SAN DIEGO (KGTV) - The Secretary of the Interior stated in no uncertain terms in a letter sent to the San Diego County Board of Supervisors Thursday federal law supersedes state law. This was in reference to an ordinance the San Diego County Board of Supervisors passed in November banning recreational shooting, saying it was unconstitutional.Currently the law states you can shoot at targets on BLM land, "as long as it is done in a safe manner, without damaging natural resources or improvements on public lands." There is a section that states you may not fire any plastic pellets, exploding, tracer or steel core rounds. He also said the board never spoke to the federal government."When he [the Secretary of the Interior] found out the entire department said no this isn’t something we’re going to stand by at all," Schwartz said. The Secretary of the Interior sent a statement to the Board of Supervisors Thursday citing the Supremacy clause in the Constitution and, "law enforcement personnel have no authority to enforce unconstitutional pronouncements of law."RELATED: After Gate Fire, recreational shooting ban hits public landsJacob fired back with this statement: "The BLM decision is unfortunate and frustrating because this area is highly prone to wildfire, and we've already learned the hard way that shooting at this spot poses a significant risk to life and property. "The gun owners consider this a huge win, it shows what activism can do and when people band together and get involved we can stop unconstitutional regulations by elected officials abusing their power," he said, adding he hopes to see the ordinance removed from the books. 2485

SAN DIEGO (KGTV) -- The San Diego Superior Court is having a hard time getting potential jurors to show up for jury duty. Jury trials started again last week after a seven month break because of the COVID-19 pandemic. The lack of potential jurors reporting to the court house forced the continuation of a criminal case this week. For two weeks in a row, only about 40 people showed up for their jury duty. ABC 10News learned 900 jurors were summoned both times. ABC 10News spoke to the court's presiding judge, Lorna Alksne, who explained the court is taking all safety measures, like temperature checks, mask use at all times, Plexiglass barriers and social distancing. Alskne explains there are consequences for not showing up, like sanctions and fees, but the court isn't taking those measures yet. The judge says about 300 people did respond this week delaying their service, but the hundreds of others did not respond. Jurors are able to delay their service if they have COVID-19 safety concerns, but court officials say otherwise, people need to show up. Local defense attorney Jan Ronis says the court is doing the best they can, but he worries a smaller selection of potential jurors could impact the diversity of the jury pool. Alskne says the court will summon 2,400 people next week, instead of 1,800, in hopes of getting enough jurors for two upcoming cases. 1379

  

SAN DIEGO (KGTV) — This November, Californians will consider whether or not to repeal a recently enacted gasoline tax meant to drum up funds for road repairs around the state.Proposition 6 aims to repeal Senate Bill 1, which was enacted in 2017. SAN DIEGO (KGTV) - The trial for a former San Diego County sheriff's deputy accused of sexual misconduct while wearing his uniform began Monday in Vista.More than a dozen women claim Deputy Richard Fischer made unwanted advances."I think he's a bad guy," a San Marcos woman, who filed ,000,000 claim against the County, said.She said in August of 2017 two sheriff's deputies knocked on her door in the middle of the night for a welfare check. There was no problem and they left but she said Fischer returned alone an hour later, saying he needed to use her restroom; then told her she was cute and hugged her, several times."I was stunned shocked, it was very fast and confusing...I felt very vulnerable, intimidated, felt weak. I felt little." She said, next to tears. "It's just a mess! Everything is a mess! This is hard to do. He shouldn't have come back to my house and I don't ... Everything's a mess!"Similar instances were described by other women. In October of 2017, near the entryway of a 64-year-old woman's condo, Fischer took her report for a domestic violence incident and then made his move."His hands went all the way down to her butt and he squeezed both of her buttocks... he took her hand and pulled it down to his groin area," Lawyer Dan Gilleon said. He represents several women who filed claims against Fischer.Gilleon made a theme apparent, "he knows that she's alone, and she's vulnerable, and she's scared." Another victim called him a predator.Some women who came forward claim Fischer became more brazen, forcing sexual acts.Wednesday a plea deal fell through. The deal would mean Fischer would plead guilty to four felony charges -- down from more than 12 felonies -- and serve no more than five years in prison.10News learned that Fischer would also have to register as a sex offender for life under the plea deal.Fischer faces more than 25 years in prison if convicted of all charges.
