BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. BOSTON (AP) — Federal immigration agencies have launched a coordinated campaign to arrest and deport immigrants seeking to become legal U.S. residents through marriage, according to documents released this week in a class-action lawsuit filed by the American Civil Liberties Union.The documents, which include depositions and correspondence from federal officials, show the extent to which officials for the U.S. Citizenship and Immigration Services have been coordinating with their counterparts at Immigration and Customs Enforcement to facilitate arrests at citizenship offices in New England.The ACLU, in its arguments, criticizes the efforts as a deportation "trap" that violates the constitutional rights of immigrants otherwise following the rules to become legal residents."The government created this path for them to seek a green card," Matthew Segal, legal director for the ACLU of Massachusetts, said in an interview Tuesday. "The government can't create that path and then arrest folks for following that path."A spokesman for USCIS said the agency doesn't comment on pending litigation, and ICE representatives didn't immediately respond to requests for comment. The two agencies both fall under Department of Homeland Security oversight.The ACLU lawsuit argues that Homeland Security regulations created under former President Barack Obama allow immigrants with U.S.-citizen spouses to stay in the country while they seek a green card — even if they're already subject to deportation."That regulation is still the law of the land," Segal said Tuesday. "So arresting these folks is not about law and order. These are people with a path to legalization and the government is trying to block that."The federal government, in seeking to dismiss the lawsuit, argues in part that the federal District Court has no jurisdiction in the matter.The ACLU's more than 250-page legal brief includes emails between ICE officials outlining how it coordinates arrests with USCIS in New England.Andrew Graham, a Boston-based ICE officer, said the agency generally receives from USCIS lists of immigrants seeking legal residency who have already been ordered for deportation, had re-entered the country illegally or were considered "an egregious criminal alien."Graham says ICE then works with USCIS to schedule interviews so that ICE agents can be present to make an arrest. He notes ICE prefers to spread out the interviews to ease the workload on its agents and to prevent generating "negative media interest" from the arrests."In my opinion, it makes sense for us to arrest aliens with final removal orders as they represent the end of the line in the removal process," Graham wrote in part. "(A)t the end of the day we are in the removal business and it's our job to locate and arrest them."The ACLU's legal brief is the latest in the class-action suit it filed earlier this year on behalf of immigrants who have been or fear being separated from their U.S.-citizen spouses.The case will be argued Aug. 20 in Boston federal court and names five couples, including lead plaintiffs Lilian Calderon and Luis Gordillo, of Rhode Island.Gordillo is a U.S. citizen, but Calderon is a native of Guatemala who came to the country with her family at the age of 3. She was ordered to leave in 2002 after her father was denied asylum.The 30-year-old mother of two was detained by ICE in January after she and her husband attended an interview at the USCIS office in Johnston, Rhode Island, to confirm their marriage.Calderon was released in February after the ACLU challenged the detention. 3588

  

BOSTONIA (CNS) - A 29-year-old woman was killed in a two-car collision in a neighborhood just north of El Cajon Friday, authorities reported.The woman was making a left turn from northbound Peerless Drive onto westbound Pepper Drive in the Bostonia area when her 2000 Chevrolet Malibu was struck broadside by an eastbound 2003 Volkswagen Passat shortly before 7:30 a.m., according to the California Highway Patrol.Medics took the mortally injured El Cajon resident to Sharp Memorial Hospital, where she was pronounced dead, CHP public affairs Officer Travis Garrow said.Her name was withheld pending family notification.The driver of the Volkswagen, a 22-year-old El Cajon man, suffered minor injuries in the crash, Garrow said.Investigators were attempting to determine which driver was at fault. 805

  

BOSTONIA (CNS) - A 16-year-old boy was hospitalized in critical condition this morning with injuries he sustained in a shooting at a marijuana dispensary near El Cajon and the shooter was at large this morning.The gunfire in the 1600 block of North Second Street in the unincorporated Bostonia community was reported shortly after noon Friday, according to Sgt. Phillip Beaumont of the San Diego County Sheriff's Department.Following the shooting, the victim was driven out of the area and dropped off at a gas station about a mile to the south, where he was found by officers from the El Cajon Police Department, Beaumont said.Paramedics took the wounded teen to a hospital in critical condition for treatment of his wounds, Beaumont said.Deputies took several people into custody at the dispensary for questioning and searched the area for the shooter by ground and aboard a patrol helicopter, Lt. Pat McEvoy said.No arrests were reported. 949
