SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free.The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. SAN DIEGO (CNS) - Two San Diego City Council members called Wednesday on California Attorney General Xavier Becerra and District Attorney Summer Stephan to investigate San Diego City Attorney Mara Elliott's possible role in an alleged child sexual abuse cover-up at the San Diego Junior Theatre.Council members Scott Sherman and Vivian Moreno sent a jointly written letter to Becerra and Stephan imploring them to investigate allegations made by attorney Matt Valenti that Elliott improperly shared information on the case with then-Junior Theatre Board member Gil Cabrera, who Valenti claims tried to silence the case's whistleblowers."We are writing to respectfully request your respective offices' review and consideration for appropriate action, as the authority to investigate these complaints falls under the jurisdiction of your departments," their letter states. SAN DIEGO (KGTV) – A catholic priest overseeing a mission in San Diego has been granted temporary relief from the state's COVID-19 restrictions on in-person worship.On Friday, ABC 10News spoke to the attorney representing Father Trevor Burfitt in his legal fight to reopen his Southern California parishes, including St. John Bosco Mission inside the Four Points Sheraton hotel off the 163 and Aero Drive.On Thursday, a Kern County judge issued a preliminary injunction protecting Father Burfitt's churches from COVID-19 restrictions but the ruling does not apply to all churches in the state.“Under the existing blueprint for a safer economy, all of [his] churches are subject or were subject to a total worship ban until the court's ruling yesterday,” said attorney Christopher Ferrara. He added, “That ruling has overturned those restrictions and the churches are now free to operate.”On Friday, San Diego County Supervisor Jim Desmond said that he supported the ruling and added in part, “I think and I always have thought that churches are essential, particularly in these times of high anxiety with having to deal with COVID.”The new ruling stems from a recent lawsuit that Father Burfitt filed against Governor Gavin Newsom and other state and local officials over lockdown measures.The judge ruled in part, "The restrictions at issue here, by effectively barring many from attending religious services, strike at the very heart of the first amendment's guarantee of religious liberty. Before allowing this to occur, we have a duty to conduct a serious examination of the need for such a drastic measure." The ruling goes on to read in part, "The free exercise of religion clause in the California constitution prohibits defendants from treating religious activities worse than comparable secular activities. SAN DIEGO (KGTV) -- A father is speaking out after being stuck on a SeaWorld ride for several hours in the cold Monday night. In video from the incident, 15-year-old Jordan Sherr can be heard shivering in the cold as temperatures plummeted into the low 40s. Jordan and his dad Jonathan were in a gondola on the Bayside Skyride when, two minutes into the ride, a huge gust of wind blew into the bay. “40-50 miles per-hour, blowing us around, looked up and saw the cables going spastic. Wondering what was going when it snapped shut, shaking us at a 45-degree angle back and forth,” said Jonathan Sherr. We said a few prayer, told each other we loved each other, then we decided to come up with a game plan, assessed height of water and decided it was a no go,” Sherr said. Their fears weren’t realized and, eventually, the gondola stabilized and they began to record cellphone video. “We're like a hundred feet up, over shallow water yea,” Sherr said. Over the next five hours, Sherr says they heard messages from staff at SeaWorld over a loudspeaker before firefighters came to the rescue.
