SAN DIEGO (KGTV) - A lawsuit was filed on Monday in San Diego County Superior Court against the County of San Diego, Registrar of Voters and other entities related to the ongoing battle over the future of the Julian volunteer fire department. Attorney and mayoral candidate Cory Briggs filed the suit and told 10News that the claim is that a group of former volunteer fire department board members made the decision to dissolve the department in secret meetings, and the County allegedly let it happen. For the past two years, locals have been in a contentious battle over the future of San Diego County's last all-volunteer fire department. Many residents believe the County should take over the department because it has more resources and money.Opponents don't trust the County and think that the department's volunteers can do a better job on their own. This morning, an independent regulatory agency conducted a final vote in favor of dissolving the department. A hearing on this new lawsuit is scheduled for Wednesday morning. 1041

SAN DIEGO (KGTV) - A pair of protests collided in front of State Sen. Toni Atkins' downtown San Diego office Friday morning, and joined forces to call for help.Members from the Alliance of Californians for Community Empowerment gathered to tell Atkins to support Assembly Bill 1436, which would extend the eviction moratorium until April 1, 2021. They say it's the only way to protect people who haven't been able to pay rent because of the coronavirus pandemic.Meanwhile, a car rally organized by UDW/AFSCME Local 3930 demanded a new tax on California billionaires to help pay for child care and shore up holes in the state's education budget.The groups were unaware of each other's planned protests until they both showed up at Atkins' office at the same time. But they say their combined voices should help get her attention."This tax would help those families who need quality childcare, affordable childcare, so we are supporting the children," said Miren Algorri, a child care provider who supports the tax. "This is not about the rich, this is about the children, the future, not only of this community, but of California, the nation.""We need protection," said Patricia Mendoza, a mother of two who faces eviction if the current moratorium runs out. "Where are we going to go? What's going to happen to me, what's going to happen to my future? I don't want to have to tell my kids we're going to be homeless. And I don't think any mother, or any parent would like to tell their kids we're going to be homeless."Atkins has already written a bill that would allow landlords and tenants to work out a payment plan for back rent, to be paid between 2024 and 2034. SAN DIEGO (KGTV) -- A motorcyclist was killed Monday night, after a crash with a suspected DUI driver in Linda Vista. Police tell 10News the driver of a Nissan ran a red light on Genesee Avenue, slamming into the motorcyclist and dragging them under the car for at least 100 feet. His 8-year-old daughter was in the car when the crash happened. SAN DIEGO (KGTV) -- A new report from the Auto Club ranks San Diego as the top travel destination for Southern Californians this Labor Day weekend.According to the report, Las Vegas, San Francisco, Grand Canyon and Santa Barbara also rank among top travel destinations for Southern Californians. The Auto Club is also warning San Diegans not to drink and drive. According to AAA, 31 people were injured in DUI-related crashes last year over Labor Day weekend.Statewide, eight people were killed in DUI crashes last year. “While alcohol-related crash fatalities have dropped in the last three years over this holiday, injuries have risen,” said Auto Club Traffic Safety Manager Anita Lorz Villagrana.“We want to remind everyone to make a plan before celebrating – use a rideshare service, stay at a hotel or someone’s home, or designate a sober driver. SAN DIEGO (KGTV) - A local college professor says her a electric scooter ride ended painfully after the scooter turned off in the middle of the ride.Jenny Mahoney, a professor of biology and kinesiology at Point Loma Nazarene University, was with three friends on scooters in December, headed to December Nights in Balboa Park. She says her friends were on Bird scooters, while she was on a Lime scooter with plenty of charge. The ride came to an end two minutes along Harbor Drive near the airport."I was in the bike lane and went from full speed to a dead stop," said Mahoney.She says the screen went blank as the scooter shut down. She remembers her body slamming into the handlebars and was then thrown off the scooter."A lot of pain. I wasn't able to breathe. Got the wind knocked out of me," said Mahoney.Mahoney says one of her friends crashed into her. He got up and carried her out of the bike lane. She suffered a broken bone in her hand, and a sprained wrist and ankle."You assume when you're on these scooters and following all the safety rules rules, you're going to get to your destination safely, but that didn't happen," said Mahoney.The question now: Has it happened before? Mahoney filed a claim with Lime before hiring attorney Evan Walker. Walker tells 10News he just got another call from a Seattle tourist whose wife remains hospitalized in San Diego from a similar incident with a Lime scooter."My understanding is that there have been numerous complaints of a similar nature made about these devices and that Lime is well aware of these complaints," said Walker.In late February, Lime issued a warning to riders of a technical bug that caused sudden excessive braking, usually downhill. Lime says in those cases, the scooter didn't shut off. While Mahoney doesn't know if those cases are related, she doesn't believe her incident is the only one. "I want them to take responsibilities for these injuries that are occurring ... and I want people to be aware, it's not as safe as they think it is," said Mahoney.A Lime spokesperson declined to talk about Mahoney's incident but issued the following statement: “Our entire global fleet has now been fully updated with the final firmware fix that appears to have eliminated occurrences of excessive braking, and we continue to closely monitor the issue to ensure it is categorically resolved.” 2375
