SAN DIEGO (KGTV) — A Camp Pendleton Marine was taken into custody this week after border officials say the Marine was trying to smuggle immigrants through a port of entry.The junior-enlisted Marine was taken into custody early Monday morning by U.S. Customs and Border Protection personnel at the San Ysidro Port of Entry, according to the 1st Marine Division at Camp Pendleton. The Marine was reportedly bringing undocumented immigrants into the port.The Marine is being held in civilian custody and CBP and the Naval Criminal Investigative Service were investigating. Thirteen Marines have approved pre-trial agreements requesting separation from the Marines instead of court martials or waiving separation board processes. SAN DIEGO (KGTV) — A Descanso woman whose power was cut during last week's Red Flag warning was surprised to receive a utility estimate showing an increase in power use.Cheryl Erpelding's power was taken away for parts of both Oct. 30 and Oct. 31, when SDG&E was trying to prevent a wildfire from igniting and spreading. Still, she got an estimate from SDG&E showing that she used the most power during the parts of those two days when the power was on. "If you're going to email me how much I'm using, why don't you email me a better guess," Erpelding said. On other days of the week, her usage ranged from 16 to 24 kilowatt hours.SDG&E says the reason for this is Erpelding is a solar customer. The estimate she received reflects her net usage, which usually reflects credit for her putting power back into the grid. That reduces her net usage significantly. During the public safety power shutoffs, she did not put power back into the grid, but still used power during parts of the day it was on. SAN DIEGO (KGTV) -- A man died Saturday night following an officer-involved shooting in El Cerrito. Police say they received a call just before 8 p.m. from a 70-year-old woman who said her 52-year-old nephew attacked her with a brick at a home on the 5800 block of Adelaide Avenue. Two officers responded to the scene and found the woman, who they say had been hit in the head and chest. Officers found the man in the backyard of the home and tried to arrest him, but they say he struggled.Witnesses say the suspect then picked up a shovel and started swinging at police. "He continued quickly advancing on the officers while swinging the shovel, prompting one officer to fire his Taser, while the second officer fired his service weapon," San Diego Police said in a news release. The suspect was struck by gunfire at least once and died at the scene, police say. The man's identity isn't being released at this time. The suspect’s aunt is expected to be okay and no officers were injured in the incident. The department says one of the officers is a four-year veteran of the department while the other is a 16-year veteran. SAN DIEGO (KGTV) - A former gang member who turned his life around in stunning fashion just got accepted to four different universities, including UC Berkeley and UC San Diego. 10News first met Apollo in 2010, as he and several others went to court to get off a gang injunction list for an Oceanside street gang.  An injunction prevents gang members from doing activities in certain areas, like associating with each other.  At that time, Apollo told us he had been out of the gang for several years after four years inside as a teenager."What hurt the most is hurting my mother... You want to amount to something, so (when i decided to get out) I'm trying to do this for her," said Apollo.Apollo was removed from the list about a year later, which is a rare feat. SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834
