SAN DIEGO (CNS) - The California Supreme Court ruled this week that a San Diego court must re-examine its decision to allow a criminal defendant to subpoena Facebook to obtain private social media posts and messages he alleged would help him in his defense.The ruling issued Thursday laid out a series of factors for the trial court to consider when weighing whether to allow the defendant to gain access to his alleged victim's restricted posts and private messages.The ruling stems from the criminal case of Lance Touchstone, a Northern California man charged with attempted murder for allegedly shooting his sister's boyfriend in Ocean Beach in 2016.Touchstone sought to obtain information from the victim's Facebook posts that the defendant alleged would show his accuser was a violent person, bolstering a self-defense claim.A San Diego Superior Court judge ruled in Touchstone's favor and ordered Facebook to release the information, leading to subsequent appeals.In an opinion authored by Chief Justice Tani G. Cantil-Sakauye, she wrote that the trial court should consider a list of seven factors to consider when deciding whether good cause has been shown to grant the subpoena.These "Alhambra factors" include whether the defendant has shown a "plausible justification" for acquiring the information and whether acquiring the material violates a third party's confidentiality or privacy rights, among others.While the state Supreme Court declined to make its own determination on the subpoena's viability, it ruled for the trial court to re-examine the subpoena issue in light of these factors.Touchstone's attempted murder trial in San Diego remains pending for a date still to be determined, as courts remain closed to the public and jury trials have been delayed indefinitely due to the COVID-19 pandemic. 1826

SAN DIEGO (CNS) - The North County Transit District will temporarily reduce service for its Coaster commuter trains starting Monday until further notice amid a drop in ridership tied to the coronavirus outbreak.Weekday train service will be reduced by about 50%, particularly around the noon hour, when several northbound and southbound trains will be suspended. Likewise, just one evening train in either direction will continue to run, at 5:41 p.m. southbound and 7:13 p.m. northbound.Breeze bus service will continue as scheduled with the exception of school bus trips, which have been halted while schools are closed.RELATED: What's open during California's coronavirus 'stay at home' orderMorning commuters will have more options, but not many. Southbound commuters will have to be on the 7:40 a.m. train or wait until 2:42 p.m. Northbound commuters can leave as late as 9:18 a.m.Weekend Coaster service will be suspended entirely beginning March 28.In addition to the Coaster trips which will remain active, riders with a valid Coaster Regional day or monthly pass will still be able to ride the Amtrak Pacific Surfliner. Accordingly, non-essential businesses and schools have been closed, and employers have been encouraged to allow employees to work from or remain at home," said Matthew Tucker, NCTD executive director."NCTD understands the importance of having vital transportation like our buses and trains remain in service during this time of uncertainty for many San Diegans. SAN DIEGO (CNS) - The Port of San Diego's Board of Port Commissioners announced its approval Thursday of a 15-year extension for the San Diego Symphony Association's lease at Embarcadero Marina Park South. The lease, approved Wednesday, includes three 10-year options and one five-year option, allowing the association to lease the park for up to 50 years. The association currently uses the park land for its Bayside Summer Nights concert series, which it started in 2004. The concert series is held on a temporary stage that is assembled and disassembled each year. Later this year, the association hopes to break ground on the Bayside Performance Park project that would include construction of an open-air performance venue with seating for 10,000 as well as various improvements to park features like benches and basketball courts. The new venue also would serve as the permanent location for Bayside Summer Nights. ``The San Diego Symphony is investing a minimum of million in improvements, including many public amenities and better performance facilities, creating a new, year-round attraction on the San Diego Bay waterfront,'' Board Chairman Garry Bonelli said. ``We're confident concert-goers will love the improved access and state-of-the art stage and sound system, and bayfront visitors will love the new and improved part.'' The stage will be designed by London-based company Soundforms, according to the association. The stage will be feature an acoustically engineered shell made of tensile white fabric and will complement the look of the nearby San Diego Convention Center. The venue will remain open to the public year-round as part of Marina Park South. ``I want to recognize the incredible partnership that has existed over the past four-and-a-half years between the Port of San Diego, the California Coastal Commission and the San Diego Symphony Orchestra,'' San Diego Symphony CEO Martha Gilmer said. ``The work we have accomplished together to create and activate a public performance park will be transformative and have lasting impact to San Diego residents and visitors.'' The lease extension is the last major step in the project's approval process, according to symphony officials. With the extension complete, ground-breaking on the project may happen by September. 2308
