SAN DIEGO (KGTV and CNS) -- Opening statements will likely begin Thursday morning in the retrial of Kellen Winslow II, who is charged with raping a woman in Encinitas and an unconscious teen in Scripps Ranch in 2003. Winslow was previously convicted of raping a homeless woman and exposing himself to two others. After a week of deliberations, the Vista jury found Winslow guilty of raping a woman in Encinitas and exposing himself to two others, but deadlocked on eight other charges. Those charges included rape and kidnapping in connection with two other women. SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102

SAN DIEGO (KGTV) - A Chula Vista woman is keeping vigil after her parents holiday vacation turned into nightmare, when both become sick with COVID-19.Jose and Gloria Arellano had a dilemma. Their daughter Joselyn says they had airfare credits from a postponed trip to southern Mexico but the deadline to use the credits was about the run out."They had their trip postpone the trip two or three times. They didn't want to lose the money, so they decided to go this time.On November 11, they flew out from Tijuana to Oaxaca for a two-week vacation. Apprehensive about rising COVID-19 rates, they went prepared with goggles and masks. Gloria also had a face shield. Once there, they did a little sightseeing. When they were near anybody, they wore masks."Their main thing is to try food. They were mostly at restaurants. They were also at the beach a lot," said Joselyn.About six days into their trip, Jose, 56, became sick."For him, it was coughing. He has asthma, and it just got into his lungs," said Joselyn.A few days later, Gloria, 54, also became ill. They went to a local hospital, received COVID-19 tests, and tested positive. Jose got sicker and the family contracted at air ambulance to fly him back to San Diego two days before Thanksgiving.Jose, a former investigator with the San Diego County District Attorney's Office and former Navy, is being treated at the VA Medical Center in La Jolla."He's been stabile, on a ventilator and taking antibiotics," said Joselyn.Joselyn calls her father's situation a helpless waiting game. Her mother ended up in a hospital in Oaxaca, intubated for several days, before being released Monday. Right now, she's quarantining at an Airbnb in Oaxaca."It's a vacation, for them, they’ll regret forever," said Joselyn.Joselyn is trying to stay optimistic with so much uncertainty about her father. She is certain about one thing. There will be no vacations in her family's near future."It's not worth it. It's not worth the risk," said Joselyn.Joselyn's brother flew to Oaxaca to help their mother. SAN DIEGO (KGTV) - A body washed ashore in Ocean Beach early Monday morning a few hours after a man was seen diving off the Ocean Beach Pier.At about 1 a.m., someone called 911 to report seeing a man jumping off the OB Pier into the ocean. A witness said the man was seen on his back being pulled out to sea.When authorities arrived, they found the man's belongings on the pier but could not locate him in the water. Lifeguards and Coast Guard personnel launched a search, but the man was nowhere to be found.Shortly after 4 a.m., authorities responded to the discovery of a body on the beach nearby. Authorities said it was too soon to determine if the body is that of the man who dove off the pier. 708
