SAN DIEGO (KGTV) -- Local gym owners are faced with another difficult decision as San Diego County moves into the purple tier, the most restrictive of the state’s classifications of COVID-19 spread.Under the new regulations, gyms may not operate indoors, meaning those who cannot operate outdoors will be mandated to close.The restrictions take effect Saturday.RELATED: County moves into California's COVID-19 purple tier“You want your members happy. You want your staff happy. You’ve got to put food on your table. And you’re trying to do the right thing, you’re wearing a mask and you’re indoors, so it’s going to be just an unbelievable, worrisome time,” said Bryan Welch, general manager of the Point Loma Sports Club.Welch said the new restrictions will not have a significant impact on his gym because the Point Loma Sports Club had already moved 90% of its operations outside. But he said he empathizes with gyms that do not have usable outdoor space or a cooperative landlord.Even some gym owners that can move outside may not choose to do so. They say limits would force them to operate at an untenable loss, leaving them to choose between operating indoors in violation of public health orders or going out of business. SAN DIEGO (KGTV) - Inside an MCAS Miramar courtroom Thursday, the military held a preliminary hearing for a Navy corpsman who's charged in connection with the death of a fellow Navy corpsman, HM3 Michael Vincent De Leon. A corpsman is a type of medic.ABC 10News' cameras were not allowed inside, where accused corpsman HM1 Ryan Dini appeared in his military fatigues alongside his private counsel."A cover-up is what I felt [happened] from the get-go," Jose De Leon told ABC 10News just after the hearing. He has suspected a possible cover-up since his 30-year-old son died on the Twentynine Palms military base last year.At Thursday's hearing, the prosecution argued that HM1 Dini should face additional charges related to negligence. He's already charged in part with dereliction of duty resulting in death and drunk and disorderly conduct. HM1 Dini has 19 years of service with the military.The prosecution stated that HM1 Dini and a handful of others service members including Michael were at a house party on-base where alcohol was flowing, and guns were being dry-fired the night of the death.HM1 Dini's defense denied any wrongdoing."[HM1 Dini] being the most senior individual at this going-away party failed to protect not just Michael but everyone there because they were in danger when these firearms came out," said Jose De Leon. He told us in September, "We know that the firearm was dry-fired at Michael. The firearm was put away and it came out again and according to some statements they were horsing around, and the firearm came out again and that's when Michael was killed."He said that the shooting was first called in as a suicide but ABC 10News then learned from a source with close military ties that the death was being investigated as a homicide.A prosecutor named three other service members in the hearing. Their involvement remains unknown.The prosecution told ABC 10News that in about three weeks a judge will determine whether HM1 Dini's charges will be sustained and whether he'll face additional charges.Naval Criminal Investigative Service wrote to ABC 10News on Thursday that the investigation is still open. 2149

SAN DIEGO (KGTV) — In October, members of ICE, CBP and USBP held a meeting with several organizations in San Diego, telling them the Department of Homeland Security would be ending a policy known as “safe release.”That’s according to a lawsuit filed Wednesday by the County of San Diego against Kirstjen Nelson, secretary of the Department of Homeland Security.The policy of safe release had been in place since at least 2009. Under it, ICE would work with asylum seekers who had made it legally across the border to connect with family or sponsors in the United States. ICE officials would coordinate transportation as well, making sure the migrants made it to their final destinations.At the meeting in October, federal authorities notified Jewish Family Service and the San Diego Rapid Response Network that ICE would no longer be providing that service.“When that policy ended we quickly began to notice there were moms and children being dropped off at the bus stations here in San Diego,” said Michael Hopkins, CEO of Jewish Family Service. “We realized pretty quickly that we needed to create some type of shelter so that we didn’t have families sleeping on our sidewalks and adding to our homelessness problem in San Diego.”Since October, Hopkins estimates they’ve helped nearly 12,000 migrants in San Diego.On average, they take in 50 to 100 people per day, but it can fluctuate.“Last week we had nights when it was over 200,” said Hopkins.The shelter has moved around several times, but in March, the County announced it would allow the Rapid Response Network to operate the shelter out of the former family courthouse in Downtown San Diego.The operation has cost about .3 million, according to the County.It’s come from a mix of donations and money given to the county by the state.In a statement from DHS, officials told 10News, “until Congress acts to address the obvious drivers of the crisis and gives the Department the proper resources, we will continue to refine and adapt our processes to address our many priority missions to the best of our abilities.” 2083
