SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. SAN FRANCISCO (AP) — Federal wildlife officials were urged Wednesday to withdraw a proposal to drop 1.5 tons of rat poison on remote islands off the coast of California to kill a mice infestation until it addresses questions on the impact to wildlife.The California Coastal Commission heard public comment on the U.S. Fish and Wildlife Service plan, which has drawn criticism from local conservation groups. The commission is seeking to determine whether the plan complies with state coastal management rules.The U.S. Fish and Wildlife Service said in a report presented to the commission in March that a massive house mice population is threatening the whole ecosystem on the rugged Farallon Islands, 27 miles (44 kilometers) off the coast of San Francisco.The archipelago is home to the largest seabird breeding colony in the contiguous United States, with approximately 300,000 to 350,000 birds of 13 species, including the rare ashy storm petrels. The islands are also used by marine mammal species for resting and breeding and by migratory birds.Federal wildlife officials proposed using helicopters to dump 2,900 pounds (1,315 kilograms) of cereal grain pellets laced with brodifacoum, an anticoagulant that causes rodents to bleed to death, which is banned in California.Officials acknowledged the plan will kill some seagulls and other species but argue that the benefits of eliminating the invasive species will heal the whole ecosystem."The only way to protect these species and allow the ecosystem to recover is 100% eradication of the mice," said Pete Warzibok, a biologist who has worked on the Farallon Islands for more than 20 years. "Anything else is simply a stopgap measure that will not adequately address the problem."Critics argued the poison will not only kill the mice, first introduced by ships that stopped in the islands 200 years ago, but also wildlife on the island and scavengers that would feed on the carcasses of the poisoned animals."These poisons are deadly, they persist in the environment for hundreds of days and they do kill animals," said Alison Hermance, the spokeswoman for the conservation group WildCare."The situation on the Farallon Islands has existed for decades. It does not need to be solved overnight with a massive poison drop," she said.The commission has no power to veto the plan but before federal officials can proceed, their plan needs approval from the various state and federal agencies.After a nearly two-hour hearing, commissioners said they still have questions on the impact to seabirds and other species. "We haven't been convinced that this is the best and only way to go," Commission Chair Dayna Bochco said.The commissioners asked federal officials to withdraw the proposal and resubmit it after their questions have been answered.The project would be implemented in the November-December time period when the mouse population is declining and food stressed, and would occur no sooner than late 2020. 2975

The players are not surprised at all their success the last two years, as they say head coach Mitch Charlens has them believing in themselves and very confident.San Diego City College is a rags to riches story. When coach Charlens took over the program 14 years ago, they did not have many players, no uniforms, and not a real gym to practice in.If they can win another California state JUCO title, they would become the first team to go back to back in over 60 years. 685

San Diego (KGTV) One plate at a time, a San Diego couple is hoping to help those living on the streets with no food to eat. They’re using their new food trailer to do just that. ‘#FeedingEveryone’ is the goal for the Duwara Consciousness Foundation. “Our foundation is about serving anyone and everyone,” says co-founder Harisimran Khalsa. Through donations from the community, couple Davinder and Harisimran were able to purchase a food trailer to help feed the homeless. The couple says they’re committed to helping others. They left their jobs, sold businesses, and are now living a simpler lifestyle. “When your passionate about something, you have to live the life of and see how it is,” says Davinder Singh. “We decided that we would give up the house that we were living in.”The 16-foot trailer is equipped with a griller, 2 part stove, refrigeration and prep space. Every food item made is plant-based. Donations and volunteers strictly power the organization. They are serving at least two locations every week. They hope to grow the non-profit and eventually purchase a shower bus for the homeless.  The organization has partnered with the Jewish Family Service to feed the homeless on Thursdays and Fill-A-Belly to serve those in need on Tuesdays. SAN DIEGO, Calif. (KGTV) - The City of San Diego has a new challenge that promotes bike riding, exploring the community and supporting local businesses. The Better by Bike blog is website that features everything from bike routes, to bike repair tips, to features on local bike riders.Part of the new program is a scavenger hunt that takes riders through the mid-city area. It ends Aug. 30 and is a competition to see who can get the most points after visiting local businesses and answering questions. The challenges range from taking pictures of specific spots to describing murals painted by local artists. It uses the Scavify application. Winners will then be awarded prizes, including gift cards to local restaurants.Anisha Gianchandani is the Climate Advisor for the City of San Diego and said this is part of a bigger-picture project to decrease greenhouse gas emissions and make San Diego more livable.“So it’s really just a fun way to get outside safely, enjoy your neighborhood and support small local businesses,” she said, later adding that “when you slow down, you get to see so many parts of your neighborhood that you normally wouldn’t see in a car.”It also helps local businesses. Stores and restaurants had the chance to submit their locations to be part of the scavenger hunt, which brings foot traffic to the area.Juan Pablo Sanchez’s family owns Super Cocina, one of the stops on the scavenger hunt. They had a local artist paint a mural on their wall outside, and their question pertains to that art.“We want to encourage you to use these streets, to go through us, to see our culture, to see the people that live here,” said Sanchez.Rudy Vargas, a native to the City Heights area, has embraced the challenge, heading up the leaderboard. He said even though he is familiar with his home, he’s still learned new facts about his neighborhood.“It was a good way to revisit some of my favorite places in City Heights but also visit some places I didn’t even know existed,” said Vargas.Vargas said he first picked up a passion for riding bikes when commuting to SDSU as a student, and has since kept up the passion.“My hope is that we continue this culture change and we step away from our vehicles because like I said there’s no other feeling like it,” he said. 2286
