VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis. WASHINGTON (AP) — A statue of Confederate Gen. Robert E. Lee that represented Virginia in the U.S. Capitol has been removed.Virginia Gov. Ralph Northam said in a statement that workers removed the statue from the National Statuary Hall Collection early Monday.“The Confederacy is a symbol of Virginia’s racist and divisive history, and it is past time we tell our story with images of perseverance, diversity, and inclusion,” said Northam.Each state is entitled to display two statues in the collection. Lee’s statue had stood with George Washington’s statue since 1909 as Virginia’s representatives in the Capitol.The Lee statue had been one among 13 located in the Crypt of the Capitol, representing the 13 original colonies.Northam had requested its removal and a state commission has recommended replacing Lee’s statue with a likeness of Barbara Johns.Johns was an American civil rights leader who protested poor conditions at her all-Black high school in the town of Farmville in 1951. Her court case became part of a landmark U.S. Supreme Court decision that struck down racial segregation in public schools.Virginia’s General Assembly must approve the replacement before a sculptor can be commissioned for the new statue. WARNING: This story contains content that is graphic in nature.LAND O' LAKES, Fla. -- A Pasco County, Florida deputy has been fired after he was arrested for touching a woman against her will and placing semen on her. Joseph Mercado, 25, has been charged with battery. The Pasco County Sheriff's Office has confirmed Mercado was terminated after he was arrested on February 28. Mercado and the victim were "NOT involved in an ongoing dating relationship at the time of this incident," according to the arrest affidavit.On February 15, 2018, while Mercado was off-duty, he arrived at the victim's home and told the victim they needed to discuss a "serious incident" that he witnessed. The victim met Mercado outside in the driveway and repeatedly asked him to leave. According to arrest documents, Mercado masturbated in front of the woman. She repeatedly told him to leave. Mercado then used his finger to place semen on the victim's breast, above the neckline of her shirt and then attempted to place it on the victim's lips, prior to her pulling away, according to the arrest affidavit. The victim continued to ask Mercado to leave and she went into her home until he left the property.Mercado was arrested on February 28th without incident.The Sheriff released a statement about the incident: "The Pasco Sheriff's Office ensures discipline is paramount in our organization.
