SAN DIEGO (KGTV) — Heavy rains and wind across San Diego County hit one Coronado business particularly hard.The Coronado Tree Farm had only been open for about a week before Thursday's Grinch of a storm rolled through the area, heavily damaging the small farm at the ferry landing. The farm posted on Facebook that it would have to close for the season, before it could fully deliver some Christmas joy."Sad to say that the Tree Farm has to be closed down," the farm wrote. "The rain destroyed all our inventory and commercial props, generator, hay, games, prizes, tables, fencing, tents etc... We would have to start all over again in order to run it."Steve Albert, co-owner of the Coronado Flower Lady, told 10News they tried to curtail any damages but the weather simply took hold."I started trying to get everything I could under the big tent, and while I was doing that, one would break lose, and then another one," Albert said. "The whole thing is just kind of anchored together. The whole thing just went."Some of the trees and decorations are in good condition and will be offered up to anyone. SAN DIEGO (KGTV) — Four San Diego businesses, including two restaurants and two gyms, have filed a lawsuit seeking an emergency injunction to stop the latest shutdown orders.Under the red tier, both sectors were open for indoor operations as limited capacities. Restaurants were allowed to serve people inside at 25 percent of the normal capacity, and gyms at only 10%.On Saturday, purple tier restrictions will go into effect, meaning businesses like restaurants and gyms must shutdown indoor services completely and move outside.Cowboy Star Restaurant & Butcher Shop, Home & Away Encinitas, Fit Athletic Club, and Bear Republic filed the lawsuit against California Gov. Gavin Newson and the County of San Diego, as well as other state and county officials arguing that the closures go against their rights.The lawsuit states that Newsom and the California Department of Public Health (CDPH) lack the authority to impose the continuing restrictions on California businesses.All four businesses detail the numerous health and safety measures they’ve added to provide a safe environment for staff and customers during this pandemic.“I think it’s pretty clear that the law is on the side of governmental authority to try to get this under control,” said Jan Ronis, an attorney with the Law Offices of Ronis & Ronis. “Why they continue to file lawsuits… it’s beyond me.”Ronis is not involved in this case, but said when the pandemic began, he reviewed emergency legislation available to the government at both state and federal levels.“These laws have been in the book for decades, and governments have used them sparingly, and quite frankly think they’re valid as surprised as I was by the breadth and scope of government authority once these emergency declarations are declared,” said Ronis.He said he had seen similar lawsuits filed across the state during the last several months, and most don’t hold up in court.“I really feel sorry for the businesses, but the fact is this is a monumental health crisis,” said Ronis.Dr. Wilma Wooten, San Diego County’s public health officer, recently asked for the CDPH to allow the county to stay in the red tier. She explained that businesses that would be impacted the most by purple tier restrictions, like restaurants and gyms, are not the cause for the local increase in COVID-19 cases.The lawsuit said despite the data provided by Dr. Wooten, the CDPH still denied the request without any justification based on science or data.Both the law firm that filed the lawsuit and the County of San Diego refused to comment on this matter, stating they do not comment on pending litigation. 2646

SAN DIEGO (KGTV) -- For the third day in a row, the county is reporting record-high coronavirus numbers.The county is reporting 440 new cases Friday, bringing the total to 12,401.In addition to new cases, the county also hit one of its 13 triggers. County officials said Friday that the average number of hospitalized COVID-19 patients has increased by 19 percent in three days. SAN DIEGO (KGTV) — From in-person instruction to distance learning, and now hybrid classes in some cases, most school districts have been through a lot during this pandemic.Many parents have decided to turn to charter schools, which have excelled in distance learning for years.A spokesperson for the California Charter Schools Association said they’ve heard from non-classroom based charters in San Diego County that are seeing substantial enrollment requests this academic year.Some of the charter schools have taken on many new students, while others had to stop enrollment due to the lack of state funding.“In the beginning, a lot of big districts were not providing any resources, the kids were just off,” said Kathleen Hermsmeyer, the superintended of Springs Charter Schools.Springs Charter Schools has locations across Southern California, including in Vista and Chula Vista in San Diego County.“We’ve been in business doing this type of distance learning education for 20 years, so for us, this was not a big transition,” she said in regards to education during the pandemic.“We already had all of our technology, our learning management system, our systems down for distance learning, so it wasn’t a big transition.”Hermsmeyer said the students new missed a day of class during the pandemic, and early on, Springs Charter Schools enrolled an additional 130 students in San Diego before they knew they wouldn’t be receiving extra state funding.“The school year starts for us July 1, we didn’t find out until June 28 that we were not going to get funded for those students,” she explained. “They did say we can disenroll the kids, but we’re not going to do that, that’s not kind, that’s not a service to the community.”Right now, she said about 7,000 students remain on the Springs Charter Schools waitlist across California, with nearly 1,000 in San Diego County. Hermsmeyer said that’s about four times more than last school year.“We can’t accept the students because there has been a cap on growth for non-classroom based charters like ours,” she said.“Parents were clamoring to get into our schools, and we couldn’t enroll them, so we wanted to provide something because parents were crying on the phone, it was a really hard crazy time, and parents wanted to keep their children moving academically.”Springs Valley Schools then launched “Open Classroom,” an online website providing free lessons for students K through 12 at home.“We had thousands of people all across the whole world using our free classroom,” she said.Springs Charter Schools received an award from the National Alliance of Public Charter Schools for going above and beyond during the pandemic.Hermsmeyer said Springs Charter Schools, along with a few other charters, are in a legal battle with the state over the lack of funding to enroll new students.Springs Charter Schools expects to start bringing back some students for in-person learning by the end of the month, with a full distance learning option still available.The California Department of Education is tracking statewide enrollment numbers for charter schools and traditional schools and will release the numbers for the 2020-21 academic year in March. 3205
