Death row inmate, 61-year-old David Earl Miller will be executed tonight by the electric chair at 7 p.m. tonight.Miller is the second Tennessee death row inmate in just over a month to choose to die by the electric chair. His attorneys argued that the state's lethal injection method causes a prolonged and torturous death.Tennessee Governor Bill Haslam declined Miller's clemency application, in which his attorney claimed Miller had been suffering from “severe mental illness” at the time of his crime, and that his mental state places him “far outside that group of offenders who are the worst and for whom the death penalty is reserved.”Miller is also asking the U.S. Supreme Court to issue a stay of execution to address two separate legal issues. The high court declined to issue stays for either of the two other inmates executed this year.The inmate was moved to death watch Wednesday and served his requested last meal Thursday afternoon.Miller was convicted of killing 23-year-old Lee Standifer, who was mentally disabled, in Knoxville in 1981.A man Miller was living with found Standifer's body naked in the yard with her hands bound and roped wrapped around her body. DENVER, Colo. — On Wednesday, a Boulder man released videos of his July 29 arrest, and said he's ready to take action against the Denver Police Department for "savagely" beating him. He also claims an officer sexually assaulted him with a baton.Michael Jacobs, a self-described student activist, was arrested on July 29 during a "Stop the Sweep" homeless protest at Lincoln Park, across from the Colorado State Capitol.He says he was rattling a fence at Lincoln Park to get an officer's attention and says he was taken down by officers."I was grabbed from behind, it felt like it was from my neck, no warning, no 'you're under arrest,'" Jacobs said.It's important to stress that little is known about what led up to the takedown. Video shows people shaking a fence at the park and then the takedown.In the video, you see an officer run towards Jacobs and then several officers holding him down. You can briefly see an officer use his baton against Jacobs in the recording."One of the officers took his baton, lifted it in the air and forcefully shoved it into my a**," Jacobs said.A probable cause statement released by the Denver Police Department claims Jacobs was part of a group trying to push down a gate at Lincoln Park and adds that they managed to bring it down and get inside.But in the video, Jacobs is outside of the fence.The police report states Jacobs violently resisted arrest and even grabbed an officer's pepper ball gun. It's a claim Jacobs and his attorney, Dr. Matt Greife, dispute."That could not be further from the truth," Jacobs said."To say that he attempted to disarm a police officer of their pepper gun or pepper ball gun, that's nonsense, he was on the ground way too fast," Dr. Greife said.According to Dr. Greife, it's been challenging to obtain vital evidence they should be granted to prepare for a lawsuit and a civil claim they plan to file."We should know what the police reports say. We should know what the body cams tell us," Dr. Greife said.Denver police say they launched an internal investigation and added that it would be inappropriate to comment further.Medical records provided by Jacobs' attorney to KMGH show a doctor couldn't conclusively identify sexual abuse from the incident.Jacobs is facing a felony charge of attempting to disarm a police officer. Trump for President, Inc organization for claims of defamation, civil conspiracy and intentional infliction of emotional distress.“I have filed a lawsuit in Colorado in an effort to unwind as much of the damage as possible done to me, my family, my life, and my livelihood as a result of the numerous false public statements that I was somehow responsible for ‘rigging’ the 2020 presidential election,” Coomer said.The 52-page lawsuit filed in the 2nd Judicial District Court also names Sidney Powell; Sidney Powell, P.C.; Rudolph Giuliani; Joseph Oltmann; FEC United; Shuffling Madness Media, Inc. d/b/a; Conservative Daily; Jim Hoft; TGP Communications LLC d/b/a; The Gateway Pundit; Michelle Malkin; Eric Metaxas; Chanel Rion; Herring Networks, Inc. d/b/a; One America News Network; and Newsmax Media, Inc.Coomer claims statements from the defendants have led to death threats, constant harassment and damage to his reputation as a national expert on voting systems.The lawsuit says Oltmann made a claim he infiltrated a conference call with Antifa activists in which he "heard someone identified as 'Eric from Dominion,' and that this 'Eric' stated he would ensure the election went to President-Elect Biden." The suit goes on to say the President began publishing numerous false statements alleging Dominion interfered with the election; his son and campaign surrogate, Eric Trump, tweeted a photo of Coomer alongside the claims; and the President’s campaign lawyers identified Coomer in a nationally televised press conference where they described him as a “vicious, vicious man” who “is close to Antifa.”“The widespread dissemination of false conspiracy theories about the 2020 presidential election has had devastating consequences both for me personally and for many of the thousands of American election workers and officials, both Republican and Democratic, who put aside their political beliefs to run free, fair, and transparent elections.
