SAN DIEGO (KGTV) — A man who spent almost half his life behind bars for a murder did not commit walked out of Donovan Prison in South San Diego County Friday a free man. Spaghetti with meatballs. This is the meal Jack Sagin has been dreaming of for years. The 73-year-old spent the last 33 years in several different state prisons for a crime he did not commit. "I'm sitting there getting up every morning, wondering what the hell am I doing here?" Sagin said. "I ain't done nothing."In July 1986, Sagin was charged with the stabbing murder of a Monterey woman, Paula Durocher. The then-39-year-old used drugs, had a record, and was a perfect scapegoat. His imprisonment was all dependent on two jailhouse informants. "An easy one to convict," Sagin said. But he was stubborn too. Once in prison, Sagin continued to write letters to his Attorney General, congressmen, and anyone else who would listen to his cry of innocence. Then, he heard of a scientific breakthrough that could help him. "When it became DNA, it blew the top of my head off," Sagin said. Sagin was one of the first cases the Northern California Innocence Project took on in 2002. Investigators with the nonprofit reopened the case and found a clue. "We have DNA from a probable perpetrator right there, underneath her fingernails," Northern California Innocence Project attorney Kelley Fleming said. That DNA, they found, did not belong to Sagin. For the next 17 years, the Innocence Project fought to free him. "We had a deal," Fleming said. "That deal was that we weren't going to give up, but he had to keep himself alive. And that's not an easy thing to do in prison. But he did it!""Believe me… Nobody was going to stop me from surviving," Sagin said. In August, the Sixth District Court of Appeals overturned his conviction. On Friday at 9 a.m., Sagin was released from Donovan Prison, and walked straight into the arms of his sister, Barbara Kosar. She has invited Sagin to live with her and her family in Arizona. Just four days before his 74th birthday, a man who was destined to spend life in prison without parole became a free man. He hopes to pay it forward. "I want to work with some youngsters and maybe help somebody," Sagin said. Somebody who may need some inspiration to never give up. The Northern California Innocence Project believes the real killer is still out there. They say they are hopeful Monterey County law enforcement will continue their investigation into the cold case. 2479
SAN DIEGO (KGTV) — A local woman is suing the Greyhound bus company after an unscheduled stop allowed border agents to come on the bus and question the citizenship of passengers. Rocio Cordova was traveling from San Diego to Phoenix in November 2017 when her bus was stopped.Her lawyer, Darren Robbins, tells 10News, “Well this practice was brought to our attention and our client was one of the people subjected to these warrantless searches conducted without probable cause.”RELATED: 'Minutemen' wants troops at border gaps near CampoHe continued to say these immigration raids have been happening on multiple different Greyhound buses. Cordova is accusing Greyhound of violating state consumer protection laws by allegedly consenting to racial profiling by law enforcement officers. Cordova is a United States citizen, however, watched people on the bus around her questioned based on their race, according to her lawyer, “it is highly invasive and inappropriate to facilitate such action of law enforcement officials against its own passengers”. The complaint was served to Greyhound on Friday.Robbins is now waiting for their response, “the best response would be they'll refrain from any additional illegal behavior and stop allowing this kind of warrantless searches to take place on greyhound facilities or Greyhound buses,” he tells 10News. 1388

SAN DIEGO (KGTV) — A new lot meant to give people living in their cars and RVs a safe place to sleep and avoid citation is going largely unused.During Tuesday morning's wee hours, the lot across from SDCCU Stadium looked completely empty. San Diego opened the lot in mid-June, as the third safe parking lot for those who live in their vehicles. The newest one came a month after the council enacted an emergency ordinance that banned people from living in cars and recreational vehicles on public streets from 9 p.m. to 6 a.m. The city enacted the restriction after being inundated with safety concerns from residents who said people were camping in their beach front neighborhoods, leaving human waste, and trash. At Mission Bay on Tuesday, many who do live in their vehicles said they would prefer to stay near the coast, despite the threat of citation. "They don't know about it, and maybe it's not that convenient either," said Gary Parsons, who lives inside his Dodge Ram. "Inside I put in some carpet, and some shelving, and I sleep on the floor."Chris Enders, who lives in an RV with his wife and son, said they spend their nights on unchecked private property, such as parking lots near the beach. He said the Mission Valley location is not feasible."When you're getting five miles a gallon in gas, that's .75 just to get there, and then to get back that's another .75 so you just cost me ... for one day," said Enders.The lot requires all vehicles to be out by 7 a.m. daily. Ashley Bailey, a spokeswoman for the mayor, said the city and Jewish Family Service are working to bring more people to the lot."In partnership with Jewish Family Service, teams are continuing to conduct outreach and seek feedback to ensure everyone who wants to use this lot has the opportunity to do so," she said in a statement. "San Diego’s ordinance restricting vehicle habitation is in full effect so we encourage individuals who are living in their RVs to take advantage of this lot to avoid possible citation.”Jewish Family Services also offers resources such as housing help and financial assistance to people using the lot. 2133
SAN DIEGO (KGTV) - A Paradise Hills family is in search of a good Samaritan after a young autistic man was mugged and beaten for his brand new iPhone, just blocks from his home.The incident played out along Briarwood Road on an afternoon two weeks ago. Garrett De Leon had just gotten off work and off the bus.His pride and joy was in his right hand - a new iPhone 10 that his parents gave to him for his birthday. Deleon was texting his mom that he was blocks from home, when it happened."This guy came from behind me and snatched my phone and pushed me to the ground," said De Leon.De Leon says he fought back, the two struggling on the ground. "He pushed me again and runs to the car," said De Leon.Deleon says he chased the man - a tall, lean black man wearing a beanie - to an older black car, where the man jumped in the back seat, the window rolled down."He tells his buddy to take off immediately," said De Leon. In the meantime, the thief was hitting De Leon, who says he was delivering his own blows through the window."I had too much adrenaline and didn't feel pain. Hopped up on anger and determined to get at them and at the phone," said De Leon.After the car started up, it dragged De Leon some 100 feet before he was thrown off, bloodied with cuts and and scrapes, and a sprained hand.Soon after, a Hispanic woman in her 20s, with a baby in her back seat, raced to his side. She tended to him before calling 9-1-1."Shows there are good people. She was more worried about me than her baby," said De Leon.When help arrived and she left, De Leon never got her name. SAN DIEGO (KGTV) -- A San Diego couple is challenging a luxury carmaker after their BMW SUV suddenly caught on fire. The Pearsons said they bought a BMWx5 in August 2018 because they thought it would be safe and reliable. In December, they replaced the battery at BMW of Escondido. The next month, Lisa Pearson was driving on Interstate 15 when she noticed a warning light showing an airbag and parking brake error. She pulled over and noticed smoke coming from the back of the car.“It happened so fast,” Lisa said. A fire had started from the rear of her vehicle. A passing tow truck driver stopped to help put out the smoke and flames. Firefighters told her it could have been a different story if her children were inside in their car seats. “It was really nerve wracking,” Lisa said. “I was really thankful since I saw that the fire was happening in the back of the car that the kids weren’t there.”They said their SUV was a total loss. It was after the fire that the Pearsons ran into even more problems. When BMW of North America inspected the vehicle, they blamed it on “an improperly secured connection of the battery cable." In the letter to the Pearsons dated February 29, 2019, Executive Customer Care Representative Michael Pigoncelli wrote, “BMW NA cannot accept responsibility for any damage, injury, or loss associated with the fire…” BMW of Escondido disagreed with corporate’s allegations, writing to the Pearsons that “the repair was done as per the BMW guidelines.” “It just seems that they’re pointing fingers at each other. Nobody cares about us or the consumer,” said Ryan Pearson. “It was still under factory warranty,” Lisa added, saying they hadn't even had it for five months. “What’s it going to take? Does someone need to die?” The Pearsons are not the only local couple to have their BMW catch fire. In October 2017, Laura Ohme said her parked BMW started a fire at the Torrey Hills homes where she lived with her family.She was in the shower when she heard a strange noise. “I just hear this really really weird popping kind of noises,ll ” Ohme said. With her two kids asleep in their rooms, she threw on a towel to find out what was going on. She went downstairs and saw smoke. “The door itself [was] literally black and glowing.”Ohme grabbed her two children and ran outside the house. “The fire, it was raging at that point,” she said.Fire investigators determined her recently purchased 2014 BMWx5 started the fire. It was a certified pre-owned vehicle she bought just a few months before. Ohme said the vehicle was sitting in the garage and turned off at the time of the fire. "I didn’t even put 5,000 miles on the car,” Ohme said. She said BMW has had a “non-response” to the situation. “BMW is not taking responsibility,” she added.While the Ohmes and Pearsons’ fires started under different circumstances, they shared things in common. Both BMWx5s were recently purchased just a few months before the fires. They both had warranties and neither vehicle was under a recall.ABC News started investigating mysterious BMW fires in 2017. Like the Ohmes, dozens involved vehicles that were parked and turned off. Since then, about 1.6 million BMWs have been recalled for fire risk. A BMW spokesperson told Team 10: "BMW notifies owners of vehicles affected by a recall via registered mail to advise them that their vehicle is part of an upcoming recall campaign and what the next steps are. BMW recently expanded its recall notification system for vehicles built after 3/2016 to allow owners to also be notified through the BMW Connected App on their smartphone. A vehicle recall may require that a part be replaced or software be updated." A spokesperson for BMW of North America told Team 10 they could not comment on the Ohme’s situation “due to litigation.” The Ohmes' attorney told me they are preparing a class-action lawsuit for the damages caused by the BMW fires.“I was able to get myself and my children out safely, but at some point someone is going to die,” she said.Regarding the Pearsons, BMW of North America wrote on March 22nd that they still believe the Pearsons’ vehicle caught fire because of “an improperly tightened battery terminal after a recent battery service.” The spokesperson added: “BMW is currently working with the dealer and the owner to resolve the matter.”In an email on March 22nd, a few days after Team 10 first contacted BMW of Escondido, the service manager wrote he “sent the Pearsons claim and contact info for [their] insurance company” and instructed their insurance to settle her claim as quickly as possible. They still disagree with BMW of North America’s findings. “We can’t let this go on and hurt other people,” said Ryan.“You are saying you are a very high quality company that sells very luxury cars, and yet your cars are catching fire.
