SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. The two companies have more than 400,000 drivers in California alone. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business. Now, posts with the tag #IAmVanessaGuillen are circulating online, as people share their own stories of sexual assault in the military.Billiekai Boughton with the San Diego Women Veterans Network said any conversation like this can bring up hard memories for female veterans. She said while many women have a positive experience in the military, four out of five females report harassment or assault. The goal of her group is to support women through any of this pain. She says this is important in a community like San Diego which has about 26,000 female veterans.“For those of us who have been in the military and have had negative experiences, this can be a memory (sic) of feeling unsafe,” said Boughton.The group’s website says the most common request of women veterans in San Diego is to meet other women veterans. Their primary goal is to create a community for female military veterans, while also encouraging community service and policy change, which encourages and embraces the positive traits female vets have to offer.“Our friends remind us how strong we are. Whether for convenience or for price, third-party repair shops are the choice for many customers. Unfortunately, some Apple users with the latest phones say they're not able to go to third-party shops. Four years ago, Christopher McQueen said he found the perfect niche business. “People are always breaking their phones, late at night,” McQueen said.He is the owner of Mobile Cell Doctors. Any brand, any phone, any version. He will come to you and fix your phone.“To be able to fix your phone in 10 minutes, versus a 3-hour fiasco at Apple, it was a need that was definitely there,” McQueen said. He said he can fix any hardware problems, except on the most recent iPhone models - iPhone 8, 8 Plus and X.Just recently, iPhone 8 user Lucas Peckham went to McQueen to get his broken screen replaced. His choices were 0 with McQueen or 9 at the Apple Store. He chose the cheaper, more convenient option.Peckham said everything was flawless until one morning, he woke up to a phone with a frozen screen. He could not swipe, touch, type, or do anything with his device. Peckham said it happened after his phone automatically updated overnight, installing the Apple 11.3 Software.McQueen said he was suddenly inundated with calls from all of his previous iPhone 8 customers. “It’s been a nightmare,” McQueen said. He said he had fixed about 100 iPhone 8’s in the last six months. He suggested to his customers, to do what they hoped to avoid by going to him in the first place - go to the Apple Store. But Peckham said, when he showed Apple the problem, he was told, because he previously used a third-party repairman, they could not repair it. Instead, he had to replace it with a brand new screen for 0 - or buy a whole new phone. “I totally felt screwed,” Peckham said. With no other option, Peckham said he gave in, spending six hours at the Apple Store, and paying up the 0. “It was basically a way for Apple to create kind of a monopoly on the iPhone screen,” Peckham said. Last month, California became the 18th state to introduce a “Right to Repair” Bill, which would require electronics manufacturers to make repair information and parts available to owners and third-party repair shops.McQueen hopes this legislation passes, so mom-and-pop business owners like him also get to have a piece of the pie. “I would love to fix those,” McQueen said. “But until they release the software to run the phones that would allow third-parties to work on those devices, we can’t fix them.”10News spoke to Apple, who said they do work with Authorized third-party dealers that are not Apple Stores. SAN DIEGO (KGTV)- Neighbors are shaken up after a home invasion in University City. “I wouldn’t have expected it because I feel like this area UTC especially is pretty safe,” says neighbor Alana Schnoor. San Diego police got the call early Monday morning, around 1 a.m, from the home in the 5300 block of Toscana Way.Two men wearing masks went inside of an unlocked apartment. One of them pointed a gun at the people inside, while the other grabbed phones and laptops. Police say one of the victims grabbed the gun and fought the robber. The intruder hit the man with the weapon, and both robbers ran out. “It’s a safe area. I just wouldn’t have expected someone with a gun going into an apartment like that,” said neighbor Amy Kaido. Police say the intruders were wearing green jackets with black stripes and black pants. Both men were in their 20’s. 860

San Diego County welcomed its first baby of 2019 at 12:04 a.m. Ainhara Abegail Banos was born at Scripps Mercy Hospital in Chula Vista at 7 pounds and 14 ounces. The bundle of joy is 20 inches tall. Her mother, Elizabeth Morales, said Ainhara's three older sisters can't wait to meet her. "They're waiting for her!" Morales said. She joked that her other daughters, however, "wanted a boy."Morales thought she would have a quiet New Year's Eve because the baby wasn't due until the middle of January. While at home, Morales' water broke and her sister brought her to the hospital. Even though Morales has three other children, she said she was still nervous. Even for seasoned veterans of the hospital, the first baby of the year is always exciting."I've been doing this for over 30 years. I still get goosebumps every time a baby is born," said Elizabeth Retts, Director of Maternal Health.Morales and the baby will be discharged tomorrow. 949
