CNS note: EEOC identified store as located in La Mesa, but store is actually in San Carlos neighborhood of San Diego.SAN DIEGO (CNS) - Albertsons has agreed to pay 0,000 to settle a discrimination lawsuit alleging the manager of an Albertsons supermarket in the San Carlos neighborhood harassed employees for speaking Spanish on the job, the U.S. Equal Employment Opportunity Commission announced Tuesday.The EEOC's lawsuit alleged a store manager was allowed to harass employees at the Lake Murray Boulevard Albertsons in violation of Title VII of the Civil Rights Act, which prohibits discrimination based on national origin.According to the complaint filed in San Diego federal court, employees were not allowed to speak Spanish even while on breaks, or when conversing with Spanish-speaking customers.In addition to the monetary damages, which the EEOC said will go to "a class of affected employees," Albertsons has agreed to review and possibly revise its discrimination policies and procedures and provide training to employees and managers, with an emphasis on language discrimination.Alberstons will also be required to submit reports to the EEOC and keep records demonstrating compliance with a consent decree settling the suit."The EEOC commends Albertsons for agreeing to meaningful and comprehensive measures to correct this situation," said Anna Park, regional attorney for the EEOC's Los Angeles District, whose jurisdiction includes San Diego County."It is important for employers to train employees and make clear that their use of language in the workplace should not impact one group over another."Christopher Green, director of the EEOC's San Diego office, said, "Given the nature of an increasingly diverse workforce, employers should be mindful that the imposition of restrictive language policies may not comply with federal law." 1864
CLEVELAND — President Donald Trump has weighed in on the report that Cleveland's Major League Baseball club will soon drop its controversial team name "Indians" calling it the latest example of “cancel culture.”On Sunday, The New York Times reported the team is planning to drop the nickname it has used for more than a century and will become the latest franchise to abandon Native American imagery.Manager Terry Francona said in July that he believed the time had come for the team to change its name after more than 100 years.“I think it’s time to move forward,” Francona said. “It’s a very difficult subject. CLINTON, Mo. — A Clinton police officer died and two other officers were hurt in a shooting at a home in the small Missouri town late Tuesday evening.Ofc. Christopher Ryan Morton died in the shooting, according to the Missouri State Highway Patrol. The 30-year-old had been with the department, then returned to the force after a shooting?last year killed Clinton police officer?Gary Michael.In a news conference early Wednesday morning, Highway Patrol Sgt. Bill Lowe said officers responded to a 911 call at 9:20 p.m. local time in which a woman was screaming in the background. When police arrived at the home, Sgt. Lowe said a man fired at the responding officers from inside the residence.The officers then returned fire and went inside the home. When they went inside, the suspect shot and killed one officer and hurt two others.The officers got out of the home and crews took them to the hospital.The suspect then barricaded himself inside.Around 12:10 am, the Highway Patrol SWAT team went into the home and found the suspect dead. It is not yet known if the suspect died as a result of the gun battle with police or if it was self-inflicted.The injured officers were receiving treatment at hospitals in the Kansas City area, and according to Sgt. Lowe, their injuries are not life-threatening."The Clinton Police Department is a well respected police department," said Sgt. Lowe. "They will forge on, but they will need help along the way. We are all saddened by this tragic event. It's one of those things that we realize can happen, but when it does happen, it definitely hits home."Cassie Toliver, who lives near where the shooting took place, said police vehicles, sirens and lights quickly filled the streets and law enforcement barricaded the area from both sides. In a phone interview with Scripps station KSHB in Kansas City just after 11 p.m. Tuesday night, Toliver said she could hear gun shots around 10:50 p.m. Tuesday."We can still hear shots being fired," said Toliver. "We don’t whether that’s the shooter or the cops because it’s so dark outside.”The two women who called 911 were not injured, Sgt. Lowe said. "We will be speaking with them right away."Sgt. Lowe said Morton had been with the department for a while."It's hard to put into words what you go through when you have an officer killed in the line of duty," said Sgt. Lowe.Tuesday night's shooting happened exactly seven months after Clinton police officer Gary Michael was shot and killed in the line of duty. "It's just another tragic event for this community and this police department," Sgt. Lowe said. "They've endured a lot and they are going to endure more. Everyone's thoughts and prayers would be appreciated."Sgt. Lowe said the officer who was shot and killed Tuesday night came back to the department after Ofc. College campuses across the country have largely sat empty for months, but as schools consider whether to bring students back, they're also considering their legal obligations.“They are a business that needs revenue to function,” explained Chris Feudo, an attorney with Foley Hoag in Boston, Massachusetts.As an attorney, Feudo has been advising folks about COVID-19 waivers, which gained national notoriety leading up to President Donald Trump’s rally in Tulsa last month. Businesses have also been turning to these forms in hopes of freeing themselves from legal responsibility if someone catches the virus.The next round of waivers could be coming from colleges and universities, and many have already mandated student-athletes to start signing the forms in order to start practicing. Students returning to empty campuses could be next.“It sends a really dangerous message,” Feudo said. “If you’re saying to your employees, faculty, students, it’s sending a message that the college or university is bringing people back when there’s still a substantial risk.”A COVID-19 waiver could mean a family loses any right to seek compensation if a student gets sick at school.But Feudo is skeptical any of these waivers will hold up in court.“You’re not going to find out whether it’s enforceable until somebody gets sick and sues,” he said. 1344
Coca-Cola said Friday that it would offer buyouts to 4,000 employees as part of corporate restructuring and said that layoffs could be coming in the future.According to a press release, the buyouts will be offered to employees in the U.S., Canada and Puerto Rico with a hire date "on or before" Sept. 1, 2017. The company said the "voluntary program" would reduce the number of layoffs.According to Coca-Cola's statement, the company's current operating model consists of "17 business units" that will be consolidated into "nine operating units."Following the announcement, Coca-Cola's stock price rose nearly a point in early trading, an increase of just under 2%.According to WSB-TV, Coca-Cola has more than 86,000 employees nationwide.
