Nursing homes and long-term care facilities need more personal protective equipment (PPE) than they did at the start of the pandemic.“If a home doesn't have at least a week's worth, that's a problem. It's regarded as a critical shortage and the reason why is because if you have an outbreak, you can start chewing through your existing supplies like that,” said Teresa Murray, a consumer watchdog at the U.S. Public Interest Research Group (U.S. PIRG).The group looked at data from facilities sent to the Centers for Medicare and Medicaid. They found one in five were dangerously low on one or more items, like gloves and hand sanitizer. Almost half didn't have a one-week supply of at least one type of PPE.“And they say that it's not unusual at all for nurses to use masks for like five days,” said Murray. “If they even have gowns, they're reusing them.”U.S. PIRG says these facilities couldn't compete with demand for supply.The Medical Supply Transparency and Delivery Act, which is sitting in Congress, would help stabilize prices. And the Defense Production Act could be used to increase U.S. production of PPE.“And not only does it affect the residents that are in that home. It affects the workers who, guess what, they go home, they go home to their families,” said Rowan. “They go home, to their grocery stores and to their churches. And their kids go to school. And so, this is, I mean, it's no surprise that this is why we're seeing some of these community outbreaks because of one case that starts in a nursing home.”When the Centers for Medicare and Medicaid said the data was accurate, U.S. PIRG says they were referred to FEMA for a solution plan. (KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. OCEANSIDE, Calif. (KGTV) -- A medical examiner’s report gives new details about an Oceanside plane crash in January. According to the report, 58-year-old Raymond Petty Jr. had cocaine and marijuana in his system at the time of the crash. Initial reports indicated that Petty was the pilot, but the Oceanside Police Department said it was possible to fly the plane from either seat. The plane crashed into a hillside off State Route 76 near Canyon Drive in late January. Heavy fog in the area blanketed the crash site, preventing it from being spotted for several hours. One pilot is dead and another hospitalized after a plane crash at a Texas Air Force base.An Air Force T-38C Talon crashed Tuesday night at the Laughlin Air Force Base, according to a statement from the base. The plane is considered a training aircraft.The names of the pilots are being withheld pending family notification, the statement said. The surface is shiny but does not appear to be reflective.According to the post, the item was found in the "middle of nowhere."Officials won't announce the exact location of the object as "it is in a very remote area, and if individuals were to attempt to visit the area, there is a significant possibility they may become stranded and require rescue."It's not known who installed the metal monolith.
