SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation. The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. Medel stated that he would have a ruling by 5 p.m. on Friday. If not, he said he would issue his decision on Monday. 1916

SAN DIEGO (KGTV) - KAABOO Del Mar will become KAABOO San Diego in 2020 as the popular music festival held at the Del Mar Fairgrounds moves to Petco Park. The change was announced by its producers Sunday at the end of a sold-out three day festival, its fifth at the North County location. Concerts will be held on Petco Park's playing field, Sycuan Stage at the Park, Lexus Premier Lot, and the Tailgate Lot, KAABOO officials said. “The location of Petco Park and its surrounding venues in downtown San Diego provides fans and artists alike the opportunity to enjoy everything that the vibrant metro area has to offer. We couldn’t be more ecstatic about this partnership and our relocation,” said Jason Felts, Managing Partner of KAABOO. “Our venue and the downtown Ballpark District offer the perfect setting for an event of this magnitude and further establishes Petco Park as the premier entertainment destination in Southern California. We look forward to hosting an unforgettable and amazing weekend in the heart of downtown,” said Erik Greupner, Padres President of Business Operations. The festival will take place Sept. 18-20, 2020. "The Padres will return for the final 6-game homestand of the season (vs. MIN, LAD) just two days after KAABOO. The team is hoping to be competing for a playoff spot. Maintaining field integrity will be critical," 10News Sports Director Ben Higgins tweeted.Tickets are now on sale, including a 9 general admission pass. VIP passes are available for 9 and 99 and include options such as private restrooms, VIP-only performances, access to onstage viewing, and exclusive meet and greet opportunities. 1655

SAN DIEGO (KGTV) - Inside the 3D Innovations Lab at Rady Children's Hospital, the hearts, bones, skulls, and spines of patients are brought to life in a new way.Justin Ryan, Ph.D. is director of the lab. Using 3D printers, they can replicate a patient's anatomy down to every precise detail, giving doctors critical information before surgery.“The concept is by giving our doctors more information they can perform a better procedure; they can even perform it with less time. So that means less time under bypass, less time under anesthesia, which is great for the patients themselves," said Ryan. For example, if a patient is a candidate for a stent or valve, doctors could use the 3D model to try different sizes before entering the operating room. “We give them more information to plan a better procedure," said Ryan. While some of the models take several hours, many can be created within the day. “There isn’t an average day, I might have a cardiac case in the morning, an ortho case in the evening, I'll have a doctor have an idea for a medical device that they wanted to design or develop, and that all happens here," said Ryan. Ryan says the 3D models are also useful when explaining the procedure to families. The technology is currently being funded by grants and donations, at no extra cost to families. Ryan believes insurance eventually will help cover costs. 1381

SAN DIEGO (KGTV) - Living in San Diego is already expensive, and paying for satellite or cable TV can make it even more costly. Now, a growing number of residents are saying goodbye to cable and satellite, and subscribing to more affordable streaming services. "Really for us, I just felt guilty flipping through those channels all the time because I knew we're paying for them, but at the same time if it's not Game of Thrones we're not really watching anyway," said Jason Stump, who got rid of cable about four weeks ago. Stump, who lives in La Mesa, kept his cable for years because he feared not being able to watch live sports. But everything changed when he discovered that YouTube TV offered Fox Sports San Diego, which carries the Padres, four versions of ESPN, and the local channels. The price tag? a month, down from the 0 he was paying monthly for cable. RELATED: Cord cutters say they save money and get hundreds of viewing options"You cut a couple of costs there, next thing you know - our move from a one bedroom to a two bedroom apartment didn't increase anything," Stump said. Stump isn't alone when it comes to so-called cutting the cord. A study by Emarketer says about 22 million Americans ditched cable and satellite in 2017, looking to get rid of the average 5 per month bill, which also had added fees. There are plenty of streaming devices around, including Roku, Apple, Amazon Fire, and Android TV. They connect you to many popular streaming services.Plus, people can get local channels free over the air by buying an antenna, which can go for less than . Jim Willcox, senior electronics editor at Consumer Reports, says often times the signal over-the-air is better because it's not compressed by cable company transmission. RELATED: Hulu drops price of basic streaming plan, increases rate for live-TV streamingNow, cable companies themselves are offering streaming services. ATT Watch TV is as low as a month, but doesn't include sports. YouTube TV is a month and has local channels and unlimited DVR. Meanwhile, SlingTV goes for about a month but has no local channels. Instead, people can buy antennas to get over-the-air HD, which is free and can have a better signal. San Diego's COX Cable offers a Contour streaming service for subscribers. "We work hard to make sure customers are paired with the services that they want and need," the company said in a statement. "With other services, you may need multiple subscriptions, additional hardware, inputs and passwords which are often inconvenient and provide less programming choices at potentially the same or increased cost, depending on how many subscription services you need to get all the content you want."Still, there are drawbacks to cutting the cord. Willcox said cable is convenient and reliable. For instance, streaming services can lag or crash during highly watched events like the Super Bowl or a Game of Thrones premier. RELATED: How to stream thousands of movies — freeHe also added people may not get all the channels they want, leading to them spending more for add-ons. "You might get one of the cable cutting services a month, but you want to add HBO, and that's a month," he said. "There may be other channels you want a la carte, so you need to add all of that up and then see how much you're really saving."For now, Stump says he loves streaming those live sports. This fall, however, he'll have to make a choice. He wants NFL Network, but unlike his former cable service, YouTube TV doesn't provide it. SAN DIEGO (KGTV) -- It's not unusual to collect Christmas decorations year-round, but using them to cover every inch of a late model Dodge Caravan is pretty unique. He's known to many as the "Christmas Man of San Diego," whose van conversion continues to turn heads and spark smiles — no matter the season or social distance."He's a trans-dimensional emperor of over a google-plex of universes," said Larry Bogaert, as he stands with his pet parrot, Emerald Eagle, on his forearm. "I'm his Prime Minister and his daddy."In his mid-60s, Bogaert is a man with a big imagination who loves to share tales, turning his late-model Dodge Caravan into a storytelling canvas."I have Peter Pan, Wendy, Tinker Bell and the Boys going to Never Never Land," Bogaert shares.Almost every square inch of his vehicle features his own hand-drawn depictions of famed children's stories, mostly from English literature."And then I have Fezziwig's warehouse here," Bogaert says, pointing to various images on the car. "If you remember Scrooge did his apprenticeship at Fezziwig's.""For some things, I have a plan in mind, but other things as I buy things or acquire things you think, Oh, I can use that on the castle," Bogaert says, pointing to the roof of the vehicle which is covered by a towering display of church-like spires and angels. The hood is plastered with its own 3-D display of a miniature snow-covered town. And the sides of the van are covered in paint pen drawings all by his hand. The vehicle is a head turner and as we talk to Bogaert a couple of bicyclists stop to take pictures. Bogaert waves: "Thanks!" he says, before turning back to our camera, "99.9% of the time people give me the thumbs up. I've even had cops drive by and give me the thumbs up."Though, Bogaert admits there have been a few tickets over the years concerning visibility issues. But the former bus driver insists he's very good at using his side mirrors. Besides that, his inspiring creation has proven a good defense."One time the judge threw it out of court because she said her kids loved my car. She said case dismissed," he recalls.Another woman stops by on foot, "I like it. I think it's a positive message and we certainly need that now more than ever."Uncertain times for many, and Bogaert can relate to the feeling."With the coronavirus going on you should see how many people cheer my car because it's just something uplifting during these times," says Bogaert. "I like to be optimistic with the car. I like to be optimistic for myself if I can be. But I do get depressed."Underneath a kaleidoscope of ornaments inside the van, there is a snug space, where Bogaert sleeps, as — for the moment — this is his home."I bought a grocery store up in Crescent City. I always wanted to live in the redwoods," Bogaert said.He says that business venture years ago didn't go as planned, and the financial ramifications remain. But he doesn't dwell, as he focuses attention on another part of the van. After all, he and Emerald Eagle have a "google-plex of universes" to run. And they are, apparently, ever-expanding."I am adding more towers and a few more parts to it. I have some stuff inside that will go on in the next week or few days," said Bogaert. 3229
