A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

That victim was transported to an area hospital with minor injuries, according to the Los Angeles Police Department.LAPD says a group of more than 300 protesters were marching near Sunset Boulevard when a blue pick-up truck maneuvered through the crowd and became involved in an altercation shortly after 9 p.m. As the driver of the truck attempted to get away from the situation, police say the vehicle struck a protester standing in the street.Moments later, police say a white Prius attempted to drive around the same protest and also became involved in an altercation with people in the crowd.“A black pick-up truck leading the protests accelerated and pinned that white Prius in, forcing it to come to a stop,” wrote police in a statement. “The driver of the Prius attempted to flee the area and reversed into a green mustang behind it. That vehicle was also participating in the protest.”Police say both the drivers of the truck and Mustang attempted to extract the driver of the Prius from the vehicle, but that driver was able to get away. Several blocks away, that motorist was detained by Hollywood officers, according to police.All the drivers and victims involved in both altercations have been identified by Hollywood officers and an investigation is ongoing.Protests are expected to continue throughout the coming days as people demand justice in the Breonna Taylor case.On Wednesday, the Kentucky grand jury indicted one of the three Louisville police officers who entered Taylor's apartment in March and fatally shot the emergency medical technician. However, the indicted officer isn’t being charged in connection with Taylor’s killing, he’s being charged with wanton endangerment for shots fired into her neighbor’s apartment. After the grand jury's charging decision was announced, the Kentucky attorney general held a press conference, during which he said the officers who shot Taylor were "justified" in their actions because they were responding to a shot fire by Taylor's boyfriend, Kenneth Walker, who has said that he believed the police were intruders. 3027

A man fell about 100 feet into the ocean on the Oregon coast while trying to take a photograph at the scenic spot, according to state police.Sunday afternoon, troopers were called to an area of Oswald West State Park, about 20 miles south of the Oregon-Washington border.Two people had walked down a trail to take a photo at a cliffside viewpoint. The investigation found one of the hikers climbed a tree on the cliff’s edge to pose for a photo. A limb broke, causing the man to fall into the ocean below.Oregon State Police shared an image of a "danger" sign along the trail.The U.S. Coast Guard helped find the man. A high school teacher was placed on administrative leave after handing students a questionnaire that asked them about sexually explicit activities and delinquent behavior, a spokesman for the Weber School District said Monday.The teacher, who was not identified, handed the survey out to 11th-grade students at Roy High School last week. The class provided instruction in human sexuality and the questionnaire was issued without parental consent, district spokesman Lane Findlay said.He said the teacher in question was a veteran within the Weber School District and didn’t believe there was any “malicious” intent with the survey.A copy of the questionnaire has since been removed from the district’s portal. However, it was posted to several websites, including scarymommy.com. The 30-question survey asked students questions from drug use to sexual activity and abortion and originated from a 1967 Ann Landers survey about sex and drugs.Heather Danks-Miller, whose daughter was handed the survey, said she found out about it when her daughter mentioned her result after taking a questionnaire. Her daughter didn’t want Danks-Miller to see how she answered the survey but read some of the questions back to her mother.“She read the questions and as she progressed, they were getting worse and worse,” Danks-Miller said. "The last 10 were really disturbing and invasive."Even worse, she said, the students were being asked to turn the survey in with their names on it."Even if you take it, grade it and hand it right back, what would happen if that paper got into the wrong hands?" she asked. "Some of the questions about the drug use, if you've ever smoked pot? Have you ever tried angel dust? I mean you're asking these people to basically incriminate themselves and turn this paper into you."If it was anonymous, sure — but even still. Maybe, here you go, take the quiz and let's discuss it but you keep the paper. I would be way more comfortable if that happened."The final scores ranked students from “a nerd — just where you should be at your age” to “hopeless and condemned.” Students in the class were asked to put their names down for a grade.“Basically parents consent to have their students be able to discuss and learn about some of those topics. Unfortunately, we had a questionnaire that was given out to students as a part of this course and that questionnaire was outside the approved curriculum,” Findlay said. “We had some parents that came up to us with some concerns about the contents of that questionnaire, so we’ve been looking into it to figure out how that ended up in the classroom and what do we need to do to remedy that situation.”Findlay said two federal acts and state laws prohibit surveys eliciting information about a student’s sexual behaviors, attitudes, sexual orientation or involvement in criminal behavior. He said district policy notes that teachers are expected to use “professional judgment and discretion in providing age-appropriate material.”Danks-Miller said she expected the school would apologize and the survey would be taken out of the curriculum. She said that didn't happen immediately and didn't learn of the teacher's administrative leave until media reports.She questioned if it had been used in the past or if a student wasn't as open with their parents as her daughter was with her, that the questionnaire would still be given to students."How many years has this paper been given out? And how many lives has that affected by telling teenagers they're hopeless and condemned or they're a nerd?" she said.In addition to placing the teacher on administrative leave, Findlay added the district and high school apologized to students and parents for the questionnaire and that it would not be used in the future. It was removed from the school’s portal to ensure it wasn’t distributed in other classrooms.“Given the contents of the survey, it is inappropriate,” he said. “We’ve looked at it — it’s unacceptable that it ended up in the classroom. … We’re taking it very seriously.” 4048
