California will end the cash bail system in a sweeping reform for the state. Rather than requiring defendants to pay in order to be released before trial, their release will hinge on an assessment of their risk to public safety."Today, California reforms its bail system so that rich and poor alike are treated fairly," Gov. Jerry Brown said in a statement.Brown signed the bill Tuesday, and the new law goes into effect October 1, 2019.Critics have long contended that the money bail system perpetuates inequality. While some people are able to quickly get out of jail by posting bail, people who aren't able to afford it sit in jail until the court takes action, or until they work with a bail bond agent to secure their freedom, which can leave them in debt."Abolishing money bail and replacing it with a risk-based system will enhance justice and safety. For too long, our system has allowed the wealthy to purchase their freedom regardless of their risk, while the poor who pose no danger languish in jail," said Assemblymember Rob Bonta, one the lawmakers who introduced the bill, in a statement.Under the new law, a pretrial assessment would be done by either court employees or a local public agency that has been contracted to determine a defendant's risk. That entity would assess the likelihood that the person will not appear in court or commit a new crime while released, and would make a recommendation for conditions of release. The pretrial assessment services will not release a person arrested for violent felonies.The California Money Bail Reform Act, also known as Senate Bill 10, passed in the State Senate with a vote of 26-12, and the General Assembly by 42-31."SB 10 puts all Californians on equal footing before the law and makes public safety the only consideration in pretrial detention. This critical reform is long overdue," Toni Atkins, Senate president pro tempore, said in a statement.But the ACLU in California expressed disappointment over the bill, saying it "is not the model for pretrial justice and racial equity that California should strive for.""It cannot guarantee a substantial reduction in the number of Californians detained while awaiting trial, nor does it sufficiently address racial bias in pretrial decision making," said the three executive directors of the California ACLU affiliates, Abdi Soltani (Northern California), Hector Villagra (Southern California) and Norma Chávez Peterson (San Diego & Imperial Counties). "Indeed, key provisions of the new law create significant new risks and problems."The organization pulled its support for the bill earlier this month as the it underwent changes in the state legislature. 2705

CARMEL, Indiana — The family of a Carmel High School student who took his own life after getting in trouble at school has filed a lawsuit against the school district.Patrick McCalley got in trouble for a Snapchat message, showing a noose around the neck of an African-American schoolmate. McCalley died by suicide after the school had him sign an affidavit over the incident without his parents being notified.His parents are now suing the Carmel-Clay School District for negligence and for violations of due process of the Fourth Amendment's ban on unreasonable searches. 610

Businesses are one step closer to growing their own marijuana in San Diego. The deadline to enter the lottery for those permits ended Wednesday afternoon. Bradley Fisher really has his hopes up. "I'm getting it," said Fisher. "I'll be one of the 40 forsure."  He applied for two permits Wednesday so his client can start growing their own pot. He submitted his paperwork ahead of the lottery deadline, which gives him a better chance of getting that permit down the road. His client already has a warehouse set up for production. "They're able to grow it and bring it right to the dispensary," said Fisher. "They can make baked items as well, cookies, cakes the whole nine-yards, and it's all legit because they'll have permits for it."But it's not a simple process. "They're gonna put like a mezzanine in the building, in the warehouse, ovens, and stuff like that, tons of lights," said Fisher. "Electric is going to be off the hook; water is going up there. It's very costly, but then again its very beneficial."The city is now reviewing those applications to make sure they meet their demands. "To make the cultivation center you need to be 1,000 feet from any schools, any churches, daycares, parks."Applicants can still apply for appointments Thursday even if they weren't part of the lottery. CARLSBAD, Calif. (KGTV) - Two teenagers were stopped in their tracks when they looked into a tree and found a creature looking back at them along a Carlsbad street.Two Fridays ago, around 10:30 a.m., a freshman college student did a double take while walking along Babilonia Street in the La Costa area. He called a friend, who drove right over. They made a quick recording."Omigod, look at him," one of the teens is heard whispering in the video.Perched in a tree, about 25 feet up, was a mountain lion, growling.The mother of one of the teens tells ABC 10News soon after they stopped recording, they looked up, and it was gone.Lauren DuBois of Project Wildlife at the San Diego Humane Society, says it's hard to tell the big cat whether the mountain lion was a juvenile or an adult. She says it's not surprising it was in a tree."Not unusual at all. They will climb trees, and rest in trees quite often," said DuBois.Dubois says it was likely relaxing after a long night."They can have up to 100 square miles of a territory. Most of time they are hunting from dusk to dawn, so a lot of the time, that’s where (tree) they will be resting," said DuBois.The concern? Less than half a mile away, is La Costa Meadows Elementary School, which began in-person learning in October.Neighbors tell us there have been sightings of a mountain lion in nearby Box Canyon for years. One of those neighbors did file a report of the most recent sighting with state Fish and Wildlife officials.DuBois say this big cat wasn't being aggressive. What about the growl?"Hey, I’m up here. Don’t want you to be there. I'm going to take off now," said Dubois.She says if you ever do spy a mountain lion in a tree, slowly back away and maintain eye contact."It's probably going to just leave. If it does come after you, make yourself large and make noise," said Dubois.ABC 10News reached out to the elementary school and Fish and Wildlife officials, and are waiting to hear back. 1962
