SAN DIEGO (KGTV) - Court services are being drastically reduced due to the Covid-19 pandemic, which affects both civil and criminal proceedings. The closure will last until April 3rd.“My fear is that we’re going to have situations where individuals are going to stay in custody longer than what the law permits,” said David P. Shapiro, a criminal defense attorney. “What happens to the individuals who are in custody who have a future court date?”By law, you should have your first court appearance within 48 hours after your arrest. That excludes weekends and holidays, according to a spokesperson with the District Attorney’s Office.“We are in constant meetings with the court and the Public Defender and the Sheriff, our law enforcement partners,” said District Attorney Summer Stephan.Stephan said they have dealt with closures, such as during our past major wildfires. They are working on a system to review criminal cases to see who is suitable for community release.“This is an evolving process, but what we’re trying to do is to maintain due process in the time of crisis,” Stephan said.A Sheriff’s Department spokesperson told 10News they are “working with the District Attorney’s Office and evaluating the impact” the court closures might have.“I was personally hoping they would have an emergency department available through all this just for arraignments, just for in-custody arraignments. Then we can at least address individuals who have been arrested,” Shapiro said.The court will still be available for restraining orders, emergency conservatorship, and search warrants. SAN DIEGO (KGTV) -- At least one person died in a Bay Park crash as rain soaked the roads in San Diego County Sunday morning. According to California Highway Patrol, the crash happened just before 6 a.m. Sunday on northbound Interstate 5 just before Clairemont Drive. CHP reports that the vehicle was traveling at high speeds just before the crash. At least three vehicles were involved in the crash. According to CHP, the driver of a pickup truck crashed into the center divide before being struck by two other vehicles. The driver of the truck was standing outside his vehicle when he was hit and killed by one of the vehicles. The driver was 48-year-old Joseph Vito Berardino, according to the medical examiner. At this time, it’s unclear how many more people may have been injured. 794

SAN DIEGO (KGTV) -- County Supervisors Wednesday sent a letter to Governor Gavin Newsom asking him to take a second look at San Diego, potentially allowing shuttered businesses to reopen amid COVID-19. In the letter, Supervisors Kristin Gaspar, Jim Desmond, and Councilmember Chris Cate of the sixth district said Newsom’s “one-size-fits-all approach to closing entire business sectors is misguided as evidenced by the many sectors in San Diego forced to close their doors again despite not having contributed at all to the rise in our local cases.”Supervisors also pushed the governor to give more control to local leaders and health officials. SAN DIEGO (KGTV) - Candalee Carbonel remembers the panic she felt Tuesday when her son's principal called about an incident involving her 7-year-old. "This is a horrible situation, I pray no other family has to go through this," said Carbonel. Her son Cole has autism and managed to walk off the Miller Elementary campus in Tierrasanta without staff noticing. He walked about half a mile to his house. "It broke my heart, knowing I drop off my child every day at school in their hands. They are now responsible to be his safety, to keep him out of danger. This really breaks my heart," said Carbonel. Carbonel says panic turned to frustration when she learned how the school handled the situation. "They should've called 911, called the police, then called me, and I could've helped. I could've been somewhere; I could've come home, I could've been here for my son when he was looking for me," said Carbonel. But instead, the principal went to look for Cole herself, driving to the family's home. She found Cole inside the house, watching television on the couch, and proceeded to take him back to the school and call Carbonel. "It broke my heart that a little kid could be running the streets, and no one called his mom," said Carbonel. She's grateful he made it home safe, but Carbonel says she can't help but wonder what could have happened to him on the walk home. The military family is new to the district, and Carbonel says she's been advocating for her son to have a one-on-one aide as he did in his last school district. She was pushing for more support for her son so that an incident like this wouldn't happen. SDUSD says as a result of this incident, they are going to add an additional staff member to provide above-and-beyond support to Cole's classroom.
