SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. SAN DIEGO (KGTV) - A bicyclist suffered life-threatening injuries after crashing near University of San Diego's campus.The bicyclist, identified as a 36-year-old man, was riding in the westbound bike lane along the 5600 block of Linda Vista Road at about 8:30 p.m. Friday, according to San Diego Police. Then for an unknown reason, police said the bicyclist overturned and crashed.The man was wearing a helmet at the time of the crash.He was transported to a nearby hospital with a skull fracture and several other serious injuries - which were considered life-threatening, police said.SDPD Traffic Division is investigating the cause of the crash. 661

SAN DIEGO (KGTV) - A former gang member who turned his life around in stunning fashion just got accepted to four different universities, including UC Berkeley and UC San Diego. 10News first met Apollo in 2010, as he and several others went to court to get off a gang injunction list for an Oceanside street gang.  An injunction prevents gang members from doing activities in certain areas, like associating with each other.  At that time, Apollo told us he had been out of the gang for several years after four years inside as a teenager."What hurt the most is hurting my mother... You want to amount to something, so (when i decided to get out) I'm trying to do this for her," said Apollo.Apollo was removed from the list about a year later, which is a rare feat. Among the requirements: written explanations, background checks, and approval from prosecutors and a judge.Since then, he has gone on to Palomar College, earned awards at speech and debate competitions, and at the age of 30, he just got accepted to four schools, including UC Berkeley and UCSD.  He's leaning towards Berkeley, though he isn't sure he can pay for it.  He's hoping to have a career in communications or social welfare so that he can help his community."Sometimes I can't believe it and sometimes I feel I should be doing more.  You want to leave something for them to look at, to hopefully inspire them to do more and succeed," said Apollo. 1473

SAN DIEGO (KGTV) -- A graduate program at the University of San Diego that teaches peacebuilding will evaluate whether or not to send students back to Culiacán, Mexico. The concern comes after Thursday's bloody battle involving Mexican federal troops and the son of notorious drug lord Joaquin "El Chapo" Guzman.The USD Kroc School's Trans-Border Institute has been regularly taking graduate students to Culiacán for the last five years, offering seminars and certificate programs in peacebuilding that have had an impact on the region, said program director Ev Meade."It's one of the only states in Mexico that's actually improved with respect to violence and was on the upswing until 3:30 yesterday afternoon and now all bets are off," Meade said in an interview.Meade was scheduled to speak at a conference on Friday but had to cancel the trip abruptly when cartel shooters laid siege to the city.The incident began when members of the Mexican National Guard patrolling a neighborhood in Culiacan and were ambushed by members of the Sinaloa drug cartel. Among those members of the criminal gang was Ovidio Guzman Lopez, the son of "El Chapo" Guzman.Cartel forces blocked roads with burning cars and demanded the release of El Chapo's son, who had been captured by Mexican security forces.Violence spread across the city until authorities suspended operations and released Ovidio Guzman Lopez.At least seven people were killed in the battle, one Mexican National Guard member, one civilian, and five cartel members, according to Security Minister Alfonso Durazo."It was terrifying. SAN DIEGO (KGTV) -- A boy who went missing on his way home from school Tuesday afternoon has been found safe, police say. The boy’s parent’s called police to report him missing around 2:15 p.m. Tuesday. Police could be seen in San Diego's Skyline neighborhood searching for the boy. Police say the boy usually walks home from school. According to police, the 9-year-old was found at a McDonald's. 405
