In 2018, Kazakhstan native Satbay Kydyrali, 31, made his way to a local border crossing "He crossed border, turned himself in and asked for asylum," said Almas Irgebayev, Kydyrali's brother.Irgebayev says the asylum claim was denied and is now under appeal, a decision that could be years away. Meanwhile his brother continues to being held at Otay Mesa Detention Center. "Last three days, I was just crying when I think about him," said Irgebayev.Irgebayev says his brother is coughing, and in a cell with 7 other men. They are less than two feet apart, and most of the other men are also coughing. His brother told him none of the staff is wearing masks, and the detainees clean their own cell twice a day. The two brothers talk on the phone every day."He says that he wants to get out. I was crying on the phone. I heard him crying as well," said Irgebayev.Irgebayev is fearful because his brother is at-risk. He contracted tuberculosis as a child and has developed chronic breathing issues."I'm in a panic. I am feeling very bad, because I'm helpless," said Irgebayev. Similar sentiments were on display at a socially distant, vehicle protest near the federal courthouse downtown. Immigrant advocates were asking for at-risk detainees to be released. On the same day, members of the Congressional Hispanic Caucus called on Homeland Security officials to release low-priority detainees.In a statement, a DHS spokesperson says they're following CDC guidelines for disease monitoring and management protocols.' Irgabayev believes that statement doesn't reflect reality."I'm just afraid he is going to die in there," said Irgebayev.Irgabayev says his brother is in day three of a hunger strike protesting the conditions. The number of detainees on the hunger strike has shrunk from 90 to eight since the first day.An employee at the Otay Mesa Detention Center has tested positive, the first employee so far, according to prison company CivicCore. He owns Social Tap San Diego, located next to the ballpark. Due to public health orders, the capacity at their restaurant was significantly reduced. However, they were able to fill the tables and chairs set up in their outdoor areas, and by the start of the game, they had a healthy waitlist.Crenshaw says despite the pandemic, Opening Day still brought more people out than usual."This is baseball. We're Americans. They go hand in hand," he said. It's definitely special and were playing the hand we're dealt."Meanwhile, there were many fans spotted decked out in game-day gear trying to catch a glimpse of the game from their balconies near the ballpark. Some fans waved Padres flags from the balcony to show support.Chip Messenger kept opening day tradition going by watching from his balcony. SAN DIEGO (KGTV) - Members of Congress are responding to a Team 10 investigation that uncovered allegations the government is not providing adequate medical care to some U.S. citizens in its custody.Two recently filed lawsuits allege that dozens of individuals’ medical needs were deliberately ignored by Department of Homeland Security (DHS) agents, and Americans were forced to undergo life-threatening and torturous detox in temporary holding cells at the border.In a statement to 10News U.S. Congressman Bennie Thompson, Chairman of the Committee on Homeland Security wrote, “The allegations made in these lawsuits are extremely troubling. Anyone in CBP custody who is in medical distress should receive urgent medical care if they require it. Across the board, it’s clear that CBP has work to do to ensure safe and humane conditions for all detainees.”San Diego area Congressman Scott Peters also responded saying, “Everyone in federal custody deserves access to basic care. Ignoring a detainee’s pleas for help runs counter to CBP’s own national policies, which say detainees are entitled to medical care if they report an illness or appear to need help. Officers at the border may be overwhelmed, but if CBP is going to detain people, they have a duty to provide proper medical care to the people in their custody.”10News also heard from ACLU of San Diego & Imperial Counties. SAN DIEGO (KGTV) - Lime is warning riders of a problem with their deckles scooters that can cause “sudden excessive braking during use.”The company issued a safety update on Saturday, saying they had recently discovered a bug in the firmware of their scooters.They determined in some circumstances, the brake on the front wheel would be suddenly and automatically applied often after hitting an obstacle while riding downhill at high speeds.“While this issue has affected less than 0.0045% of all Lime rides, some riders have been injured,” wrote Lime in the safety update.That includes Paul Grasso, who says he was riding a Lime scooter on December 18 on Ingraham Street near Vacation Road in Mission Bay.He said he had just gone down the bridge and was making his way up a sidewalk ramp when the scooter’s wheels tightened up, sending him flying face-first into the pavement.“I spent five days in the hospital,” he said with a “broken nose, fractured skull, traumatic brain injury, fractured eye socket, ten stitches in my forehead and stitches on my nose.”10News reached out to Lime about Grasso’s crash but they said they couldn’t comment on rider specific questions.Lime has launched a fleet-wide firmware update to fix the braking bug. It should reach all of their scooters in the next few days, according to the company’s safety update.Until they have confirmed that all of their scooters have been updated, they have issued a list of precautions for riders:Before starting your Lime trip, walk around the scooter and do a visual inspection of the hardware. Is the vehicle body in good condition? If not, don’t use that vehicle; report it to our customer service team and then select another vehicle.Once you start your Lime trip, give the brake a tight squeeze. If the brake does not engage properly and immediately stop the vehicle, dismount, end the trip and notify Lime customer service.Use extra caution in the next few days while we issue the final firmware update -- especially when riding downhill.
