A former Google engineer is accusing the company of firing him after he spoke out about incidents of racism, sexism and harassment.Tim Chevalier is suing Google for retaliation, wrongful termination and failure to prevent discrimination and harassment, according to a lawsuit filed in San Francisco on Wednesday.Silicon Valley -- and Google in particular -- has been shaken by fierce debates over diversity issues. Highly charged arguments between Google employees have at times burst into public view as the company wrestles with how to address the concerns.The lawsuit by Chevalier, who identifies as transgender and disabled, claims Google's culture is discriminatory. He alleges that some employees use the company's internal social-networking and messaging systems to belittle and bully women, people of color and LGBTQ colleagues."Chevalier pushed back on the online bullying he and others were experiencing, using the same internal messaging systems to try to educate his employer and coworkers on how to change Google's working conditions to be inclusive and supportive of underrepresented minorities, such as himself," the lawsuit says.His lawsuit alleges that rather than trying to address the concerns he was raising about other employees' behavior, Google fired him in November, citing the political nature of his posts."It is a cruel irony that Google attempted to justify firing me by claiming that my social networking posts showed bias against my harassers," Chevalier said in a statement provided by his lawyers. She said that lively debate is important to Google's culture, but that there are limits."All employees acknowledge our code of conduct and other workplace policies, under which promoting harmful stereotypes based on race or gender is prohibited," Scigliano said in a statement. "This is a very standard expectation that most employers have of their employees. The overwhelming majority of our employees communicate in a way that is consistent with our policies. But when an employee does not, it is something we must take seriously. We always make our decision without any regard to the employee's political views."In the lawsuit, which was first reported by tech news site Gizmodo, Chevalier alleges that some Googlers would call coworkers "immoral" because of their sexual orientation. Employees also questioned the competency of women and minorities on internal message boards, he said."Company social networking forums can be incredibly useful, but employers have an obligation to prevent them from becoming a cesspool of bullying and harassment," David Lowe, an attorney for Chevalier, said in a statement. "Firing the employee who pushed back against the bullies was exactly the wrong step to take."Debates inside Google about diversity issues erupted in August when one of the company's senior engineers at the time, James Damore, published a controversial memo claiming women are underrepresented in technology because of psychological and biological differences, not sexism.In his memo, Damore claimed to "value diversity and inclusion," but he took issue with Google's approach, which he described as overly political and alienating to "non-progressives."Damore, who was fired over the controversy, and another former Google engineer, David Gudeman, are suing the company, alleging that it discriminates against white men and conservatives.Chevalier waded into the internal debates over Damore's memo last summer, according to his lawsuit. A locked-down pandemic-struck world cut its carbon dioxide emissions this year by 7%, the biggest drop ever, new preliminary figures show.The Global Carbon Project, an authoritative group of dozens of international scientists who track emissions, calculated that the world will have put 37 billion U.S. tons (34 billion metric tons) of carbon dioxide in the air in 2020. That’s down from 40.1 billion US tons (36.4 billion metric tons) in 2019, according a study published Thursday in the journal Earth System Science Data.Scientists say this drop is chiefly because people are staying home, traveling less by car and plane, and that emissions are expected to jump back up after the pandemic ends. Ground transportation makes up about one-fifth of emissions of carbon dioxide, the chief man-made heat-trapping gas.“Of course, lockdown is absolutely not the way to tackle climate change,” said study co-author Corinne LeQuere, a climate scientist at the University of East Anglia.The same group of scientists months ago predicted emission drops of 4% to 7%, depending on the progression of COVID-19. A second coronavirus wave and continued travel reductions pushed the decrease to 7%, LeQuere said.Emissions dropped 12% in the United States and 11% in Europe, but only 1.7% in China. That’s because China had an earlier lockdown with less of a second wave. Also China’s emissions are more industrial based than other countries and its industry was less affected than transportation, LeQuere said.The calculations — based on reports detailing energy use, industrial production and daily mobility counts — were praised as accurate by outside scientists.Even with the drop in 2020, the world on average put 1,185 tons (1,075 metric tons) of carbon dioxide into the air every second.Final figures for 2019 published in the same study show that from 2018 to 2019 emissions of the main man-made heat-trapping gas increased only 0.1%, much smaller than annual jumps of around 3% a decade or two ago. A Canadian judge who wore a "Make America Great Again" baseball cap in his courtroom has been suspended for 30 days without pay.A panel investigated complaints made about Ontario Justice Bernd Zabel stemming from an incident in November of 2016. The panel found that the judge wore the baseball cap into his courtroom, made comments about the U.S. presidential election, and also commented on his political views, as well as those of other judges. The panel also found that when the judge gave a public statement about that day in court, his comments were not consistent with what had happened.The panel hearing was held August 23, and the panel received 81 letters of complaint. Panel members also reviewed a number of other items, including an Agreed Statement of Facts, in which Judge Zabel admitted he "engaged in judicial misconduct." On September 11, 2017, the panel determined there was judicial misconduct, and suspended the judge for 30 days without pay. A group of Las Vegas shooting survivors is coming together to send a very special gift to Jason Aldean. Their goal is to use the gift to ask Aldean to come back to Las Vegas to finish his concert that was tragically interrupted the night of the mass shooting.Tiffany Thomas created a Facebook group called “58 Survivors 1 Last Set." Survivors of the shooting quickly learned about the group and the online community chatted about their stories of that infamous night.“After it happened, all I could think about was Jason Aldean,” said Thomas. “I kept thinking like he was up there, he was on that stage, he was singing for us.”Through the Facebook group, Tiffany met another survivor named Gina McKin. The women came up with the idea to make a Shutterfly book to send to Aldean.McKin took charge of the book and asked everyone to send their favorite pictures of the night before the shooting rang out.The book ended up being 91 pages long to represent Route 91.In the book, McKin dedicated different pages to victims and survivors. Some people wrote messages to Aldean.The 0 book took months to finalize.The group of women are sending the book to Aldean along with a few other special items.They are using the gift to ask Jason Aldean to come back to Las Vegas and finish his set. Their idea is to open the concert up to survivors and victims and families of the victims.“It would just be so bonding and so amazing and so emotional and I think so healing.”Scripps station KTNV in Las Vegas was in touch with Jason Aldean’s communications team about the book.KTNV was told they are excited to see the book but cannot officially comment on if Aldean will be back to perform just yet.The women are putting the package in the mail this week. “I hope that when he opens it, he just sees that we love him and that we know what he’s going through,” McKin said. 1889
A growing group of Republicans want Attorney General Jeff Sessions to be the party's choice in the Alabama Senate race, but ethics experts say Sessions either would have to have to leave the Department of Justice or continually disavow campaigns to put him in the seat if he wants to run for the office and avoid legal trouble.This week Senate Majority Leader Mitch McConnell of Kentucky and Senate Majority Whip John Cornyn of Texas both said they would support Sessions as a write-in candidate over Republican candidate Roy Moore, who has been accused of pursuing sexual relationships with teenagers when he was in his 30s.Moore denies the allegations, and says he has no plans leave the race. And Sessions has not indicated that he's planning to run for his old seat.But ethics experts say that even if Sessions does not himself campaign to be a write-in candidate in the race, he could have an "affirmative duty" to disavow campaigns to put him in the Senate while he's still the attorney general. If he remains silent, he could be in violation of the Hatch Act, a 1939 law restricting the ability of most federal employees to engage in political campaign activities.Walter Shaub, a former director of the US Office of Government Ethics who's now at the nonprofit Campaign Legal Center, told CNN that the federal Office of Special Counsel has issued an advisory opinion on write-in candidates, which specifies:"(S)uch a candidacy is permissible only if spontaneous and accomplished without an employee's knowledge. You acknowledge that you have heard rumors of a write-in effort to elect you to the school board. It would be a violation of the Act if you encouraged this effort or remained silent. The Act imposes on you an affirmative duty to disavow this effort through public announcements and other appropriate means." It remains to be seen whether the OSC considers the comments by McConnell and Cornyn as imposing an "affirmative duty.""There's a question as to whether it's a write-in campaign or a stray comment from one guy," Shaub said following McConnell's comments. "If McConnell keeps talking about it, he's going to create an affirmative duty."Larry Noble, a senior director at the Campaign Legal Center who's a CNN contributor, said Republicans such as McConnell are "putting (Sessions) in a very difficult position" by even suggesting he be a write-in candidate."We are close to the line of his having to disavow," Noble added.For Sessions to be eligible as a write-in candidate, Noble said, he would have to "affirmatively disavow" any campaign or resign from office to avoid violating the Hatch Act.Sessions would likely be asked about his support for the write-in candidacy frequently until the December 12 election. Questions could also be raised about whether he was having private conversations about the effort with the state party and the Republican National Committee, which also would violate the Hatch Act.In response to a request for comment, Sarah Isgur Flores, director of public affairs for the Department of Justice, said, "Our ethics officials will need to evaluate precisely what has been said by others and then review what, if any, affirmative obligations we may have."Samuel Bagenstos, a University of Michigan Law School professor who specializes in constitutional litigation, noted that a few previous attorneys general -- including Dick Thornburgh and Robert Kennedy -- have campaigned for Senate seats, but neither were floated as write-in candidates."It's extremely suboptimal for an attorney general, who is supposed to have some insulation from electoral politics, to be actively running for a political office," Bagenstos said, adding, "And of course there would be lots of possible recusal questions."Aside from ethical considerations, running as a write-in candidate would be a long shot even if Sessions resigned.Few candidates have won Senate seats via write-in campaigns. Sen. Lisa Murkowski, R-Alaska, won her seat that way in 2010, but prior to her election the last person to do it was Strom Thurmond in 1954.However unlikely, a Sessions victory would serve two purposes for the GOP: The party would retain the seat, and Sessions would leave the DOJ after months of public criticism by President Donald Trump over his decision to recuse himself from the Russia investigation and not to prosecute Trump's political enemies. 4412
