LORAIN, Ohio - A family has filed a lawsuit against the Lorain County School District in Lorain, Ohio after their daughter was wrongly accused of bringing drug-laced candy to lunch in September and suspended.Shannon Ciotti and her daughter have filed a suit naming the district, the Lorain City Board of Education, every board member, the district CEO and the Lorain Police Department.Ciotti said her daughter was suspended immediately from Southview Middle School after being accused of bringing tainted candy, before any test was ever conducted on the candy. The director of out of school suspension cited Ciotti’s daughter with a level three violation – possession of marijuana edibles.The lawsuit states a 10-day suspension turned into 21 because the police department took so long to test the candy. The box of Milk Duds was not properly tagged as evidence and sat on a shelf in the police department, “untested and abandoned,” the court filing states. It was only after the crime lab found out from Ciotti that the evidence was improperly tagged that they tested the candy.The family also contacted the Hershey Company, who tested the batch of Milk Duds for illegal substances, the suit states.Hershey came to the same conclusion that Lorain police eventually did: the candy contained no illegal substances.According to the lawsuit, the teen has been harassed and ridiculed since returning to Southview Middle School. Fellow students have called her names like “pothead,” and a teacher allegedly mocked the girl, saying, “I hope you’re not planning on exchanging candy. We’ve been down that road before.”The lawsuit seeks ,000 in compensatory damages and over ,000,000 in punitive damages for negligence, gross negligence and defamation on behalf of the school and police. 1796

LOGAN HEIGHTS, Calif. (KGTV) -- The man involved in the officer-involved shooting in Logan Heights previously faced an attempted murder charge, according to court records. Witness video obtained by 10News shows the suspect, later identified as 30-year-old Enrique Aguilar, walking in the middle of the street. In the video, it appears Aguilar starts walking toward the direction of police. Yells of “drop the gun” could be heard as Aguilar continues walking down the street.As Aguilar proceeds toward officers, police say he pointed a weapon at them. Several shots were fired and Aguilar fell to the ground. He was taken to a nearby hospital with non-life threatening injuries. Police say he was struck at least once and underwent surgery. Records uncovered by Team 10 show Aguilar’s criminal past dates back more than a decade—from vehicle code violations to drug offenses. In 2010, he faced attempted robbery charges. The following year, Aguilar and two others were charged with attempted murder and first-degree robbery. Documents show he was connected to a local gang. Aguilar entered a plea deal and pleaded guilty to robbery, according to documents. He was sentenced to six years in prison.In the court file, we found a letter he wrote in 2012 saying in part:“I am remorseful for my involvement that I took part in and take full responsibility for my own actions. Sometimes circumstances put us in situations that later on we regret. I’m thankful to God that nobody got killed in this matter. My intentions were never, never to hurt anybody… I wish I could take it all back so I could be with my family. I continuously apologize to the victim and my loved ones for the pain I’m putting them thru [sic]; not being able to support my wife as well for my 3 babies.” Aguilar is now in jail facing a slew of charges including three counts of first-degree attempted murder, attempted assault with a firearm, receiving stolen property, participating in a criminal street gang, and a felon in possession of a firearm. Because of his criminal past, he was not supposed to own any weapons. Aguilar is scheduled to appear in court in the next couple of days. The officers involved in the shooting were not hurt. Earlier in the week, Moderna announced its vaccine also was 95 percent effective.Ticketmaster says it has discussed the idea of using a person’s vaccine status as a possible barometer of protection for admittance into events. In an email, the company said, “In short, we are not forcing anyone to do anything. Just exploring the ability to enhance our existing digital ticket capabilities to offer solutions for event organizers that could include testing and vaccine information with 3rd party health providers. Just a tool in the box for those that may want to use.”Here is how Ticketmaster says it might work: People who wanted to attend an event would upload their vaccine status through an app that connects to a third-party health care provider. That company would store the information and keep all other details private, abiding by HIPAA laws, according to Ticketmaster. That provider would then mark that person’s status so they could present their digital ticket along with their vaccine status at the event.Ticketmaster says this would not be mandatory, noting “Ticketmaster does not have the power to set policies around safety/entry requirements, which would include vaccines and/or testing protocols. LOS ANGELES (AP) — A former business manager of Stan Lee was arrested Saturday on elder abuse charges involving the late comic book legend.Keya Morgan was taken into custody in Arizona on an outstanding arrest warrant after being charged by Los Angeles County prosecutors earlier this month.Morgan faces felony charges including theft, embezzlement, forgery or fraud against an elder adult, and false imprisonment of an elder adult. A misdemeanor count also alleges elder abuse.Authorities say Morgan sought to capitalize on the Marvel Comic mastermind's wealth and exert influence over Lee even though he had no authority to act on his behalf.Police say Morgan pocketed more than 2,000 from autograph signing sessions Lee did in May 2018. Authorities say Morgan at one point also took Lee from his Hollywood Hills home to a Beverly Hills condominium "where Morgan had more control over Lee."Lee's daughter said in a request for a restraining order last year that Morgan was manipulating the mentally declining Lee, preventing him from seeing family and friends, and trying to take control of his money and business affairs.Attorney Alex Kessel has said Morgan has never abused or taken advantage of Lee. Kessel said in an email on Saturday that he had been in contact with prosecutors to arrange for Morgan to surrender on Tuesday."It is unfortunate that the DA and police did not honor our commitment to surrender next week and arrested him," Kessel said in an email.Lee died in November at the age of 95.Morgan's bail has been set at 0,000.
