BAKERSFIELD, California — A Kern County, California judge decided Thursday to set free a man who's been on death row for 26 years.Vicente Benavides, 68, was freed from San Quentin Prison Thursday afternoon.The judge said all Benavides' charges were changed to not guilty.  His defense attorney told KERO television station that Benavides will not have to return to Kern County.On Tuesday, District Attorney Lisa Green made the announcement that her office would not file charges against Benavides, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape, and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. Benavides' defense attorney says his client's case is extremely rare, saying only two similar cases have occurred since the death penalty was reinstated in the 1970's.The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based on the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted. 2101

As millions of Americans have been without work amid the pandemic, nearly 12 million people will lose unemployment benefits on December 26, according to the Century Foundation.The Century Foundation estimates that 7.3 million Americans will exhaust benefits from the Pandemic Unemployment Assistance program. The federal program extended unemployment benefits for millions of Americans who otherwise would not have received state unemployment benefits.According to the Century Foundation, 4.6 million Americans will lose benefits through the Pandemic Emergency Unemployment Compensation program on December 26. This fund extended state unemployment benefits for an additional 13 weeks. The 4.6 million Americans is in addition to the 3.5 million workers who will have lost PEUC benefits by then.“Congress has stared down major expirations of jobless benefits multiple times during the Great Recession and previous economic cycles,” the Century Foundation said. “Policy makers have been more comfortable with enacting temporary extended benefits programs with more predictable costs rather than improving the automatic stabilizers in (extended benefits) EB."While millions of Americans are set to lose benefits, there remains ongoing debate on Capitol Hill to provide some form of economic stimulus. There have been various proposals that would offer extended benefits, but the House, Senate and White House have struggled to find any sort of agreement.“With the stakes of the benefit cutoff perhaps higher than they have ever been before, there also seems to be a grave danger that unemployed Americans could be left behind during a lame duck session taking place in the overhang of a contested presidential election,” the Century Foundation said. “But the numbers—and families behind them—leave no excuses for inaction.” 1829

AVILA BEACH, Calif. — Officials say two women are lucky to be alive after a humpback whale capsized their kayak as they paddled in the ocean on Monday.The incident, which occurred near the Cal Poly Pier, was caught on video by multiple people in the area.Julie McSorley says she went out Sunday and took pictures of the whales and convinced her friend to go kayaking with her on Monday.McSorley says there were a lot of birds and fish in the area, so people had their phones at the ready. She said she and her friend could see whales off in the distance.Seconds later, one of the whales was right underneath them.While some video footage makes it appear as the women went inside the whale's mouth, McSorley says their kayak just overturned, and they were thrown underwater.Video shows McSorley screamed before going underwater for about five or six seconds.Humpback whales are considered an endangered species, and marine mammal experts say they can be unpredictable and dangerous. Experts say people should keep about a football field's worth of space between themselves and the large mammals, when possible.The Port San Luis Harbor Patrol says enforcement can be difficult. Boaters can think they've left a whale plenty of space, but the mammals move quickly.The whales have been making appearances close to shore between Morro Bay and Avila Beach in recent days. (AP) — The federal government is warning Americans to brace for a "floodier" future.Government scientists predict 40 places in the U.S. will experience higher than normal rates of so-called sunny day flooding this year because of rising sea levels and an abnormal El Nino weather system.A report released Wednesday by the National Oceanic and Atmospheric Administration predicts that sunny day flooding, also known as tidal flooding, will continue to increase."The future is already here, a floodier future," said William Sweet, a NOAA oceanographer and lead author of the study.RELATED: Devastating 'ARk' storm envisioned for California by U.S. Geological SurveyThe report predicted that annual flood records will be broken again next year and for years and decades to come from sea-level rise."Flooding that decades ago usually happened only during a powerful or localized storm can now happen when a steady breeze or a change in coastal current overlaps with a high tide," it read.The nationwide average frequency of sunny day flooding in 2018 was five days a year, tying a record set in 2015.But the East Coast averaged twice as much flooding.The agency says the level of sunny day flooding in the U.S. has doubled since 2000.Nationwide, the agency predicted, average sunny day flooding could reach 7 to 15 days a year by 2030, and 25 to 75 days a year by 2050.RELATED: How to check if your neighborhood is at risk of flooding"We cannot wait to act," said Nicole LeBoeuf, acting director of NOAA's Ocean Service. Within the last 12 months, it experienced an additional 12 days.Robert Kopp, a leading climate scientist with Rutgers University, who was not involved in the study, said it confirmed many well-established trends."It's simple arithmetic: If you have higher sea level, you will have tides causing flooding," he said. "We're not talking about disaster flooding. We're talking about repetitive flooding that disrupts people's lives on a daily basis. The water table has risen to ground level and degraded septic systems in the Miami region, and farmlands in the Delmarva Peninsula in Delaware and Maryland have been damaged by salt water encroaching into planted areas.High-tide flooding is causing problems including beach erosion, overwhelmed sewer and drinking water systems, closed roadways, disrupted harbor operations, degraded infrastructure and reduced property values — problems which "are nearly certain to get much worse this century," the report read.The report's statistics cover May 2018 through April 2019.The agency forecasts sunny-day flooding this year in Boston at 12 to 19 days (it had 19 last year). It predicted sunny-day flooding this year in New York (8 to 13 days, compared with 12 last year); Norfolk, Virginia (10 to 15 days; compared to 10 days last year); Charleston, South Carolina (4 to 7 days, compared to 5 last year); Pensacola, Florida (2 to 5 days compared with 4 last year); Sabine Pass, Texas (6 to 13 days compared with 8 last year) and Eagle Point, Texas (29 to 40 days, compared to 27 last year).West coast predictions included San Diego (5 to 9 days compared to 8 last year); Los Angeles (1 to 4 days compared to 5 last year); Humboldt Bay, California (6 to 12 days compared to 12 last year); Toke Point, Washington (9 to 21 days compared to 12 last year) and 2 to 6 days in Seattle, compared to 2 last year.The report documented that 12 locations broke or ties their record of sunny day flooding last year, including 22 in Washington, D.C., 14 in Wilmington, North Carolina; and 12 each in Baltimore and Annapolis.FEMA created flood maps of San Diego County which enable users to search by their address. ATLANTA (AP) — Police say actor Thomas Jefferson Byrd was shot and killed in Atlanta over the weekend.Authorities said he was shot in the back multiple times and was pronounced dead at the scene of the shooting on the city's southwest side.
