A California teacher was arrested Wednesday after a video posted to Reddit shows her cutting students' hair while singing the "Star-Spangled Banner."Margaret Gieszinger, 52, was arrested and changed with abandonment and neglect of children.According to NBC News, Gieszinger is a teacher at University Preparatory High School in Visalia, California. The video shows Gieszinger in a classroom, cutting chunks of hair from a male students' head and throwing it behind her as she sings the national anthem.After cutting the boys' hair, she threatens to cut other students' hair.The College of the Sequoias Chief of Police confirmed to NBC News that the video was the reason for the arrest.Gieszinger is currently being held in the Bob Wiley Detention Center in Tulare County, California on 0,000 bond. A body found in Costa Rica has been identified as a Florida woman who went missing while she was on vacation, according to her family. The father and brother of Carla Stefaniak identified the body as the 36-year-old Tuesday night.During an exclusive interview with ABC Action News, Stefaniak's father, Carlos, said his heart shattered when he saw her body.Costa Rica's Judicial Investigation Agency (OIJ) said an autopsy performed on her body showed that she had stab wounds around the neck and extremities and blunt-force trauma to the head.Family friend, Greg Zwolinsky, who is with them in Costa Rica, said he wants everyone to remember Stefaniak based on the radiance of her personality that is portrayed in pictures of her smiling.On Monday, a spokesperson for the OIJ confirmed that remains were found. The body was found in a wooded area as investigators combed through the region, roughly 1,000 feet away from where Miami resident and Tampa native, Carla Stefaniak, spent what was supposed to be her final night in Costa Rica last week, Judicial Investigator Director Walter Espinoza said in a press conference. On Monday night around 11 p.m., OIJ officials detained a security guard at the apartment complex, 32-year-old Bismarck Espinoza Martínez. Martínez has been in Costa Rica since June 2018.After Stefaniak was reported missing, agents began to investigate where she was last seen. Officials say that Martínez had the time and space to commit this crime and became a suspect because of the investigation. Specifically, his statements did not match video surveillance in and around the area at that time.In addition, fluids found in the apartment where Stefaniak was staying have the consistency of blood, OIJ officials said.Stefaniak traveled to Costa Rica to celebrate her 36th birthday, according to the family. She left for Costa Rica on Thanksgiving Day but had not been heard from since Tuesday, her brother, Carlos Caicedo, told ABC Action News.Meanwhile, the lawyer representing the complex that houses the Airbnb told ABC Action News they were "deeply saddened and devastated by the tragic events that occurred last week" and said that the owners were cooperating with authorities. He said the rental had been temporarily closed while officials conduct the investigation. The lawyer released the following statement:"Since 2013, Villa Le Mas has operated a small vacation rental facility located at San Antonio, Escazu, Costa Rica. We have received over a thousand guests with wonderful reviews about the property and our service.We are deeply saddened and devastated by the tragic events that occurred last week. The owners are fully cooperating with the authorities in the investigation and we hope that once the facts are determined, the perpetrator is brought to justice.Our deepest sympathies are with the family of the victim of this horrible crime.While the investigation is ongoing, and since the focus of the owners is the comfort of our guests, the facility has been temporarily closed."Now that Stefaniak has been identified by her family, they say they will continue to press Costa Rican officials for more information on who killed her.  3301

A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

  

A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. If you've heard the phrase 'got off on a technicality,' this is the phrase to the most stark sense I've ever seen it," said Rubinstein.Reports state that McFadden has been exonerated from all of his charges and does not have to register as a sex offender. 1661
