SAN DIEGO (KGTV) - A Marine Corps. family won a -million lawsuit against Lincoln Military Housing after they say mold sickened their children.The Charvat family moved to San Diego's military housing near the Marine Corps. Recruitment Depot in April 2015. Father and husband Matthew worked at MCRD.The lawsuit lists disturbing symptoms the family dealt with, including "diarrhea, dizziness, drowsiness, irritated eyes, watery eyes, fatigue, stuffy nose, sinus congestion, itchy skin, sneezing, sore and dry throat, chest tightness, runny nose, lethargy."Anna, 9, was brought to tears when she described what she and her family endured, "my breathing was bad, I got sick a lot and my brother," she said choking up.Her mother, Leigh, said she had to take Anna to the emergency room after Anna woke up in the middle of the night gasping for air.When it came to her 6-year-old son Johnathan, "you could hear him breathing downstairs, it was very loud we used to say he sounded like Darth Vader."She said she tried everything from a different diet to going to doctors to try and figure out why her family was sick."I felt everyone thought I was crazy. Doctors, family thought I was crazy," she said in anguish. Then, the family found vents covered in black mold."It was shocking, I was disgusted," Leigh said, but she was also relieved to find an answer."Okay this is it, let’s get rid of it and let’s get on with our lives so we can get back to the way things were," she said.The lawsuit stated the defendant, Lincoln Military Housing, "negligently, improperly, recklessly and in a non-controlled manner, exposing Plaintiffs to excessive moisture, dampness, and humidity, as well as microbial contamination."Leigh said the company tried to "put a band-aide" on the situation and didn't try to find the source of the mold, "we were still sick after all their attempts to clean."The family moved out and had to throw away toys and furniture to keep from contaminating their new home. SAN DIEGO (KGTV) - A missing former Navy SEAL reported missing earlier this month has been found, according to police.San Diego Police said Johnathan Steven Surmont, 45, was located in Los Angeles during the time he was reported missing.RELATED: San Diego Police searching for missing Navy SEAL veteran"A citizen" called SDPD to tell them Surmont was in Los Angeles, at which point the department's Missing Persons Unit confirmed the information."Although Surmont’s current whereabouts are not known to SDPD, he is no longer considered at-risk or a missing person," the department said in a release.Surmont was reported missing after he was last seen in August, telling his wife he was in a "rough place" in Los Angeles, according to a missing person bulletin from the SDPD. According to police, the incident happened around 9:30 a.m. at the Mills Building on Imperial Avenue downtown. The building houses San Diego County government offices. Police say the man threatened an employee on the 5th floor of the building before damaging computer monitors in the office. SAN DIEGO (KGTV) -- A hero’s homecoming 75 years in the making. Wednesday, a World War II Marine killed in action was laid to rest at Miramar National Cemetery. "To all my fellow marines who gave their all the world is free because of you, God rest your soul."Up until now Nancy Lee lived a lifetime of not knowing - not knowing her older brother Staff Sergeant Wesley Kroenung, and not knowing what happened to him at war. "You can only imagine the sacrifice they made that day."Kroenung was a combat cameraman, just 25 years old when he died during the Battle of Tarawa, moments after landing. His remains left on the island, listed as unknown… leaving an irreparable wound for his father and family back home."He was never the same, I never knew him as a happy man. I know every family affected like this feels like this."But decades later Lee held onto hope for answers, submitting a DNA sample to the military. Not long after, the answers came in a phone call. "When I got that call, I'm so thankful and think of every family, the sis happening all over, every family now knowing the truth, and it means a whole lot."And now a proper homecoming for his final resting place. SAN DIEGO (KGTV) - A homeless man was attacked with a skateboard while sleeping in North Park Saturday, San Diego Police said.The man was asleep in the south alley of El Cajon Blvd. at 28th St. when a man hit him repeatedly with a skateboard, said officers.The victim suffered serious head trauma and was taken to the hospital.Police said the attacker is white, about six feet tall, and between 19 and 26 years old.
