SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. SAN DIEGO (KGTV) - A pet parrot gave its owner quite the scare after flying up into a tall tree in La Jolla.The owner, Katie Anthony, said she camped under the tree all night worried about her African Grey parrot named "Sidekick." Anthony said the bird is domesticated and not used to being in the wild.Anthony called the San Diego Fire Department and crews came out to investigate. SDFD Capt. Margot Johnson - who was retiring Wednesday - climbed up to retrieve the bird, but it took a couple tries to get it down. At one point, another firefighter fought off a falcon in the process."We really appreciate it and very very thankful because we didn't think we were ever going to see him again," Anthony said.Sidekick is now safe and sound. SAN DIEGO (KGTV) -- A man who groped and sexually assaulted four female students as they walked to their off-campus housing near SDSU pleaded guilty Monday.Minda Shewangizaw, 20, pleaded guilty to charges including felony and misdemeanor counts of false imprisonment and sexual battery.All four victims in the case, who ranged in age from 17 to 19, testified during the preliminary hearing.One of the victims said she and her roommate were walking home after midnight when Shewangizaw came up behind her and “grabbed her butt.RELATED: Women testify against UC Riverside student accused of groping near San Diego State”Her roommate said she noticed someone walking behind them before he began to chase them. "I said, You need to leave. He grabbed my hand and pulled me toward him. He pulled my shirt down and grabbed my breast."She said she kicked Shewangizaw and was able to break free.Another victim testified that she and another woman were on a pedestrian bridge heading back to their dorm when she heard footsteps and was smacked on her “behind” by Schewangizaw."I was livid. I said, What are you doing? Don't do that! He laughed it off."She said she kept walking when the defendant made a remark about her breasts before pulling her shirt down and putting his hands on her chest.A witness said Shewangizaw then grabbed her breast and buttocks and trapped her against a rail before laughing and walking away.The sentencing is scheduled for June 12. 1460
