SAN DIEGO (CNS) - A San Diego judge's ruling today clears the way for the proposed Plaza de Panama project in Balboa Park to proceed.San Diego Superior Court Judge Gregory W. Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W. Elliott said after the ruling.The Plaza de Panama project will also include improvements to more than six acres of park space and improved park access. SAN DIEGO (CNS) - A pair of thieves stole a safe and pistol-whipped a woman during a home-invasion robbery in the Jamacha-Lomita neighborhood, police said Tuesday.The robbery happened shortly before 5:10 p.m. Monday at a group home on Blackstone Court, a short, dead-end street off Meadowbrook Drive south of Jamacha Road, San Diego police Officer John Buttle said.A man and a woman entered through the back door of the home, then began asking around for the manager of the home, Buttle said. When a 40-year-old woman told them the manager lived upstairs, the pair began looking around and the male suspect spotted a safe.The man picked up the safe and an altercation ensued, during which he pistol-whipped the 40-year-old victim, the officer said. The man then carried the safe outside to a black Ford Escape SUV.The pair of thieves were last seen in the Ford heading north on Meadowbrook Drive toward Jamacha Road, Buttle said.No detailed suspect descriptions were immediately available. 997

SAN DIEGO (CNS) - A man who beat his estranged wife to death with a commemorative baseball bat as she delivered food to him at his City Heights apartment was sentenced Friday to 16 years to life in state prison.Dana Marion Davis, 56, pleaded guilty at an earlier hearing to second- degree murder in the death of April Davis, his spouse of more than 30 years and the mother of his six children.The defendant beat the 51-year-old victim with a wooden bat on the afternoon of Oct. 7, 2017, then prevented a family member and police from entering the apartment, said Deputy District Attorney Stephen Marquardt. When officers finally gained entry, she was found dead on the floor.Davis told Judge Michael Smyth that he was remorseful for killing the mother of his children."She didn't deserve this," the defendant said before he was sentenced.To his children -- three of whom were present in court -- Davis said, "I am deeply sorry for the pain I have caused you."A psychologist determined the defendant suffered childhood development trauma that affected his relationship with his wife, Deputy Public Defender Amy Hoffman told the judge.When talking to police after the murder, Davis was "clearly in shock" as to what happened, Hoffman told the judge. The attorney said alcohol was involved in the fatal encounter.According to Marquardt, the defendant was on probation for domestic violence when he killed his wife. The two had been living apart.The prosecutor said the defendant had been violent with the victim in the past, having been convicted of misdemeanor domestic violence in 1994 and 2016.When the defendant was convicted of punching his wife in the head in 2016, he was also prosecuted for choking his teenage daughter, Marquardt said. 1749

SAN DIEGO (CNS) - A student pilot and a flight instructor were uninjured after a Cessna plane ran off the Montgomery-Gibbs Executive Airport runway Sunday and crashed through a fence, authorities said.The incident happened at about 1:15 p.m. at the airport on 3750 John J. Montgomery Drive, according to the San Diego Fire and Rescue Department.Montgomery Field and Kearny Villa Road were shut down. There were no reports of fire.After the incident, Montgomery Field diverted air traffic to Brown Field in Otay Ranch and Gillespie Field in El Cajon. 557
