SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) - A controversial retirement center proposed by Skyline Church is moving ahead following a San Diego Planning Commission vote Friday.Officials voted five to one in favor of advancing to the development to the next step.Church officials are looking to build the retirement center in the Valle De Oro neighborhood. It would be located on almost nine acres next to Skyline Church. The 232 units would be made up of independent and assistant living spaces. The facility would also have a walking trail, offices, a pool, and clinics.Those who are in support of this plan say it’s needed because of the growing aging community in the San Diego County. "This application is more than just a request. It’s asking the County’s permission to serve our community, by seeking your permission for this retirement center," said Pastor Dan Grant of Skyline Church.Opponents say this will cause traffic problems in an already congested location along I-94 just East of Via Mercado. They add, this would be a huge environmental impact on the area.Now that the Planning Commission has agreed to move forward, they will bring this recommendation to the Board of Supervisors. 1180

SAN DIEGO (KGTV) -- A 17-year-old boy accused of killing a Carlsbad woman on a popular hiking trail denied the allegations against him during a virtual arraignment Thursday morning.Through his attorney, the teen denied all allegations. He faces charges in connection with the Nov. 23 death of 68-year-old Lisa Thorborg.Thorborg was on a morning walk at Hosp Grove Trail when Carlsbad police investigators said she was attacked and stabbed to death.On Dec. 14, Carlsbad police announced the arrest of a 17-year-old boy in the case. Little information on the teen was released, but police noted the suspect is a Carlsbad resident.Thorborg's death struck a chord with many in the community. In the days following her death, a large group came to honor her by finishing the walk she started.The woman’s death also left many neighbors upset and concerned about their safety while on that trail.During Thursday’s arraignment, the judge also granted the teen's request to two phone calls -- one to his Mom, the other to his grandmother.ABC 10News learned Thorborg’s family was also listening to the hearing through the phone.Another hearing in the case is set for Dec. 22. 1173

SAN DIEGO (KGTV) – A driver was shot while traveling on a Clairemont street Thursday night, according to police.At around 10:30 p.m., a man was driving in the 5800 block of Chateau Drive when he was hit by gunfire, San Diego police said.ABC 10News learned the injured man was able to drive a few blocks before the SUV crashed into an electrical box in front of San Diego Fire-Rescue Station 36.Firefighters and paramedics at the station heard the crash and rushed to help the victim, who had at least one gunshot wound on his upper body.The unidentified victim was taken to Sharp Memorial Hospital, but his condition is unknown as of 9 a.m. Friday.Police said witnesses reported seeing a silver 4-door sedan leaving the shooting scene. 743

SAN DIEGO (KGTV) - A driver was killed and several teens were injured Tuesday night in a high-speed solo vehicle crash along State Route 905 in south San Diego.The crash happened on the westbound lanes near the Beyer Boulevard off-ramp about 9:15 p.m., according to the California Highway Patrol.The driver lost control of the dark-colored Chrysler 300, struck the center divide, and was ejected from the car. The victim was declared dead at the scene. It was initially reported that the driver, a 21-year-old male, was a teenager. Firefighters worked to extricate two passengers trapped in the rear passenger seats, according to the San Diego Fire-Rescue Department.The injured victims, three males and two females ranging in age between 15- to 21-years-old, were transported to UCSD and Scripps Mercy for their injuries. Their conditions are unknown at this time.CHP officers are investigating if drugs, alcohol, or distracted driving contributed to the crash.Investigators are asking anyone that witnessed the crash to contact the California Highway Patrol.The Beyer Boulevard on-ramp to the westbound state Route 905 was shut down until at least midnight, according to the CHP. 1191
