SAN DIEGO (KGTV) — A new lot meant to give people living in their cars and RVs a safe place to sleep and avoid citation is going largely unused.During Tuesday morning's wee hours, the lot across from SDCCU Stadium looked completely empty. San Diego opened the lot in mid-June, as the third safe parking lot for those who live in their vehicles. The newest one came a month after the council enacted an emergency ordinance that banned people from living in cars and recreational vehicles on public streets from 9 p.m. to 6 a.m. The city enacted the restriction after being inundated with safety concerns from residents who said people were camping in their beach front neighborhoods, leaving human waste, and trash. At Mission Bay on Tuesday, many who do live in their vehicles said they would prefer to stay near the coast, despite the threat of citation. "They don't know about it, and maybe it's not that convenient either," said Gary Parsons, who lives inside his Dodge Ram. "Inside I put in some carpet, and some shelving, and I sleep on the floor."Chris Enders, who lives in an RV with his wife and son, said they spend their nights on unchecked private property, such as parking lots near the beach. He said the Mission Valley location is not feasible."When you're getting five miles a gallon in gas, that's .75 just to get there, and then to get back that's another .75 so you just cost me ... for one day," said Enders.The lot requires all vehicles to be out by 7 a.m. daily. Ashley Bailey, a spokeswoman for the mayor, said the city and Jewish Family Service are working to bring more people to the lot."In partnership with Jewish Family Service, teams are continuing to conduct outreach and seek feedback to ensure everyone who wants to use this lot has the opportunity to do so," she said in a statement. SAN DIEGO (KGTV) - A San Diego elementary school teacher was arrested this week and accused of distributing child pornography.Authorities arrested 59-year-old David Weaks, a fifth-grade teacher at Rosa Parks Elementary School in City Heights, Thursday and charged with distributing child pornography of young girls, including a toddler, according to a complaint filed by the U.S. District Court, Southern District of California.According to documents, a U.S. Department of Homeland Security special agent was able to download two child pornography videos of young females from Weaks computer through peer-to-peer software.The IP address associated with the download was tracked to a residence in San Diego and a subscriber with the last name of Weaks, the complaint says.Authorities say a search of Weaks' residence and his computer revealed numerous files featuring child pornography.The complaint said Weaks admitted to obtaining and distributing child pornography through the file-sharing software over the internet. He also admitted to possessing similar materials on an external hard drive.Weaks is scheduled for a detention hearing on April 24. The government has requested he be held without bond on the grounds that he "is a danger to the community and a flight risk."He faces a maximum of 20 years in prison and 0,000 fine if convicted. 1421

SAN DIEGO (KGTV) — A San Diego judge says police departments must release records related to officer misconduct.The decision comes after local media groups, including 10News, sued to keep some police unions from blocking departments from following a groundbreaking new law in California.“This court finds that Senate Bill 1421 applies retroactively, to all, keyword, all personnel records of peace officers not only now but prior to January 1, 2019,” said San Diego County Superior Court Judge Eddie Sturgeon.Senate Bill 1421 requires departments to release records of officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault to the public.Several police associations in San Diego County sued to block the release of records, arguing Senate Bill 1421 doesn’t contain any express provision or language requiring retro-activity or any clear indication that the legislature intended the statue to operate retroactively. They claimed the bill eliminates the longstanding statutory confidentiality of specified peace officer or custodial officer personnel records.“These records have been under seal for 45 years, and when you have that kind of duration, and decisions are made for that long than it is going to create substantial disruption when the law changes, and all of a sudden these things have been under seal for four and half decades are available for public perusal,” said Richard Pinckard, attorney for the unions.An attorney for the ACLU argued they intervened in the case to defend the public right to know saying the law was designed to be retroactive.“These are fundamental matters that the public has a right to know,” said David Loy, attorney for the ACLU of San Diego & Imperial Counties. “To restore public trust the public has to have the right to know and observe what the officers have done and what the agencies have said about it.”The Judge ruled no records could be released before March 29. SAN DIEGO (KGTV) - A local family is remembering their mother who died suddenly after suffering a brain aneurysm.Monica Pimentel, 43, collapsed at her home on May 17. She died the next day at the hospital with her family by her side. Monica was born and raised in San Diego. She graduated from Patrick Henry High School and was deeply involved in the San Carlos community. She was the mother of four children.This is the second time tragedy has struck the Pimentel family. In 2014, one of their daughters, Jewelean Pimentel, died from bacterial meningitis. Jewelean was a freshman at Patrick Henry and was also a cheerleader for the school. The family's father is devastated after suffering two heartbreaking losses.
