convention begins in San DiegoSaturday will feature speeches by gubernatorial candidates as well as candidates for other California offices. Programs on mobilizing women to run for office and vote, a celebration of black voters, a series of speeches by labor leaders and millennial elected and party officials are also scheduled. 2567

SAN DIEGO (KGTV) - Some parents in Poway are teaming up to help their kids when the school year begins with virtual learning in a few weeks. In the spring, when Ellie, 6, and her brother Ethan, 7, were learning Spanish while distance learning, their father, a college professor, and mother, a lawyer, were working from home."I had my daughter to my left. I had my computer in the middle, and my son at my right. So when they had questions, which was constant, I could help them," said Testa.Testa says the end result was stressful.WATCH - ASK THE EXPERTS: What we know about coronavirus and children, with Dr. Abi Olulade"Trying to get kids to stay in front of computer and stay focused for an extended period of time was a challenge. When you're working full-time, its a constant interruption because they do need assistance at that age," said Testa. The mental juggling is a distraction for her own work."We are working long days and weekends to make up for it," said Testa. So when she and her husband were planning for the upcoming school year at Valley Elementary, they knew they needed help."It's a total of three families and it's families we know and trust," said Testa.WATCH - ASK THE EXPERTS: Susie Walton talks about managing home schoolThose other families all have kids in the same school, and same grades, as her children. Julie says they're planning on forming a rotating micro-school of sorts.Every third day, each household will take a turn hosting all eight kids, guiding them through the day of virtual learning."You have parents able to dedicate the time to make sure kids stay on task, take them outside and play when it's recess time ... make sure the kids are sticking to lunch and snack schedules," said Testa.Julie says their micro-schooling offers something that is in short supply with distance learning.WATCH - ASK THE EXPERTS: Virtual Steam Academy, resources and how to do science at home"Critical time for them when it comes to reading and math. Somebody needs to be there to review your work. With the distance learning, I believe they will have some one-on-one time but the majority of the time, they're still going to be working on their own," said Testa.Testa hopes the parental 'co-op' approach will give the parents a break and their kids a chance to socialize."We haven't figured out everything yet, but the will kids be bringing on their own lunches. No sharing of food. They'll be washing their hands a lot," said Testa.Testa says it may not be realistic to keep kids at that age from interacting from each other. She'll be relying on the other parents to be honest about any signs of illness."We trust each other to follow the health protocols," said Testa.Their school year is set to begin August 2. 2746
