SAN DIEGO, Calif. (KGTV) -- An appeals court today overturned a ruling that would have allowed the conditional release of the “Bolder Than Most” rapist, Alvin Quarles. The ruling was issued by the 4th District Court of Appeals Monday. The court said, in part that “Quarles is a serial rapist whose crimes were shockingly brutal and destructive. If he fails after he is conditionally released, considering his past, we shudder to contemplate the consequences of such a failure.”After news broke of the reversal, Dianne Jacob, who serves on the San Diego County Board of Supervisors and has been adamantly against the release, spoke out on Twitter. We must continue to fight the placement of sexually violent predators into our communities,” Jacob said in part. The ruling comes after San Diego County Superior Court Judge David M. Gill's decision to release Quarles to a home somewhere in San Diego County. After his release, he would have undergone treatment through a conditional release program.Gill's ruling followed a series of closed-door hearings that involved testimony from psychiatrists and other experts. Quarles was dubbed the "Bolder Than Most" rapist due to the way he attacked his victims at knifepoint, sometimes forcing the women's husbands or boyfriends to watch. In 1989, he pleaded guilty to committing over a dozen sexual assaults in the mid-to-late 1980s. He was sentenced to 50 years in prison. Services and locations are posted on the church's website. A video on the church’s website shows pastors Jurgen and Leanne Matthesius speaking about why they have decided to reopen. The two said it was time to reopen and that “fighting for our religious freedoms and pushing back against government overreach is not only worth the cost; it’s essential.”In the video, the pastors say that the governor and county officials continue to keep churches under strict regulations, which prevents them from meeting the needs of their congregation.“Sadly, we’ve had five people connected to our church that have lost their lives, not from the virus but because of the virus. This was due to many factors, including suicide, drug overdose, and severe neglect from a hospital who was primarily focused on their COVID patients,” said Leanna Matthesius in the video.While county supervisor Nathan Fletcher acknowledged the importance of religious freedom and constitutional rights, he spoke of his frustrations with the church at a county COVID-19 press conference Monday. “It is very frustrating to see an entity that has an avenue to gather that is allowable, that is acceptable, that is much safer, choose to openly defy that in order to expose the members of their congregation to a very dangerous situation,” said Fletcher. “Just gather outdoors, physically distance, and wear a face covering.”Under the county’s public health order, houses of worship can continue to operate if “outdoor services and cultural ceremonial activities may be conducted provided all persons practice social distancing.”A county spokesperson tells ABC 10News that the church isn’t facing additional action from the county as of right now.ABC 10News reached out to Awaken Church for further comment but did not hear back. 2380

  

San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. SAN DIEGO COUNTY (CNS) - Seven "cool zones" are scheduled to open at noon Monday in San Diego County to provide relief from high temperatures.The cool zones are air-conditioned locations throughout the hottest areas of the county:-- Borrego Springs Library, 2580 Country Club Road;-- Fallbrook Community Center, 341 Heald Lane;-- Lakeside Community Center, 9841 Vine St.;-- Potrero Branch Library, 24883 Potrero Valley Road;-- Santa Ysabel Nature Center, 22135 CA-79;-- Spring Valley Community Center, 8735 Jamacha Blvd.; and-- Valley Center Branch Library, 29200 Cole Grade Road.All sites will be open from noon to 5 p.m. Monday through Friday.COVID-19 safety measures will be in place. Anyone entering a cool zone will have their temperature taken and all visitors and staff must wear face coverings and practice social distancing.The libraries are cooling sites only; no library services are being offered.Animals, except service animals, are not permitted in cooling zones."Although we need to take steps to keep seniors safe, it still remains important to also keep them cool," said Supervisor Dianne Jacob. "Cool zones provide a refuge during the hot summer months, so it's helpful the county has developed a plan to get them open."The cool zones program is offered in partnership with the San Diego County Health and Human Services Agency Aging & Independence Services and San Diego Gas & Electric Co. 1424
