SAN FRANCISCO (AP) — A California state appeals court has thrown out the sole conviction against an immigrant who fatally shot a woman on the San Francisco waterfront in 2015.The 1st District Court of Appeal on Friday overturned a gun conviction against Jose Inez Garcia-Zarate because the judge failed to instruct the jury on one of his defenses.Garcia-Zarate was acquitted of murder in the killing of Kate Steinle, who was on a pier with her father when she was shot in the back in July 2015.The case of Garcia-Zarate, who was in the country illegally and had been deported five times, touched off a fierce immigration debate.He said he unwittingly picked up the gun wrapped in a T-shirt and it fired accidentally.Garcia-Zarate is in custody and facing federal gun charges. 783

San Diego (KGTV)- For weeks, the pandemic left nursing students at CSU San Marcos in limbo when it came to completing their graduation requirements. Now, thanks to the county, the students can get their clinical hours.When the pandemic hit in March, nursing students were forced out of public health facilities to get their hands-on experience for their classes.“We didn’t know when we were going to go back, and it was halfway through the spring semester,” says nursing student Winter Minton.Minton will be graduating from CSU San Marcos in the spring.The nursing student says for weeks, students were unsure about how they would obtain their clinical hours. A total of 135 hours are needed for two classes.“When we were ready to go back, the county was not willing, ready to have nursing students on site at all,” says Course Coordinator Madelyn Lewis.In August, the county opened a COVID-19 testing clinic on campus and allowed nursing students to work on-site. The students assist patients with self-administered COVID tests while wearing full protective gear.“Not only does it benefit us, but it benefits so many people,” says Minton. “I heard people driving all the way down from Irvine or Fullerton just to get the exam done.”Minton says the walk-in clinic sees more than 300 patients a day.The testing site is open to the public seven days a week. 1363

San Diego (KGTV)- Just weeks ago the Veterans Village of San Diego wasn’t sure they’d have the money to fund their annual Stand Down event. But thanks to generous sponsors, the organization is helping hundreds of homeless veterans this weekend. The three-day event is being held at San Diego High School. More than 700 veterans are expected to participate in the event throughout the weekend. A variety of services is being offered. Some veterans say they are in desperate need of housing, while others tell 10News they are just fighting to keep the roofs they already have over their heads. “I’m minding my own business, next thing I hear knocks on the door ‘hey you can’t park here,’” says Vietnam Veteran Robert Ewing who was given 15 parking tickets for his motor home in the last three months. “That’s why I’m here trying to get rid of these.”Ewing says it has been a struggle trying to find a safe place to park his motor home. Among a variety of services, Homeless Court is being provided at the annual Stand Down event. “The City Council needs to sleep on the streets for a couple of nights and see what the homeless go through. It’s no joke,” says Ewing. For more than three decades, the Veterans Village of San Diego has been putting together this event. It brings in more than 100 organizations to help the homeless. Even though donations were low a few weeks ago, organizers say they were never going to cancel the event. They are just grateful for their donors, so they did not have to scale the event down. 1529

SAN DIEGO (KGTV) Sewage contaminated water is keeping swimmers out of the ocean in Imperial Beach. Late Tuesday afternoon, The County of San Diego Department of Environmental Health extended an existing water contact closure to include all of Imperial Beach. The original closure was issued on June 27th for the Tijuana Slough National Wildlife Refuge shoreline. According to the county, sewage-contaminated runoff in the Tijuana River has been entering the Tijuana Estuary. Eric Syverson is a life long resident of Imperial Beach. He keeps a close eye on what's happening in the Tijuana River Valley. "It was dry on Saturday, not dry on Sunday. Monday, we wondered what was going on and now, Tuesday, there was quite a bit of flow this morning and it just smelled horrible and it’s green,” said Syverson. The water was pooling under the bridge on the north side of Dairy Mart Road. "At six a.m. this morning, probably double the volume that’s flowing right now and the air was twice as bad, you couldn’t breath under this bridge this morning," said Syverson. According to a San Diego inspector with the International Boundary and Water Commission, there was transboundary flow Monday night into Tuesday morning from a ruptured potable water line. The IBWC estimates 300,000 gallons of treated and untreated wastewater flowed into the U.S. Initially, the IBWC said the figure was much higher; roughly two million gallons. The number was revised after the inspector determined their gauging station was not accurately recording the flows. Members of Citizens Against Sewage are skeptical. "I’m looking at the gauge data from the river gauge from IBWC's information. We put values on those numbers that they provide, and it’s over seven milllion gallons,” said Lance Rodgers, Co-Founder of Citizens Against Sewage. This is just the latest in a series of sewage spills that have closed South County beaches."There were flows on the second, there were flows on the 30th, the 28th, 24, 23, 20, 19 it’s been a bad month,” said Syverson. Syverson said it's the same problem with no solutions from either side of the border. "I mean, why should we even have to think about it. It's July 9th, we should be at the beach right now, going "God, look at how gorgeous this area is," not standing in a horrible valley wondering how to solve a problem that’s existed for my entire lifetime," said Syverson.
